Abstract

Marine Police Regional Police Banten Province is breakthrough in the development of creative, aware of the importance of knowledge of the social and cultural life of the operational environment. However, the problem is: First, how the pattern of development of the concept of Creative Breakthroughs Marine Police Banten ?; Second, how the implementation of the concept of creative breakthrough Marine Police Banten?. The results showed that the First, Pattern Creative Breakthrough Development undertaken in the framework of Banten Water Police Pushing Water existence in Banten Police are doing synchronization and coordination with the Department of Maritime Province of Banten in terms of the measurement vessel, Formulation of Local Regulations related to service to the fishermen and the plan of Units waters; Secondly, optimization of local government support, Academics to Overcome situation, needs and implementing creative breakthroughs Marine Police Banten in order to protect, Protects, Serving Society, and Law Enforcement The Regional Water can be embodied through preemptive action, preventive and educative as well as ongoing collaboration with the form as a container maritime forum gathering agencies in charge of maritime waters and ports in Province of Banten.Keywords: Creative Breakthroughs, Marine Police, Security, Law Enforcement, Sunda Strait

Abstract

Terdapat perbedaan dan kesamaan antara konsep HAM Internasional dengan Islam, terutama berkaitan dengan sumber, sifat, dan orientasi. HAM Internasional bersumber pada akal, bersifat antroposentris, dan berorientasi duniawi. Semantara HAM dalam pandangan Islam bersumber dari Wahyu (Allah SWT), bersifat teo-antroposentris, dan berorientasi dunia-akhirat. Karenanya, yang pertama perwujudannya bertumpu semata-mata pada Negara (faktor pendorong eksternal), sedangkan yang kedua perwujudannya tidak hanya bersifat eksternal dan formal legalistik, melainkan bersumbu pada aspek internal manusia (batin/iman). Dalam praktiknya di lapangan bentuk hukuman cambuk dipandang efektif dalam melindungi HAM baik secara sosiologis, ekonomis, psikologis, bahkan teologis. Meskipun masih mengandung beberapa kelemahan yang potensial melanggar HAM, khususnya berkaitan dengan tindak pidana khalwat dan aspek hokum acaranya. Sementara bentuk hukuman rajam dipandang masih merupakan wilayah ijtihadiyyah yang sarat dengan perdebatan di kalangan para ulama sendiri.

Abstract

Tulisan ini mengkaji tentang kepemimpinan wanita dalam perspektif Hadis. Hadis tentang larangan wanita menjadi pemimpin dapat ditemui dalam beberapa kitab sumber, yaitu: Bukhari, Kitab Maghazi Bab 82, Fitan Bab 18, Tirmidzi, Kitab Fitan Bab 75, Nasa’i, Kitab Qadat Bab 8 dan Ahmad bin Hanbal, Juz 5 halaman 43, 51, 38, 47. Hadis tersebut adalah hadis yang diriwayatkan secara maknawi, oleh karena terdapat beberapa ragam matan hadis. Dari sisi Kritik Sanad hadis tersebut, maka hadis tersebut adalah hadis Shahih, disebabkan karena ketersambungan sanad, kritikal hadis menunjukkan lebih dominan ta’dil daripada jarah, dan tidak bertentangan dengan hadis dan ayat yang lain. Terdapat perbedaan pendapat pada pemahaman hadis tersebut, secara tekstual hadis tersebut disyarah dengan melihat pelarangan wanita menjadi pemimpin karena wanita memiliki keterbatasan, qadrat dan kemampuan yang diluar dari wewenangnya. Akan tetapi wanita boleh menjabat sebuah jabatan diluar ranah pemerintahan, seperti: perusahaan, lembaga pendidikan, instansi non pemerintahan. Sementara syarah secara kontestual menunjukkan bahwa berdasarkan konteks turunnya hadis tersebut, tidak bisa digunakan secara umum dalam menentukan hukum syar’i pelarangan wanita menjadi pemimpin.

