Abstract

The government consisting of the Ministry of Home Affairs, the DPR RI, the KPU, and Bawaslu agreed to organize pilkada in pandemic times. The government also issued large amounts of funds from the state and regional cash, which lasted from the beginning to the end of the Pilkada implementation process to meet the technical needs of the industry. The following policy has many advantages and disadvantages. But the optimism of the government requires the support of the public and all the parties involved in order to succeed Pilkada. Pilkada in the midst of the election Covid-19 pandemic has had a positive impact and also a negative impact. The positive impact is the implementation of existing regulations, the exercise of constitutional rights of Pilkada participants and the public remains running, thus reducing the practice ofining the government of the region that is too led by temporary officials, hindering the preparation of budgets. Meanwhile, the negative impacts include an increased risk of becoming infected with Covid-19, the likelihood of increasing vulnerability to fraud, and the rejection of scam can increase the number of non-voters.

Abstract

This study examines the implementation of law enforcement against perpetrators of murder accompanied by child rape in the jurisdiction of the South Sumatra Regional Police, using a criminological approach. The main focus is on evaluating the effectiveness of law enforcement, identifying structural and cultural barriers, and applying criminological theories such as Strain, Differential Association, and Routine Activity. The methodology used is an empirical juridical approach with qualitative methods. The findings show that the law enforcement process has been in accordance with positive law provisions, but still faces challenges in the form of limited human resources, lack of coordination between institutions, and the influence of socio-cultural factors. Criminological analysis reveals that these crimes are triggered by social pressure, weak moral control, and open opportunities for crime due to minimal supervision. Therefore, integration between criminal law and social policies is needed in formulating law enforcement strategies for serious crimes involving children as victims

Abstract

Based on Article 201 paragraph (6) of Law Number 10 of 2016, Indonesia has an agenda to hold the General Election for Regional Heads (Pilkada) on September 23, 2020. This Covid-19 pandemic period has caused simultaneous Regional Head elections (Pilkada) in seven districts and cities in South Sumatra (Sumsel) were officially postponed, this delay was due to the corona virus outbreak or Covid-19. The purpose of this study is to explain, analyze and find laws in providing alternatives for filling regional head positions during the Covid-19 pandemic. The research method uses empirical juridical (field research), namely examining the applicable legal provisions and what is happening in reality in society. The results show several alternative patterns of filling regional head positions during the Covid-19 pandemic, including through the appointment of a temporary acting or task executor (Plt), indirect elections, and elections using the electronic election system. Each pattern has its advantages and disadvantages, with strong logical and juridical arguments that can be taken into consideration.
