Abstract

Berbagai kasus tindak pidana pencemaran nama baik melalui media elektronik memunculkan kontroversi. Penerapan pasal delik pencemaran nama baik dianggap bertentangan dengan UUD NRI Tahun 1945, yaitu hak asasi manusia dalam menyampaikan pendapat dan berekspresi. Fokus permasalahan dalam penelitian adalah bagaimana tindak pidana pencemaran nama baik pasca Putusan Mahkamah Konstitusi. Jenis penelitian ini adalah penelitian hukum normatif. Hasil penelitian menunjukan pasca Putusan Mahkamah Konstitusi Nomor 50/PUU-VI/2008, Putusan Mahkamah Konstitusi Nomor 2/PUU-VII/2009, Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010, Putusan Mahkamah Konstitusi Nomor 31/PUU-XIII/2015 dan Putusan Mahkamah Konstitusi Nomor 76/PUU-XV/2017 tentang Pengujian Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap UUD NRI Tahun 1945 diatur secara terperinci dengan salah satu pointnya yaitu melakukan perubahan dalam Pasal 27 ayat (3) UU ITE dan menurunkan ancaman pidana pada 2 (dua) ketentuan.

Abstract

Cassation Law is the right of the defendant or public prosecutor not to accept the court's decision. Cases categorized as minor crimes are cases where the threat of a criminal verdict is a maximum of 3 months of confinement/imprisonment and a fine, one of which is a criminal act of using land without permission. The purpose of this study is to review and analyze, first, the legal arrangements for filing appeals according to SEMA No. 8 of 2011 against cases of minor criminal acts of using land without permission Decision Number 164 / Pid / 2019 / PT Smr and legal considerations of the Bailiff of the Samarinda District Court in issuing a notice of appeal decision No. 164 / Pid / 2019 / PT Smr which explains that the defendant can apply for cassation. The results showed that the legal arrangement for filing an appeal according to SEMA No. 8 of 2011 against cases of minor criminal acts of using land without permission Decision Number 164 / Pid / 2019 / PT Smr is a case that is not eligible to be appealed because the criminal verdict falls on qualifications that are threatened with imprisonment under 1 (one) year. Legal considerations for the issuance of a notice of appeal decision No. 164/Pid/2019/PT Smr, which explains that the defendant can apply for an appeal based on the Bailiff being obliged to convey the Right of a Defendant because the defendant has the right to file an appeal and in Article 205 of the Criminal Procedure Code regarding the examination of minor crimes there is no specific mention of the prohibition of filing appeals.

Abstract

The wrongful arrest by investigators simultaneously occurs during the arrest process, resulting in a violation of someone's human rights. The responsibility of investigators for wrongful arrests has been regulated in the Criminal Procedure Code and the police professional code of Ethics. The research approach used is a socio-legal approach that aims to find out two main points of discussion. First, the author wants to know and analyze the legal responsibility of investigators who commit wrongful arrests from the perspective of criminal law and human rights. Second, the writer wants to know and analyze the enforcement of criminal responsibility laws against investigators who commit wrongful acts of arrest in the Kutai Kartaneagara Police area. Based on the results of the research, it can be concluded that the responsibility of the investigator is towards the occurrence of wrongful arrests from a criminal law perspective, namely by imposing sanctions on the professional code of ethics of police and disciplinary law or further regulated in Article 13 PP No. 1 of 2003 concerning the Intentions of Members of the National Police of the Republic of Indonesia. Apart from that, from a human rights perspective on wrongful arrests, investigators must be processed following Perkap No. 8 of 2009 concerning the Implementation of Human Rights Principles and Standards in implementing the Duties of the Republic of Indonesia Police. Then the obstacles in enforcing the criminal law against wrongful arrests are caused by the lack of strict application of the police code of ethics sanctions against investigators, specifically regarding sanctions against investigators who violate the police code of ethics.

Abstract

This research is based on the increase in trafficking cases in the city of Samarinda involving children as victims. Restitution is one of the rights that must be obtained by child victims of sexual violence. Meanwhile, in reality, out of the 20 cases that occurred in the city of Samarinda, there was not a single case that applied Restisui. legal protection for children victims of trafficking in Samarinda still needs a lot of improvement, especially in terms of the implementation of restitution. This study aims to identify and analyze obstacles in the implementation of restitution for children of trafficking victims in Samarinda City. From this case, the problem was formulated, namely, how to implement restitution for child victims of trafficking in the city of Samarinda, and what are the obstacles faced in the implementation of restitution for child victims of trafficking in the city of Samarinda. This research is of the Socio Legal type which was carried out using the statue approach and the case approach. The results of this study reveal that the implementation of restitution for child victims of trafficking in Samarinda City is still far from optimal. Although Law No. 21 of 2007 concerning the Eradication of Trafficking has regulated the right of restitution for victims, as well as the lack of clarity in procedures and the lack of standards in determining the amount of restitution are factors that hinder the implementation of restitution.

Abstract

The civil servants is the actor with the most corruption cases in the first semester of 2021. With its status as a state civil apparatus, including the law enforcement profession, it should receive more severe criminal sanctions. The criminal case in decision number 10/PID.TPK/2021/PT DKI. precisely without weighting. In addition, the judge's consideration of gender status where the perpetrator is a woman leads to considerations that relieve the perpetrator. This writing uses a normative research method with a case approach and a statutory approach. The analysis was carried out on library materials or secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials The results of the analysis were then described in a qualitative descriptive manner. The results of the study indicate that the accountability for criminal acts of corruption committed by state civil servants should be given weight by referring to the provisions of Article 52 of the Criminal Code (KUHP) so that the punishment in case number 10/PID.TPK/2021/PT DKI is not in line with the spirit of eradicating corruption, which should be aimed at providing a deterrent effect, both specifically and in general. Abstract

The absence of specific legislation regulating Artificial Intelligence has resulted in the lack of a special criminal offense qualification that can serve as a legal basis for imposing criminal liability on perpetrators. This condition creates a legal dilemma when the Principle of Legality is confronted with criminal acts such as the sale of Deepfake Porn on the social media platform X, which utilizes Artificial Intelligence-based technology. This research aims to examine the relevant criminal offense qualifications applicable to such acts and determine the appropriate statutory provisions for imposing criminal liability on perpetrators. The research employs a doctrinal legal research method with a statutory approach and a conceptual approach. The findings indicate that the Cybercrime Criminal Offense Qualification is more relevant than the Pornography Criminal Offense Qualification due to the principle of lex consumen derogat legi consumte, based on the locus and characteristics of the Deepfake Porn sale. Perpetrators may be held criminally liable with a maximum imprisonment sentence of 16 years and/or a maximum fine of sixteen billion Rupiah pursuant to the criminal provisions of Article 35 in conjunction with Article 51 paragraph (1) of Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) as the primary provision, along with other criminal provisions from the amendments to the ITE Law (Law Number 19 of 2016 and Law Number 1 of 2024), Law Number 27 of 2022 concerning Personal Data Protection, and Law Number 44 of 2008 concerning Pornography.
