Abstract

Each worker/workers face the risks of social-economic and social security can cope with the risks of the socio-economic. Setting social security law for labors has been started since the days of the Dutch East Indies colonial rule until the time of independence of the Republic of Indonesia both early era of independence as well as in the reform era. Therefore, this paper intends to study the development of legal regulation of social security. Social security arrangements colonial era the Netherlands East Indies, set in the Civil Code and Regulations Accident or Ongevallen-Regelling 1939, but the laborers / workers unprotected. New on the independence of the Republic of Indonesia, especially after the enactment of legislation in the field of social security such as: Law Number 3 of 1992 on Social Security of Labor, Law 20 of 2004 on National Social Security System and the Law 24 of 2011 on Social Security Organizing Body, laborers / workers obtain legal protection in the field of social security, which programnyapun not only guarantees compensation for workplace accidents alone, but includes work accident insurance program, program life insurance, security program today old, pension insurance programs, and health care insurance program. Keywords: Social Security Labor Protection Law, the Labour / Workers, Development, Settings.

Abstract

The protection of Labour/worker can be enforced by various laws,including Law No. 13 of 2003 on Manpower. This law gives greatattention to the protection of labour/worker, in the terms of substance andscope of regulation, which includes all matters relating to labour at thepre-employment, during and post employment. Therefore, this paper isaimed to discuss the protection of labour/worker according to Law No. 13of 2003 on Manpower in the terms its scope of regulation. The regulatedpre-employment, such as: Manpower Planning and EmploymentInformation, Job Training, Labour Placement and Expansion ofEmployment Opportunities. The regulated during employment, such as:Employment Relationships (work agreements), Protection, Wages andWelfare and Industrial Relations. The regulated post employment, suchas: Termination of Employment and the rights them. Although the scope ofthe regulation is so, it is still not perfect, considering that the law is notperfect. Likewise, if examined in theory the scope of the validity of the law(scope according to time): pre-employment, during and post employmenthas met these criteria, but if examined from the side of purpose theory,character and the nature labor law has not fully fulfilled.

Abstract

The provision of agricultural land for food is currently facing pressure due to competition from other sectors as a result of economic growth and population growth. This condition causes food agriculture land to be faced with the problem of decreasing land area due to conversion to non-agricultural uses. The converted land area is mostly intended for residential housing developments in addition to the construction of public infrastructure, offices, shops and industries. This conversion of agricultural land can have a negative impact on agricultural development. Each district or city actually has to reserve and protect agricultural land that has the potential to be developed into sustainable food-producing agricultural land. However, in its implementation, the determination of the area for sustainable food-producing agricultural land has not been carried out by many districts or cities for various reasons. Likewise in Banten, the availability of agricultural land in Banten Province is getting depleted due to being eroded by development, new efforts and breakthroughs are needed in maintaining the availability of agricultural products while maintaining food security for the Banten people, one of which is by utilizing idle land owned by developers in urban areas so that they can be worked on by the community. farmer. Currently, the management of idle land owned by developers in urban areas is still not optimal. As a result, a lot of unused land is left empty before being built into housing. There needs to be support from all parties so that the management of unused land can be optimized in maintaining food security in Banten Province can always be maintained, in addition to avoiding consumptive people's habits, relying on all their daily needs from buying, while a lot of land can still be cultivated and cooperated. This study explains about Land Management and Land Use for Food in the area around the Untirta Sindang Sari campus and around the Sindang Sari village area which is still not optimal. This research is also to find out, examine and develop alternative policies related to efforts to optimize the potential of agricultural land used for food utilization. The long-term goal of this research is that this research aims to optimize land use and management to support food security in Banten and national food security. Food products in Banten can not only meet the needs of their own region, but can also meet the needs of National Food and even for export commodities to foreign countries. The specific target to be achieved from this research is to strive to achieve one of Untita's Visions and Missions, namely Realizing the Integrated, Smart, and Green Campus Vision. The Ministry of Education, Culture, Research and Technology (Kemendikbudristek) has made Sultan Ageng Tirtayasa University a Center for the Study of Food Security and Local Food Innovation in Banten so that with the new Untirta Building from the Islamic Development Bank (IsDB), Untirta can become a center of excellence. in Food Security. Untirta does not only focus on the development of food products, but is also accompanied by the development of technology. This research uses Sociological Normative and Juridical Normative legal research methods. This research is descriptive analytical and uses primary data sources and secondary data sources. Descriptive in this study is a description of the situation, conditions, circumstances, and realities that exist in the area around the Untirta Sindang Sari campus and around the Sindang Sari village area in terms of land use and land management to support food security. Then analyze what the problem is in order to find a solution to the problem. Sources of data used in this study were obtained from Library Research (Library Research). The normative juridical in this research is in the form of a discussion of several laws and regulations made by the government that are enforced to regulate the formation of regional areas and land use. Sociological Normative Research on law constructs law as a system of laws and regulations that have existed so far and then constructed in a society's behavior.