Abstract

Studi ini bertujuan untuk menganalisis kontribusi Islam terhadap perkembangan hukum humaniter internasional sebagai disiplin ilmu yang mengatur tentang perlindungan terhadap korban perang dan pembatasan terhadap sarana dan metode perang. Analisis terhadap kontribusi Islam ini dilakukan untuk mengetahui dan menemukan pengaturan perang apa saja dalam hukum perang Islam yang sudah dan belum di adopsi oleh hukum hukum humaniter internasional.Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perbandingan hukum. penelitian ini bersifat deskriptif analitis, yaitu menganalisis permasalahan dengan menggunakan data sekunder, kemudian dianalisis secara yuridis kualitatif.Hasil penelitian menunjukkan bahwa: pertama, kontribusi hukum Islam terhadap pengaturan konflik bersenjata dalam hukum humaniter internasional dapat memanusiawikan perang. Namun demikian masih terdapat beberapa aturan perang Islam yang belum diadosi oleh hukum humaniter internasional diantaranya tentang larangan perang, dan kualifikasi yang menjadi syarat-syarat perang. sehingga setiap permasalahan di masyarakat internasional berpotensi menjadi konflik bersenjata dan setiap konflik bersenjata menimbulkan korban penduduk sipil dan kerusakan obyek sipil. Kedua, Perspektif Islam terhadap hukum humaniter internasional pada dasarnya tidak ada perbedaan pengaturan. Ajaran Islam sejalan dengan hukum humaniter internasional. Perbedaannya hanya terletak pada tanggungjawab penerapannya, dimana dalam hukum positif, tanggungjawab itu hanya bersifat duniawi saja, sementara dalam hukum Islam tanggungjawab itu bersifat duniawi dan ukhrawi sekaligus

Abstract

This study aims to understand the contestation of Islamic legal thought between the scientific tradition of Dayah (Islamic boarding school) and the State Islamic Higher Education Institutions (PTKIN) in responding to global issues. The main data sources in this research are words and actions, the rest are additional data such as documents. Methods of data collection included interviews, observation, and documentation. All data obtained were analyzed by data reduction, analysis, and interpretation. Based on the objectives and research methods above, it was found that there were three factors causing the emergence of contestation between the two Islamic educational institutions, namely, (1) the different methodologies and approaches to Islamic law used; (2) the difference in the spirit of fiction between Dayah and PTKIN. Dayah has the spirit of preserving fiqh, while PTKIN’s spirit is fiqh renewal; (3) Political background. The contestation between Dayah and PTKIN occurred in two areas, namely the area of worship and non-worship. Based on the references, methods of reasoning, approach, and spirit possessed by these two Islamic educational institutions, it can be understood that the two models of Islamic legal thought have the potential to be integrated. Such integration may include; integration of foundations, sources, methods, approaches, and reasoning models.

Abstract

The main purpose of implementing Shari’a is to benefit humanity in all areas of life in this worldly life and the hereafter. Based on this circumstance, this article critically sheds light on the existing implementation of Acehnese Shari’a by examining its scope and the existing qanun issued to seek that purpose. This article is grounded in a qualitative research query with a reflective approach. This study finds that the existing scope of the Acehnese Shari’a has not responded to the ideal of Shari`a, which is based on maqashid presumptions; dharuriyat, hajiah and tahsinat. The results of this study indicate that the application of Shari’a in Aceh is far from the goal of ideal Shari’a for its application does not cover every aspect of life, but is limited to only covers legal aspects (punishment). This study also shows that Acehnese Shari’a has not ruled over political affairs, governing system, health issues, economic matters, and defense issues. Therefore, the scope of Acehnese Shari`a implementation should be reconstructed in order to respond to the ideal  Shari’a, which is universal and inclusive.[Tujuan utama penerapan syariat Islam adalah untuk mencapai kemaslahatan umat manusia dalam segala bidang kehidupan di dunia dan di akhirat. Berdasarkan hal tersebut, artikel ini mencari peta implementasi penerapan syariat Islam di Aceh antara idealisme dengan realitas kekinian. Metode penelitian dalam artikel ini adalah penelitian kualitatif dengan pendekatan reflektif. Kajian ini mencerminkan cita-cita penerapan syariat Islam di Aceh dengan realitas yang terjadi, kemudian menyajikan roadmap agar syariat Islam dapat diterapkan di Aceh sesuai dengan ide dasarnya. Hasil penelitian ini menunjukan bahwa penerapan syariat Islam di Aceh jauh dari tujuan syariat Islam karena syariat Islam tidak muncul kecuali di bidang hukum (hukuman), dan juga kajian ini menunjukan bahwa  syariat  Islam di Aceh belum menyentuh permasalah politik, pemerintahan, kesehatan, ekonomi, pertahanan, pendidikan, sosial budaya, dan lingkungan, Oleh karena itu, peta implementasi harus direkonstruksi untuk menerapkan syariat Islam yang sesuai dengan cita-cita penerapan syariat Islam di Aceh]

