Abstract

The government enforces various kinds of regulations in providing protection to the public, one of which is through the Financial Services Authority (OJK) by issuing POJK Number 11 / POJK.03 / 2020 concerning National Economic Stimulus as a Countercyclical Policy on the Impact of the Spread of Coronavirus Disease 2019. This regulates the implementation of the relaxation policy. against debtors affected by the new Corona Virus or Covid-19 outbreak. The restructuring carried out by the financing institution is carried out in accordance with the guidelines issued by the OJK based on POJK Number 11 / POJK.03 / 2020. However, the implementation is left to the policies of each financing institution, the relief scheme may vary, among others, in the form of lowering interest rates, adjusting principal or interest installments, extension of time or other matters determined by the bank or financing institution. This regulation does not regulate sanctions against banks / financing companies that do not provide restructuring / relaxation programs for debtor customers, because they are not coercive, the language used in this POJK is "can" not "must".

Abstract

The AUKUS agreement, a trilateral pact between Australia, the United Kingdom, and the United States, has increased tensions between Indonesia and Australia. The deal focuses on enhancing defense capabilities, particularly by developing nuclear-powered submarines. This has broader geopolitical implications for the Asia-Pacific region and affects bilateral relations between Indonesia and Australia. The two countries have historically shared strong economic ties and cooperation in various sectors but have also faced disagreements, particularly regarding issues like West Papua and regional security alignments. Indonesia views Australia's participation in AUKUS as potentially increasing foreign military presence in the region, raising concerns about sovereignty and maritime security. The focus on nuclear submarines also raises legal and environmental considerations under international maritime law, particularly concerning exclusive economic zones (EEZs) and resource sovereignty. With the world's largest maritime territory, Indonesia emphasizes adherence to UNCLOS and calls for dialogue to manage these tensions peacefully. Some perceive the AUKUS alliance as a response to balance China's growing power, but this polarizes regional perspectives, with Southeast Asian nations expressing mixed reactions ranging from support to apprehension. The alliance's implications extend beyond military capability enhancement to include technological cooperation and regional stability efforts. In conclusion, AUKUS aims to bolster security and technological advancement in the Indo-Pacific. Still, its implementation requires careful navigation of legal, environmental, and geopolitical complexities to mitigate potential regional tensions and uphold international norms.

Abstract

This study aims to examine the application of the principle of freedom of contract within employment contracts. The employment contract serves as the foundational agreement between an employee and an employer. As a type of contract, the employment contract inherently adheres to the principle of freedom of contract. This research employs a normative juridical method, utilizing secondary data and descriptive qualitative analysis. The findings indicate that while the principle of freedom of contract applies to employment contracts, its scope is limited by specific material and formal requirements outlined in Law No. 13 of 2003 concerning Manpower. The principle functions effectively when both parties possess equal bargaining power; however, when there is a disparity, such as the unequal socio-economic status between the employer and the employee, the principle’s application may be hindered, potentially disadvantaging the employee.

Abstract

Sengketa dapat bermula dari berbagai sumber potensi sengketa, salah satunya adalah dapat berupa masalah bisnis internasional atau penanaman modal asing. Sengketa tersebut harus diselesaikan dengan hukum internasional. Peran yang dimainkan hukum internasional adalah memberikan cara bagaimana para pihak yang bersengketa untuk menyelesaikan sengketanya secara win win solution. Oleh karena itu tulisan ini bertujuan untuk menganalisis mengenai bagaimanakah perkembangan dan prospek penyelesaikan sengketa penanaman modal asing serta bagaimana Implementasinya di Indonesia. Penyajian hasil penelitian ini menggunakan penelitian kualitatif dengan pendekatan yuridis normatif. Hasil penelitian ini menujukkan bahwa Berdasarkan pembahasan dan uraian fakta yang telah dijabarkan sebelumnya, maka dapat disimpulkan bahwa Dalam menyelesaikan sengketa penanaman modal para pelaku usaha lebih menyukai penyelesaian di luar lembaga peradilan (non litigasi) yaitu penyelesaian dengan menggunakan jasa Arbitrase Komersial Internasional karena jalur/metode penyelesian tersebut lebih menguntungkan para pihak. Badan Arbitrase Komersial Internasional yang terkenal adalah ICSID, suatu badan arbitrase yang menangani sengketa-sengketa penanaman modal asing antara negara dengan investor asing. Indonesia adalah salah satu negara anggota ICSID yang diratifikasi dengan Undang-Undang No. 5 tahun 1968 tentang Persetujuan Atas Konvensi tentang Penyelesaian Perselisihan Antara Negara Dengan Warga Negara Asing Mengenai Penanaman Modal. Setiap sengketa antara Indonesia dan perusahaan Asing, dapat diselesaikan dengan menggunakan ICSID.

Abstract

This study aims to examine the role of Article 1367 of the Civil Code in determining the duties of Futures Brokers and Futures Broker Representatives in the context of Indonesian commodity futures trading, with a focus on the consequences for violations of these duties by Futures Broker Representatives. respond to it. This methodology is based on normative legal principles and is based on research into relevant literature and examination of BAKTI rulings in the field of commodity futures trading arbitration. Findings from this study highlight the importance of taking into account the Futures Broker Representative's level of professionalism as well as any applicable rules and regulations when determining the extent to which the Futures Broker is legally liable for the Futures Broker Representative's conduct. In order to provide fairness and clarity in commodity futures trading, this study's findings suggest that current rules need to be revised and adjusted. The study also suggests directions for future research on the dynamics of futures trading's legal aspects.

Abstract

Examining the duty to repay online loans within the framework of debt legality in the digital age, and how successful monitoring and enforcement of laws have been in enforcing online loan rules in Indonesia are the overarching goals of this study. Findings are based on logical viewpoints, critical analysis, and philosophy; the study takes a normative legal stance with analytical descriptive methodologies; it examines pertinent laws and regulations as well as applicable law enforcement activities. In particular, when it comes to dealing with unregistered fintech, the findings reveal a disconnect between current legislation and the efficacy of its oversight. Issues with implementation and enforcement of legislation continue to affect consumer protection and transaction fairness, despite efforts to promote transparency and consumer protection via regulations like Financial Services Authority Regulation Number 77/POJK.01/2016. For better management, this study suggests tightening the regulatory framework and boosting inter-institutional cooperation.

Abstract

Legal protection of Indonesian Migrant Workers continues to be pursued, especially because of the many rights violations and inhumane treatment experienced by some Indonesian Migrant Workers. So that this phenomenon requires serious attention, both at the national and international levels. The purpose of this study is to examine and find out how the legal protection of the rights of Indonesian workers in national and international law and whether the role of the Indonesian government has been implemented in protecting the rights of Indonesian workers abroad. The research method used is normative juridical, with an approach that focuses on law as a system of norms.  This system of norms includes the principles, rules, and guidelines of the applicable law, including agreements and theories put forward by experts. This research highlights the government's efforts to build and implement a legal framework to support the rights of Indonesian Migrant Workers. However, there are still challenges that need to be addressed, such as improved monitoring and enforcement to ensure the policy is implemented effectively. This research provides greater insight into the dynamics of the Indonesian government's role in protecting workers' rights, with the aim of making this protection more effective and comprehensive.