Abstract

The issue in this study is that regulations on halal certification have a very large role in supporting the national food security program. Halal certification on products is very important for consumers because in some cases people are reluctant to buy food products that do not have a halal label on their packaging. The government ratified Law Number 33 of 2014 concerning Halal Product Guarantee (UU JPH) which after being investigated it turned out that the JPH Law did not strengthen the existence of LPPOM MUI, but gave authority to the Government or the Ministry of Religion to form a new institution other than LPPOM MUI, namely the Product Assurance Organizing Body. Halal (BPJPH). The research objective to be achieved from this research is to ensure that BPJPH can cooperate with MUI in terms of halal auditor certification and the determination of halal products in order to support national food security. This study uses a normative juridical legal research method, this research is descriptive analytical and uses primary data sources and secondary data sources. The key finding of this research is that the authority of the MUI remains important because MUI is the institution authorized to issue a fatwa on the determination of the halalness of a product which is then submitted to BPJPH as the basis for issuing a halal certificate. The importance of this research to be discussed because with the union of the two institutions, hopefully in the future Indonesia will become the center of world halal products with various products made in Indonesia so that national food security will be maintained.

Abstract

Mengonsumsi pangan harus memperhatikan aspek kesehatan, kandungan gizi dan aspekkehalalan pangan (konsumen muslim), sebab pelaku usaha kadang kurang memperhatikanhalal haram dalam proses produksi panganya, terpenting kelancaran bisnisnya. Merekamencari keuntungan setinggi-tingginya sesuai dengan prinsip ekonomi, bersaing denganperilaku bisnisnya sendiri-sendiri yang dapat merugikan konsumen. Oleh karena itu, hukumperlindungan konsumen sebagai keseluruhan peraturan hukum mengatur hak-hak dankewajiban konsumen dan pelaku usaha secara timbal balik, dan khusus mengatur jaminanproduk halal UU No.33 Th 2014 tentang Jaminan Produk Halal jo. Perpu No.2 Th 2022 tentangCipta Kerja, yang meliputi: cakupan produk halal : meliputi barang dan/atau jasa yang terkaitdengan makanan, minuman, obat, kosmetik, produk kimiawi, produk biologi, dan produkrekayasa genetik serta barang gunaan yang dipakai, digunakan, atau dimanfaatkan olehmasyarakat, bahan produk beserta proses produksinya; tata cara memperoleh sertifikat halalmulai dari permohonan sampai terbit sertifikat halal, maka perlu sosialisasi melaluipenyuluhan hukum kepada warga masyarakat desa dan aparatur desa agar mereka mengenal,memahami dan melaksanakan ketentuan peraturan perundangan jaminan produk pangan halaldalam rangka perlindungan hukum konsumen dan pelaku usaha.Tidak kecuali wargamasyarakat Desa Sukaraja, Kecamatan Warunggunung, Kabupaten Lebak, karena setiapwarga adalah konsumen. Dan juga dalam rangka motivasi pelaku usaha UMKM di desa agarmelaksanakan ketentuan jaminan produk pangan halal. Abstract

Ungkapan dimana ada masyarakat ada hukum(Ubi societas ibi Ius)dan konsekuensi negara kita negara hukummaka segala aktivitas masyarakat harus berdasarkan hukum. Diantaranya aktivitas hubungan industrial, yaituUUKNo.13TH2003danUUCKNo.11TH2020,yangmerupakanundang-undangpokokdibidangketenagakerjaan yang beberapa pasalnya dicabut, ditambah atau direvisi oleh UUCK. Sehingga dari 193 pasalUUK, yang dihapus dan diubah oleh UUCK berjumlah 61 pasal, dan beberapa perbedaan pokoknya adalah: (i)Perizinan dan Penggunaan TKA;(ii)PKWT; (iii)Kompensasi bagi Pekerja PKWT;(iv)Pembayaran Ganti RugiPHK PKWT;(v)Waktu kerja lembur;(vi)Pesangon PHK; (vii)Upah Minimum dan dasar penetapannya;(viii)Upah per Jam;(ix)Outsourcing; dan (x) Jaminan Kehilangan Pekerjaan.Mengingat perubahan besar danmendasar tersebut berdampak terhadap muatan materi/substansi dan ruang lingkupnya, maka perlu sosalisasikepadawargamasyarakattenagakerjayangmencakuppencari/calon pekerja,pekerja/buruhdan calonpengusaha/pengusaha, agar mereka mengenal, memahami dan melaksanakan hukum kerja dalam hubunganindustrialnya, baik sebelum bekerja, selama bekerja, dan sesudah masa kerja.Tidak kecuali warga masyarakatKelurahan Kelapa Dua, karena dari segi komposisi mata pencaharian penduduk banyak terlibat dalam hubunganindustrial. Abstract

