Abstract

This article aims to analyze the objective condition for disseminating information on development performance and governance in the Serang City Government? What are the obstacles and obstacles for the City of Serang Communication and Information Technology in disseminating information on the development performance and governance of the Serang City Government? Where the current millennial era certainly requires information technology support, for example, by using the internet as an instrument for disseminating information by using online or online-based support. This study uses a qualitative research method with a normative juridical and empirical juridical approach. The information dissemination system needs a sustainable effort in structuring instrument by implementing the use of information technology as an intermediary and a more coordinated and consolidated chain of information dissemination, as well as stimulating the acceleration of the presence of smart government as a support for the realization of an informative society in Serang City. Of legal protection that is just, harmonious, and under the State Administrative Court Law and the 1945 Constitution of the Republic of Indonesia as the basis of the Indonesian state.

Abstract

The 2024 Simultaneous Regional Elections mark a critical moment in Indonesia’s democracy, especially for first-time voters who play a key role in shaping local political dynamics. This research explores the role of first-time voters in Serang Regency, Banten, focusing on their political rights and responsibilities, and the implementation of legal norms around political participation. Employing a normative research method, the study analyzes regulations and official data to assess how well first-time voters understand and exercise their political rights. The findings indicate that their participation not only enriches local political dynamics but also provides valuable insights for developing political education strategies, particularly in schools like SMAN 1 Pabuaran. Policy implications include strengthening collaboration between local governments, election organizers, and educational institutions to enhance first-time voter participation, fostering a more inclusive and transparent democratic process.

Abstract

The background of the research is that cross-border haze pollution that hits Indonesia and Malaysia occurs almost every year, and this problem has not been resolved from the past until now. Humans, as the caliphs of Allah SWT on earth, are still unable to maximise their duties in preserving nature, forests, and the environment. The aim of the research is to find out the latest issues in the problem of cross-border haze pollution in Indonesia and Malaysia so that we can analyse solutions according to Islamic law and international environmental law. The research method used is normative juridical with a statutory approach, a concept approach, and a case approach. Using qualitative descriptive methods. The results of the research are that the management of natural resources is not in accordance with the principles of international law, causing air pollution, which has a negative impact on Indonesia and Malaysia. The research conclusion is that the biggest factor triggering the problem of smoke pollution is forest and land fires, which are mostly caused by human actions. Law enforcement in preventing and taking action against perpetrators is still not effective, especially since there is interference from powerful elements who take part. The research suggestion is that society, in its role as caliph, must be able to act wisely and judiciously in managing the natural wealth on this earth so that environmental sustainability will be maintained. The government must be proactive in collaborating with neighbouring countries in overcoming the haze problem.

Abstract

Population growth and welfare development in each province, particularly Banten, have been inadequately supported by the management of natural resources. In fact, such conditions are prevalent across Indonesia. Accordingly, the study aims to investigate the regulation of central and regional relations under Law Number 1 of 2022: Financial Relations between the Central and Regional Governments, as well as their Ideal Format based on Natural Resource Utilisation in Banten province. The study employed normative juridical methods. The study took place in Banten Province. The findings are that the financial administration system, regulating central and regional relations, is law number 1 of 2022; financial relations between central and regional governments, which provide regional income sources, manage transfers to regions, manage regional expenditure, give authority to carry out financing regions, and implement national fiscal policy synergies in a fair, transparent, accountable, and harmonious manner. Framework of the Unitary State of the Republic of Indonesia: optimal structure of central and regional relations—the utilisation of natural resources in Banten Province. In particular, the management of natural and other resources, as stated in the Profit Sharing Fund layout, which is standardised in the law on central and regional financial relations, is referred to as implementing regional autonomy through a clustering mechanism between regions while considering the ecological and conditional factors (economic, social, and political conditions). To summarise, harmonisation and coordination between the central and Banten provincial governments are highly required. In addition, the Banten provincial government should immediately issue derivative regulations to facilitate policy implementation.

