Abstract

Law Number 3 of 1971 concerning the Eradication of Criminal Acts of Corruption is no longer in accordance with the development of legal needs in society, therefore it needs to be replaced with a new Law on the Eradication of Criminal Acts of Corruption so that it is expected to be more effective in preventing and eradicating criminal acts of corruption. On the basis of such considerations, it is necessary to establish a new Law on the Eradication of Corruption Crimes; The legal basis for this law is: Article 5 paragraph (1) and Article 20 paragraph (1) of the 1945 Constitution; and Decree of the People's Consultative Assembly of the Republic of Indonesia Number XI/MPR/1998 concerning State Organizers that are Clean and Free of Corruption, Collusion and Nepotism. This Law regulates: Corruption Crimes; Other Crimes Related to Corruption; Investigation, Prosecution, and Examination in Court Sessions; And Community Participation. This Law also mandates the establishment of a Corruption Eradication Commission which will be regulated in a separate Law within a period of no later than 2 (two) years from the promulgation of this Law. Abstract

The purpose of this research is to evaluate the effectiveness of mediation technical guidance in land dispute resolution in Sirah Pulau Padang Sub-district, Ogan Komering Ilir Regency, South Sumatra Province. The research method used was technical guidance and interactive discussions, as well as mediation simulations involving participants from various backgrounds, such as Village Heads, Heads of Neighborhood Associations, Community Leaders, Babinsa, and community members. Data were collected through interviews, questionnaires, and observations. The evaluation results showed that the mediation technical guidance program was effective in improving participants' understanding of land dispute resolution through mediation and sparked enthusiasm in disseminating information about land dispute resolution through mediation. In addition, the mediation simulation also helped participants in identifying problems in conflicts from various perspectives and increased participants' experience in finding alternative agreements between the parties. Therefore, mediation technical guidance can be effective in empowering communities to resolve land disputes and increase legal certainty in the land context.

Abstract

This study aims to understand the challenges faced in the implementation of direct regional elections by the General Election Commission amid the COVID-19 pandemic in Indonesia in 2020. The research method used is empirical juridical with a field research approach. Data were obtained through interviews with election coordinators and document analysis related to the implementation of elections. The results showed that the implementation of local elections in Indonesia in 2020 faced challenges due to disruptions caused by the COVID-19 pandemic, such as ensuring compliance with health protocols, poor internet quality, violations related to the procurement of Personal Protective Equipment (PPE), public concerns about the spread of COVID-19, disruption of the election process due to delays in resources and infrastructure, and candidate partners (paslon) who often ignore health protocols during their campaigns. Overcoming these challenges requires effective coordination and communication among election coordinators, strict implementation of health protocols, adjustments to schedules, stages, programs, and budgets, and increased community participation. The government also needs to pay attention to the availability of sufficient funds to ensure the smooth implementation of the election.

Abstract

The government consisting of the Ministry of Home Affairs, the DPR RI, the KPU, and Bawaslu agreed to organize pilkada in pandemic times. The government also issued large amounts of funds from the state and regional cash, which lasted from the beginning to the end of the Pilkada implementation process to meet the technical needs of the industry. The following policy has many advantages and disadvantages. But the optimism of the government requires the support of the public and all the parties involved in order to succeed Pilkada. Pilkada in the midst of the election Covid-19 pandemic has had a positive impact and also a negative impact. The positive impact is the implementation of existing regulations, the exercise of constitutional rights of Pilkada participants and the public remains running, thus reducing the practice ofining the government of the region that is too led by temporary officials, hindering the preparation of budgets. Meanwhile, the negative impacts include an increased risk of becoming infected with Covid-19, the likelihood of increasing vulnerability to fraud, and the rejection of scam can increase the number of non-voters.

Abstract

Pemanfaatan tanah sebagai benda berharga merupakan hak dari setiap masyarakat untuk memanfaatkan dan menikmati dari hasil pengelolaan tanh tersebut. Namun dalam kenyataanya, dengan semakin banyaknya jumlah penduduk di Indonesia, memberikan permasalahan tersendiri lantaran tidak sebandingnya rasio antara jumlah penduduk dan jumlah luas tanah. Selain itu faktor ketidakmampuan dalam melakukan pengelolaan tanah baik dari segi teknis, manajerial, dan finansial yang diawali dengan kegiatan jual beli yang berhubungan dengan objek tanah, menyebabkan banyaknya terjadi penelantaran tanah, sehingga berpotensi dapat mengakibatkan hapusnya hubungan hukum antara pemilik tanah dan tanah yang ditelantarkan. Penelantaran tanah yang kian banyak terjadi di wilayah Indonesia karena hal tersebut terjadi karena berbagai faktor yang melatarbelakangi baik dari segi administratif maupun dari segi finansial. Tentu perlu adanya campur tangan dari pemerintah untuk melakukan penertiban dan pendayagunaan tanah terlantar. Peraturan pemerintah Nomor 20 Tahun 2021 tentang Penertiban Kawasan dan Tanah Terlantar, sebagai landasan hukum yang digunakan dalam melakukan pencegahan terhadap lahan dan potensi kawasan terlantar. Berdasarkan hal-hal yang telah diuraikan tersebut di atas, penulis ingin meneliti mengenai bagaimana tahapan dari penertiban tanah terlantar serta mengkaji mengenai upaya pendayagunaan tanah terlantar tersebut, sehingga memberikan kepastian hukum dan memberikan dampak yang baik dalam hal ketertiban administrasi pertanahan. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan dan regulasi yang berkaitan dengan penertiban kawasan dan tanah yang terlantar, serta disertai dengan pendekatan kontekstual. Dengan tujuan memperoleh pemahaman akan peraturan yang berhubungan dengan penelitian ini. Teknik pengumpulan data yang digunakan adalah teknik studi kepustakaan, yaitu teknik pengumpulan data dengan melakukan studi pustaka terhadap bahan-bahan hukum, baik bahan hukum primer serta bahan hukum sekunder.Kata Kunci: Pendayagunaan Tanah; Penertiban Tanah; Peraturan Pemerintah; Tanah Terlantar