Manusia sebagai subyek hukum (naturlijke persoon) lazimnya memiliki nama yangdisandangnya. Nama disamping sebagai hak, juga menandakan eksistensinya dalam pergaulanhidup sosial dan masyarakat. Hak atas pembentukan atau pemberian nama manusia telah dijamindan diatur oleh peraturan perundangan seperti : UU HAM, UU Perlindungan Anak, UUPerkawinan, dan UU Administrasi Kependudukan. Kini aturan lebih ketat tentang pemberiannama telah berlaku, yaitu melalui Permendagri Nomor 73 Tahun 2022 tentang Pencatatan NamaPada Dokumen Kependudukan. Adanya aturan ini akan mengatur dan membatasi kemajemukanatau keanekaragaman dan kebiasaan masyarakat Indonesia dalam pemberian nama ketikadicatatkan dalam dokumen kependudukan dari dinas kependudukan dan catatan sipil, maka perlusosalisasi melalui penyuluhan hukum kepada warga masyarakat desa dan aparatur desa agarmereka mengenal, memahami dan melaksanakan ketentuan peraturan perundangan administrasikependudukan dan cacatan sipil dalam pembentukan dan pencatatan nama. Tidak kecuali wargamasyarakat Desa Tejamari, Kecamatan Baros, Kabupaten Serang, karena setiap wargamemiliki/menyandang nama. Juga dalam rangka persiapan dini pembentukan nama bagi generasimereka yang akan lahir agar sesuai dengan aturan tata nama administrasi kependudukan yangberlaku. Abstract

Konflik/perselisihan suatu yang lumrah terjadi dalam aktivitas mahluk sosial(zoon politicon),termasuk dalam aktivitas hubungan industrial, yang perlu dicarikan penyelesaiannya sesuai dengannorma hukum yang berlaku, yaitu UU No.13 Tahun 2003 tentang Ketenagakerjaan, UU No.11Tahun 2020 tentang Cipta Kerja dan UU No. 2 Tahun 2004 tentang Penyelesaian PerselisihanHubungan Industrial. Hal ini karena negara kita adalah negara hukum, maka segala aktivitas baikbekerja maupun berusaha (berbisnis) termasuk jika timbul perselisihan/konflik dalam hubungankerja maka penyelesaian masalahnya harus berdasarkan hukum, serta belum semua tenaga kerjadan pengusaha memahami dan melaksanakan ketentuan hukum kerja tersebut. Dalam penyelesaianperselisihandapatdilakukanmelaluipenyelesaiandiluarpengadilan(nonlitigasi)danpenyelesaian melalui pengadilan hubungan industrial (PHI). Mengingat Konflik/perselisihan perludiminimalisir atau dicarikan penyelesaiannya agar konflik tidak menimbulkan ekses-ekses negatif,maka perlu sosalisasi melalui penyuluhan hukum kepada warga masyarakat tenaga kerja yangmencakup pencari/calon pekerja, pekerja/buruh dan calon pengusaha/pengusaha, agar merekamengenal, memahami dan melaksanakan hukum kerja dalam hubungan industrialnya, terutamadalam hal terjadi masalah perselisihan hubungan industrial.Tidak kecuali warga masyarakat DesaCarenang Kecamatan Carenang, karena dari segi komposisi mata pencaharian penduduk banyakterlibat dalam hubungan industrial dan dekat dengan lokasi industri Serang Timur. Melalui metodeceramah, diskusi dan simulasi penyuluhan hukum, dan merupakan salah satu realisasi tri dharmaperguruan tinggi.

Abstract

This research discusses the legal responsibility of boarding house owners for the loss of tenants' goods based on Law Number 8 of 1999 concerning Consumer Protection. Boarding house rental agreements are often made verbally without clarity on the boarding house owner's responsibility for the loss of the tenant's belongings. Based on an analysis of Articles 1709 and 1710 of the Civil Code and Article 19 of the Consumer Protection Law, boarding house owners are obliged to provide protection for tenants' belongings. The research uses empirical juridical methods by collecting primary and secondary data through field and literature studies. The research results show that loss of goods at boarding houses often occurs due to boarding house owners' negligence in providing adequate security facilities. Legal efforts and consumer protection are the keys to overcoming this problem.

Abstract

This study aims to examine the application of the principle of freedom of contract within employment contracts. The employment contract serves as the foundational agreement between an employee and an employer. As a type of contract, the employment contract inherently adheres to the principle of freedom of contract. This research employs a normative juridical method, utilizing secondary data and descriptive qualitative analysis. The findings indicate that while the principle of freedom of contract applies to employment contracts, its scope is limited by specific material and formal requirements outlined in Law No. 13 of 2003 concerning Manpower. The principle functions effectively when both parties possess equal bargaining power; however, when there is a disparity, such as the unequal socio-economic status between the employer and the employee, the principle’s application may be hindered, potentially disadvantaging the employee.