Abstract

This article examines the legal verses of polygamy from a hermeneutical perspective. The third verse of surah al-Nisa is often understood as a verse commanding polygamy, because it contains recommendations to marry more than one woman, namely: two, three and four. The data used in this article are divided into two categories. The collected data were then analysed using the hermeneutic theory of Emelio Betti, Martin Heidegger, Hans Georg Gadamer and Paul Ricoeur with a descriptive method. The results of the research based on the hermeneutic theories above show that the third verse of surah al-Nisa which is usually used as the argument for polygamy from the Koran actually reinforces the recommendation of monogamy because according to Betti the purpose of marriage is sakinah mawaddah wa rahmah, this goal is difficult to realize in polygamy. Then according to Heidegger the verse above talks about justice for orphans. Furthermore Gadamer that polygamy is carried out with 2 conditions; (1) the 2nd, 3rd and 4th wives are widows who have orphans; (2) there must be a feeling of worry that they cannot do good and justice to orphans except by marrying their mothers. Finally, Ricoeur is of the view that the verse above is an order to act fairly in protecting the assets of orphans. The conclusion is that the third verse of surah al-Nisa is a recommendation for monogamy, not an order for polygamy.

Abstract

Qanun Jinayat is one of the legal umbrellas for implementing Islamic law in the Criminal sector in Aceh. The application of this Qanun has pros and cons because it is seen as contrary to the spirit of tolerance which is one of the pillars of Religious Moderation. This study examines the suitability of the Jinayat Qanun with Religious Moderation. The data used in this article consists of primary data and secondary data. Primary data comes from Qanun Aceh No. 6 of 2014 concerning Jinayat Law. Meanwhile, secondary data was obtained from literature related to the implementation of Islamic law in Aceh and articles related to religious moderation. The study results show that Qanun Jinayat is following Religious Moderation for the first two reasons that this Qanun in its formulation chooses the Minhaji approach, not the Mazhabi approach. Second, non-Muslims are given a choice in their implementation to choose to submit to the punishment in the Qanun Jinayat or the penalties contained in the Indonesian Criminal Code if they violate the Qanun Jinayat in the Aceh region.

Abstract

The study aims to examine the integration of religious values, Aceh culture, and global issues, which form the Sexual Violence Crime Law (UU-TPKS). This article is a qualitative study with a descriptive approach where the primary data were obtained through interview and group discussion. The study used relevant sources from books, journals, and articles related to the chosen theme as the secondary data. This study shows that integration of religious values into the Sexual Violence Crime Law (UU-TPKS) is necessary because Indonesian law must be based on the Pancasila philosophy as a result of the translation into Islamic values. It further shows that religious, cultural, and global values embodied in that law are the values of tauhid, justice, freedom, kindness, cooperation, equality, and tolerance. The state must measurably implement all values and derive them into laws and regulations. The study also reveals that such an integration reflects the integration of religious principle and values and local wisdom described in various meanings and symbols.