Abstract

The objective of this study is to examine the resolution process for corporate bonds that have been declared bankrupt by the commercial court. This research adopts a normative legal approach, which involves analyzing the law as a comprehensive system comprising legal principles, norms, and rules. The findings of this analysis reveal that the Law of the Republic of Indonesia Number 8 of 1995, which pertains to the capital market, encompasses provisions on bonds. Additionally, article 1 number 3 of the finance ministerial regulation Number 27 of 2020 specifically regulates government securities (SUN) that qualify as bonds. These bonds have a maturity period exceeding one year and are accompanied by coupon payments and limited interest installments (discounts). Bonds can be interpreted as a form of liability protection offered by bond issuers to investors, along with an agreement to repay the principal amount and premium coupons at a predetermined time. Notably, in the case of a company or issuer being declared bankrupt, it is crucial to examine the settlement system for these bonds.

Abstract

This study aims to analyze the legal regulations on cyber crime in the Indonesian legal system. The research method used is document analysis, by examining Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) and other related literature. The analysis results show that the legal regulations on cyber crime in Indonesia are governed by the ITE Law, which regulates various criminal actions related to the use of information and communication technology. In addition to the ITE Law, there are also other regulations that govern cyber crimes. However, there is a need for the enactment of the Cyberlaw Bill to provide a more specific and comprehensive legal basis for addressing cyber crimes. With specific laws regulating cyber crimes, law enforcement can be carried out more effectively and efficiently, providing legal certainty for cyber crime victims, and offering better legal protection for them. Therefore, this study concludes that legal regulations on cyber crimes need to be continuously developed and updated in accordance with the development of technology and the evolving trends of cyber crimes.

Abstract

The primary objective of this community service initiative is to augment public comprehension and awareness, particularly among business entities and stakeholders associated with State-Owned Enterprises (BUMN), regarding the regulations governing fair and robust business competition. The overarching goal is to stimulate greater adherence to these regulations and foster transparency in the operational practices of BUMNs. Through these endeavors, we aim to pinpoint and address challenges inherent in business competition practices, ultimately fostering an environment conducive to innovation and sustainable economic development. The methodology employed in this community service involves the orchestration of a comprehensive series of workshops. These workshops serve as a platform for disseminating knowledge on fair and healthy business competition regulations, elucidating best practices in the synergies of State-Owned Enterprises, and facilitating discussions on compliance and transparency. By creating an open forum for dialogue and learning, participants are equipped with the tools and insights needed to navigate the intricacies of business competition regulations effectively. The tangible outcomes of this community service initiative are multifaceted. Firstly, there is a discernible enhancement in public understanding and awareness of the regulatory framework governing fair and healthy business competition.

Abstract

This research examines the legal perspective of the inheritance rights of adopted children based on the Indonesian Civil Code. Inheritance is the transfer of property rights from a deceased person to living heirs, and in many cases, adopted children may be entitled to inherit from their adoptive parents. However, the status of adopted children in inheritance laws can be complex and raises various legal issues. The study explores the concept of adoption and its implications on the inheritance rights of adopted children. It analyzes relevant provisions of the Indonesian Civil Code and other related legal texts to understand the legal status of adopted children as heirs. The research also investigates the challenges and problems that may arise in determining the inheritance rights of adopted children, particularly when there are natural descendants or other adoptive children involved. By adopting a qualitative research approach, the study gathers data through legal document analysis and interviews with legal experts. The findings shed light on the legal intricacies surrounding the inheritance rights of adopted children and provide insights into the recognition and protection of their rights under the prevailing legal framework. The research contributes to the understanding of the legal complexities surrounding adoption and inheritance in Indonesia and highlights the importance of addressing these issues to ensure fair and just treatment of adopted children in matters of inheritance.

Abstract

This paper examines the role of the Judicial Honorary Council (MKH) in supervising judges' ethics in Indonesia, within the framework of the joint regulation between the Judicial Commission and the Supreme Court. The establishment of the Judicial Commission in 1999 marked a crucial step in addressing the need for independent external supervision of the judiciary, aimed at ensuring a transparent, fair, and professional judicial system. The paper highlights the significant role of the Judicial Commission in monitoring judges' behavior, proposing the appointment of judges, and enforcing the Code of Ethics and Judicial Conduct Guidelines. However, despite its mandate, the Judicial Commission’s recommendations often face non-compliance from the Supreme Court, particularly regarding technical judicial violations. The Judicial Honorary Council, as part of the Supreme Court's internal supervisory mechanism, plays a pivotal role in processing violations committed by judges. This research identifies the challenges faced by MKH in enforcing the code of ethics, such as indecisiveness, potential conflicts of interest, and inadequate follow-up on recommendations. These challenges undermine the effectiveness of the supervision system, highlighting the need for improved coordination and clearer delineation of authority between the Judicial Commission and the Supreme Court. The paper also emphasizes the importance of strengthening the collaboration between these two institutions to ensure a consistent and effective judicial supervision system. Through an in-depth legal analysis, the study concludes that enhancing transparency, accountability, and objectivity in the supervision process is essential for fostering public trust in the Indonesian judicial system.
