Abstract

Purpose: This study discusses whether there is a dispute, and whether Indonesian positive law has usually provided a way for both parties to resolve it. The process that parties can undertake can be either extrajudicial proceedings or court proceedings (litigation). Method: This research applies a literature review. We collected information on regulations, research, books, documents, records, websites, and various other literature related to BASYARNAS regarding dispute resolution in Islamic banking. The secondary data used in the analysis included data from Law No. 30/1999, Indonesian Banking Surveillance Report-Third Quarter 2023, and data from the National Sharia Arbitration Board of Indonesia. Results: The results show that the role of BASYARNAS is not yet ideal because it must be preceded by written consent from the parties, and the overlapping jurisdiction between religious courts and district courts hinders the enforcement of arbitration awards. Limitations: This research suggests the need for stricter regulations regarding the jurisdiction of Islamic bank financing disputes to avoid jurisdictional dualism. There is a need for a legal infrastructure that supports Sharia-based businesses by providing effective and culturally relevant out-of-court dispute resolution mechanisms with the principles and values of Sharia commerce. Contribution: Arbitration is considered by entrepreneurs as the best way to resolve disputes out of court, as it suits the needs of businesses.

Abstract

This paper explains how arbitration functions in the Indonesian legal system. The purpose of this study is to determine whether there is a legal remedy that can be made by law to reach a final decision based on the principle of final and binding. This study aims to study the way sharia arbitration bodies handle economic disputes. The research method used is juridical-normative, using descriptive qualitative analysis. The results showed that, as an extra-judicial institution governed by international law that has been ratified by the Indonesian government, arbitration helps complement the Indonesian judicial system. And the absence of a legal remedy for a final award in accordance with the principles of final and binding And the absence of legal remedies for a final decision in accordance with the principle of finality and binding is one of the advantages of settlement through arbitration compared to the court, In conclusion arbitration is more effective in resolving sharia insurance disputes based on the principle of simple, fast, and cheap justice according to the mandate of the Law.

Abstract

This study explores the role of social capital in enhancing disaster resilience, comparing urban and rural areas to identify key differences and similarities. Social capital, encompassing networks, norms, and trust that facilitate coordination and cooperation, is crucial for communities facing disasters. Using a comparative study approach, we conducted surveys and interviews in selected urban and rural areas to gather data on social capital dimensions and their impact on disaster resilience. Our findings reveal that while both urban and rural communities benefit from social capital, the mechanisms and outcomes differ significantly. In urban areas, formal networks and institutional support play a more significant role, whereas in rural areas, informal networks and community cohesion are more influential. These differences highlight the need for tailored disaster resilience strategies that leverage the unique strengths of each context. The study contributes to the literature by providing empirical evidence on how social capital functions in diverse settings and offers policy recommendations to enhance disaster resilience through community engagement and capacity building.

Abstract

The Sharia Supervisory Board (DPS) plays a crucial role in ensuring that Islamic banks operate in accordance with Sharia principles. The main functions of DPS include issuing fatwas, approving products, and supervising the implementation of Islamic banking products to ensure they are free from elements of riba, gharar, and maysir. DPS also ensures that every product launched by an Islamic bank complies with Islamic law and does not harm customers or other parties. Although the role of DPS is essential, challenges in Sharia supervision include limited resources, the influence of globalization, and the uneven understanding of Sharia principles among bank management. Best practices in Sharia supervision involve close collaboration between DPS, bank management, and the implementation of adequate information technology to enhance the effectiveness of supervision. Several successful Islamic banks, such as Islami Bank Bangladesh Limited and Bank Islam Brunei Darussalam, have demonstrated that the synergy between DPS and management, along with the adoption of technology, can improve the quality of supervision and the development of Sharia-compliant products. Therefore, it is recommended that DPS continue to enhance its capacity, strengthen collaboration with management, adopt information technology to support more effective supervision, and adapt to globalization and international regulations. Keywords : Sharia Supervisory Board, Islamic banking, Sharia compliance, supervision, information technology

Implementation of this ethics provides significant benefits, such as improving company reputation, financial performance, relationships with stakeholders, innovation and business sustainability. Examples of implementation in large companies show increased customer loyalty and investor confidence. Apart from that, the study also reviews the example of Rasulullah SAW in carrying out business ethics, which includes honesty, trust, fairness and avoidance of unethical practices such as gharar and ihtikar. Thus, sharia business ethics not only creates economic value but also supports social and environmental welfare. This research emphasizes the importance of implementing these principles in company operations to achieve long-term sustainability.
