Abstract

Rekam medis elektronik merupakan bukti bahwa kemajuan teknologi telah menimbulkan perpaduan yang telah mengaburkan batas antara media fisik dan digital. Keberlakuan rekam medis elektronik belum memiliki payung hukum yang mengatur terkait pertanggungjawaban atas kebocoran data rekam medis elektronik milik pasien. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis sejauh mana tanggung jawab rumah sakit dapat melindungi hak pasien yang dirugikan atas kebocoran data rekam medis elektronik dan akibat hukum yang terjadi. Penelitian ini menggunakan metode penelitian yuridis normatif dan menggunakan metode pendekatan perundang – undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian ini menunjukan bahwa perlu adanya regulasi terkait pertanggungjawaban rumah sakit mengenai keberlakuan rekam medis elektronik. Mengingat berdasarkan Pasal 46 Undang–Undang Nomor 44 Tahun 2009 tentang Rumah Sakit, menyatakan bahwa tanggung jawab terkait kelalaian seorang dokter secara hukum di tanggung oleh rumah sakit. Pertanggungjawaban rumah sakit tentang keberlakuan rekam medis elektronik juga didukung oleh doktrin vicarious liability, bahwa rumah sakit sebagai badan hukum atau korporasi perlu mempertanggungjawabkan tindakan yang dilakukan oleh dokter dan tenaga kesehatan. Tindakan pengelolaan rekam medis elektronik menimbulkan akibat hukum berupa ganti rugi atas kerugian yang dialami oleh pasien. Tidak bisa dipungkiri bahwa permasalahan pertanggungjawaban rekam medis elektronik adalah permasalahan yang perlu segera diselesaikan, mengingat bahwa implementasi rekam medis elektronik telah berlaku di beberapa rumah sakit di Indonesia.

Against the backdrop of India's abundant resources, diverse biodiversity, and rich cultural heritage, the study underscores the strategic broadening of India's participation across various dimensions—ranging from socio-economic initiatives to political collaborations and security endeavors—within this expansive and diverse region. The proclamation of the Act East Policy by Prime Minister Narendra Modi serves as a crucial element in this holistic approach. It embodies a strategic framework crafted to fortify India's relationships with countries in both East Asia and Southeast Asia. This policy reflects a deliberate and far-reaching strategy to enhance diplomatic, economic, and security ties, leveraging India's strengths against the intricate tapestry of opportunities and challenges present in the region. By delving into the various facets of India's diplomatic outreach, this study seeks to unravel the layers of complexity surrounding India's engagements in Southeast Asia, East Asia, and Indonesia. Its objective is to offer a nuanced understanding of the motivations, challenges, and outcomes associated with India's multifaceted foreign policy in this strategically significant and culturally diverse region.

Abstract

This study explores the changing dynamics of defense and diplomacy in the Philippines amidst the escalating rivalry between the United States (US) and China. Due to its strategic geographical location, the Philippines faces susceptibility to the consequences of this rivalry. The primary focus is on the Philippines' comprehensive defense diplomacy strategy, which has been in practice since the Ramos administration. Rooted in the United Nations Convention on the Law of the Sea (UNCLOS), the Philippines pursues a law-centric diplomacy, notably through the 2009 Philippine Baselines Law. The strategic framework draws inspiration from Harry R. Yarger's "Little Book on Big Strategy," emphasizing the importance of aligning national strengths with the prevailing strategic environment. Actively engaging in capacity-building initiatives within Southeast Asia, the Philippines participates in various forums such as ASEAN, ADMM, and ADMM-Plus. These initiatives encompass the modernization of defense forces, increased maritime awareness, and fortified coastal defense. The discussion also encompasses the country's defense industry, the crucial role of the Armed Forces, and its readiness for international collaboration. In essence, the Philippines adopts a proactive approach by integrating diplomatic strategies, capacity-building endeavors, and a commitment to international law to ensure stability and security amidst evolving regional challenges.

Abstract

The research aims to analyze and propose recommendations concerning regulations prohibiting acts of infidelity committed by workers/laborers from the perspective of labor law. Unlike labor laws and regulations, which do not specifically address the prohibition of acts of infidelity, autonomous rules can address such provisions. This study employs a normative legal research methodology, utilizing both statutory and conceptual approaches. Primary and secondary legal materials serve as the basis for analysis. Findings indicate that provisions prohibiting acts of infidelity for workers/laborers can be integrated into autonomous principles without contravening existing laws and regulations. Furthermore, acts of infidelity may also fall under the purview of urgent offenses or criminal acts. The inclusion of such prohibitions in autonomous rules is not indicative of bad faith on the part of employers seeking to expedite termination of employment relations. Rather, it serves as a preventive measure against violations of laws, regulations, and ethical standards by workers/laborers. Regarding dispute resolution, termination of employment cannot be immediate in cases related to allegations of infidelity. Instead, due process must be followed to ascertain the veracity of such accusations and determine the culpability of the worker/laborer involved.