Abstract

This study aims to understand the regulation of illegal logging in Indonesia as well as to analyse the implementation of forest police authorities in combating illegal logging in Mount Ciremai National Park. This study applied a juridical-empirical approach that involves literature study and field research in which the primary, secondary, and tertiary data were collected through observation and interviews. The results indicated that illegal logging is governed in Articles 12, 19, 82, 83, and 87 of Law No. 18 of 2013 on the Prevention and Eradication of Forest Destruction, and the forest police authorities are regulated in Article 51 paragraph (2) of Law No. 41 of 1999 on Forestry and Article 4 paragraph (2) of the Regulation of the Minister of Forestry of the Republic of Indonesia No. P.75/Menhut-II/2014 on Forest Police, which serve as the regulatory framework for forest police in addressing illegal logging in Mount Ciremai National Park. In carrying out his/her authorities, the forest police apply 3 (three) approaches, namely preemptive, preventive, and repressive. Hence, it can be concluded that illegal logging is governed by Law No. 18 of 2013 on the Prevention and Eradication of Forest Destruction, and the implementation of forest police authorities in combating illegal logging is carried out through a preemptive, preventive, and repressive approach. Finally, it is suggested that law enforcement officials must be consistent and firm in taking action against illegal logging to create a deterrent effect, and the improvement of facilities and infrastructure is urgently needed.

Abstract

The enactment of the Job Creation Law is seen as strengthening centralization. "Some of the material contained in the Job Creation Omnibus Law has reduced the widest possible autonomy rights granted to regional governments, both provincial and district or regional authorities based on Article 18 paragraph (5) of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945)". This article intends to re-read the principles of decentralization related to the Authority of Regional Governments in Implementing Licensing After the Implementation of the Job Creation Law. The problem studied in this article is related to the concept of implementing licensing in the regions before and after the enactment of the Job Creation Law, whether the principle of decentralization is starting to shift back towards centralization through the authority of the central government in relation to regional authority in terms of business licensing in the regions. In this paper the author uses legal theories and statutory regulations related to this research. Then, in the research method for this article, the author uses the Normative Juridical Research Method (Legal Research). Since the enactment of the Job Creation Law, the flow of regional government towards recentralization has become stronger and Indonesia's regional autonomy has become increasingly questionable. "Some of the material contained in the Job Creation Omnibus Law has clearly reduced the widest possible autonomy rights granted to regional governments, both provincial and district based on Article 18 paragraph (5) of the 1945 Constitution of the Republic of Indonesia (1945 Constitution of the Republic of Indonesia). ". With the current enactment of the Job Creation Law, regional authority is only as a verifier of licensing files, so they do not have the authority to issue or not issue a permit, even though the background to the creation of this Law is to improve the investment ecosystem and regional business activities to encourage regional prosperity.

Abstract

Instilling anti-corruption values is something that must be done from children to adults, and is done anywhere, even in schools or learning places, especially for high school students in Serang City. These Anti-Corruption Values must be taught and practiced in schools so that they can be brought and practiced to society by students, so that opportunities for committing Corruption in everyday life can be minimized. Teachers as educators also have an important role in directing students not to commit corruption, no matter how small, in real life. The instillation of Anti-Corruption Values is in accordance with the 9 Integrity Values issued by the Corruption Eradication Commission which are believed to be able to prevent criminal acts of corruption, namely including the values of "honesty, caring, independence, discipline, responsibility, hard work, simplicity, courage and fairness." ”. Methods for Increasing Understanding of Anti-Corruption Values are carried out through Socialization and Dialogue with Students of SMAN 1 Serang City and Training of Trainers for Teachers of SMAN 1 Serang City, Program for Increasing Anti-Corruption Values for Teachers and Students in the SMAN 1 City School Environment Serang is an application of the JAWARA Values (Honest, Fair, Dignified, Trustworthy, Religious and Accountable) at Sultan Ageng Tirtayasa University in eradicating criminal acts of corruption both on campus and in the communities of Serang and Banten cities. Apart from that, this activity to increase Anti-Corruption Values is also an embodiment of Untirta's vision of "Character", so this is Untirta's commitment to creating not only students but also people with character, so that this activity to increase Anti-Corruption Values is one of UNTIRTA's commitments. to move together with the community in eradicating corruption and becoming a spring that refreshes the thirst of the surrounding community. One of the efforts made by universities in the Anti-Corruption Values Improvement program is by providing outreach to students of SMAN 1 Serang City as well as Training of Trainers for Teachers of SMAN 1 Serang City. It is hoped that this socialization activity can instill an anti-corruption culture for students at SMAN 1 Serang City and become a guide for teachers at SMAN 1 Serang City in directing students to reject all forms of corruption from various small things in everyday life. So that an Anti-Corruption Culture can be created, especially in Serang City.

Abstract

Peningkatan penyelarasan kebijakan antara pemerintah pusat dan pemerintah daerah diperlukan untuk menerapkan kebijakan strategis peningkatan investasi dan penciptaan kerja tersebut. Ini terutama berlaku untuk mempercepat proyek strategis nasional, mengatur administrasi perpajakan daerah, dan menyediakan kemudahan berusaha. Dengan demikian, beberapa peraturan pajak daerah telah diubah. Pasal 156A Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja menyatakan bahwa pemerintah dapat mengubah kebijaksanaan terkait tarif pajak dan retribusi daerah yang ditetapkan oleh pemerintah daerah sesuai dengan program prioritas nasional. Masalah hukum kemudian muncul bagaimana pelaksanaan hubungan antara pemerintah pusat dan pemerintahan daerah dalam penetapan tarif pajak daerah apakah telah mampu mengantisipasi terjadinya ketidakslarasan kebijakan pajak daerah tersebut.Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan. Berdasarkan hasil pembahasan yang ada, hasil penelitian ini sebagai berikut: Pertama, kewenangan dalam penyelenggaraan penetapan pajak daerah menurut Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja mecangkup: (a). peningkatan ekosistem investasi dan kegiatan berusaha; (b). peningkatan perlindungan dan kesejahteraan pekerja; (c). kemudahan, pemberdayaan, dan perlindungan koperasi dan usaha mikro, kecil dan menengah; dan (d).  peningkatan investasi dan percepatan proyek strategis nasional. sebagaimana diatur dalam Peraturan Pemerintah Republik Indonesia Nomor 10 Tahun 2021 Tentang Pajak Daerah Dan Retribusi Daerah Dalam Rangka Mendukung Kemudahan Berusaha Dan Layanan Daerah. Kedua, hubungan antara pemerintah pusat dan pemerintah daerah dalam penetapan tarif pajak daerah sebelum dan sesudah pembentukan undang-undang nomor 11 tahun 2020 tentang cipta kerja kondisi faktual saat ini Pemerintah Daerah tetap memiliki kewenangan dalam rangka penetapan tarif pajak daerah dan retribusi daerah sebagaimana hal tersebut diuraikan di dalam Pasal 189 ayat (2) Undang – Undang Nomor 1 Tahun 2022 tentang Hubungan Keuangan antara Pemerintah Pusat dan Pemerintah Daerah daerah yang menyesesuaikan dengan program-program prioritas nasional dalam menentukan tarif pajak daerah sesuai batasan tarif yang dikeluarkan oleh Pemerintah Pusat.

Abstract

Sistem Informasi Desa merupakan amanat Undang-Undang Nomor 6 Tahun 2014 tentang Desa yang ditujukan langsung kepada pemerintah daerah sebagai fasilitator di daerah. Keberadaan sistem informasi desa dapat memberikan gambaran mengenai kondisi geofrafis, budaya, dan fisik tentang desa itu sendiri. masyarakat hukum adat merupakan bagian terpenting dalam sejarah perkembangan bangsa Indonesia. Kontribusi yang diberikan masyarakat hukum adat sejak zaman dahulu sangat besar bagi perkembangan peradaban manusia terlebih pada aspek ketertiban yang ada dalam hukum adat. Suku Baduy merupakan salah satu masyarakat hukum adat yang masih terjaga eksistensinya sampai saat ini di Provinsi Banten. Untuk itu perlu diketahui bagaimana pengaturan hukum mengenai Sistem Informasi Desa untuk desa adat khususnya Desa Adat Baduy dan bagaimana pelaksanaannya sampai saat ini dalam upaya optimalisasi tata kelola pemerintahan desa.Metode penelitian yang digunakan adalah metode peneitian yuridis normatif dengan pendekatan peraturan perundang-undangan. Menggunakan data sekunder seperti literatur dan kepustakaan tetapi juga menggunakan data primer atau data lapangan sebagai data penunjang. Berdasarkan hasil penelitian diperoleh simpulan bahwa Sistem Informasi Desa pada desa adat merupakan suatu hak bagi masyarakat desa adat dan harus dipenuhi oleh pemerintah pusat maupun pemerintah daerah terkait. Saat ini Desa Adat Baduy belum menggunakan Sistem Informasi Desa secara menyeluruh sebagai salah satu upaya optimalisasi potensi desa adat dan penyelenggaraan pemerintahan desa dengan baik. Oleh karena itu penerapan Sistem Informasi Desa pada Desa Adat Baduy harus segera dilaksanakan karena hal tersebut merupakan amanat undang-undang terlebih pada desa adat akan menjadi salah satu perangkat guna meningkatkan potensi dan kekhususan Desa Adat Baduy.
