Abstract

Planting activities are undergoing in the area of former forest with mechanism of extrication of forest area or non-forest area that commonly has high conservation value or known as High Conservation Value (HCV). However, the extrication of forest area for Palm Plantation has eroded the presence of forest with HCV disrupting ecosystem balance and harming the wellbeing of current and next generations. Legal system does not specifically regulate the limit of application for the use of forest area for palm plantation through the mechanism of forest extrication. Legal provisions at the national and regional levels encounter a difficulty accommodating the existence of area with HCV, especially in terms of regional spatial plans. Moreover, the obscurity of forest distribution and non-forestry areas with HCV also complicates the regulation at the level of imperative provisions.

Abstract

The economic independence of the community through Micro, Small, and Medium Enterprises (UMKM) is an important priority that supports social economy. Especially during a crisis and pandemic COVID19, UMKM are one of the business actors who are still able to survive when economic activity declines. However, in this great potential, UMKM actors in the mangrove ecosystem in the Mahakam delta area have weaknesses in legal understanding as evidenced by the incomplete licensing requirements, and also do not have an understanding of the urgency and procedures for making contracts and other legal aspects. Therefore, training is needed to increase the legal capacity of UMKM actors. The method used is a training involving UMKM business actors in three stages; UMKM mapping; provide material on opportunities and challenges for UMKM in mangrove ecosystems and legal knowledge for UMKM; preparation of strategic plans for UMKM for mangrove ecosystems. The results of this activity indicate an increase in the legal understanding of UMKM actors and a strategic plan for strengthening UMKM in the mangrove ecosystem in the Delta Mahakam area has been formulated. This encourages the community to participate in protecting and rehabilitating mangrove areas for mutual prosperity. Keywords: Micro, Small and Medium Enterprises ; Mangrove ; Delta Mahakam

Abstract

Mangrove merupakan kawasan penting bagi kehidupan masyarakat pesisir dan keberlangsungan layanan alam. Namun kondisi ekosistem mangrove di Kawasan Delta Mahakam masih mengalami kerusakan meskipun upaya rehabilitasi telah banyak dilakukan. Salah satu kelemahannya adalah belum adanya payung hukum terkait perlindungan dan rehabilitasi mangrove. Sehingga dibutuhkan upaya hukum berupa penyusunan produk hukum lokal terkait perlindungan dan rehabilitasi mangrove berbasis masyarakat. Pelatihan ini dilakukan melalui dua tahapan, antara lain: pemetaan produk hukum desa, dan penyusunan dengan metode Roccipi. Pemetaan di lima desa menunjukkan belum memiliki produk hukum yang berkaitan dengan rehabilitasi mangrove. Pelatihan produk hukum desa peduli mangrove dengan menggunakan metode ROCCIPI membentuk kesadaran hukum yang dibuktikan dengan keterlibatan seluruh pihak dalam menyusun kanvas desain peraturan desa peduli mangrove di lima desa yang berada di Kawasan Delta Mahakam. Hasil pemetaan dan pelatihan diperoleh data potensi penguatan produk hukum desa dan peningkatan kapasitas aparatur desa dan masyarakat dalam menyusun produk hukum desa peduli mangrove.

Abstract

This article discusses the efforts of the Indonesian Financial Audit Agency (BPK) in preventing and eradicating corruption, reviewing the BPK's main role in auditing state financial management to achieve transparency, accountability and integrity in the use of public budgets. The BPK is also involved in eradicating corruption by conducting investigative audits of suspected corruption cases and revealing facts related to the perpetrators, modus operandi and state losses. In carrying out its duties, the BPK must pay attention to the Human Rights (HAM) perspective to ensure that its efforts do not violate individual rights guaranteed by the constitution and statutory regulations. This article explores how the BPK maintains its independence to carry out objective audits and provide recommendations based on valid data. With a deeper understanding of the role of the BPK, it is hoped that this article will increase appreciation of the importance of cooperation between the BPK, government and society in overcoming corruption which undermines development and human rights principles.

(pp. 616-625).  Palembang: Penerbit & Percetakan Universitas Sriwijaya (UNSRI).Mangrove ecosystem areas in The Nusantara Capital area have not been protected, especially those located in traditional fish pond cultivation development areas. The aimed of this research is to analyse the legal problems of developing smart silvofishery ponds in mangrove rehabilitation and formulate legal strategies to overcome them. The method is a socio-legal research method with a qualitative approach used. The research results show that legal problems in the development of smart silvofishery ponds occur as a result of the absence of specific regulations governing this matter. Government and the community feel that they have no obligation to develop smart silvofishery ponds which will affect mangrove rehabilitation efforts. Besides that, fish farming operators do not understand the concept and urgency of smart silvofishery. Facing these problems, legal strategies are important to implement. Referring to the theory of legal formation, the law aims to integrate and coordinate various interests in society because in a traffic of interests, protection of certain interests can only be done by limiting various interests on the other side. The legal strategy is developed by establishing regulations at the central, regional and local levels regarding legal protection, both preventive and repressive. Preventive legal protection includes provisions that are preventative (prohabited) and repressive legal protection that is punitive (sanction). Multi-stakeholder roles and meaningful community participation are also needed.

Abstract

Pandemi Covid-19 menimbulkan dampak signifikan pada kelangsungan hidup manusia seperti krisis kesehatan, resesi ekonomi, degradasi sosial dan penurunan kualitas pendidikan. Pemerintah menerbitkan kebijakan pemasifan penggunaan protokol kesehatan    seperti herbal hand sanitizer, disinfektan dan mencuci tangan dengan sabun antiseptik dalam rangka mencegah penularan Covid-19 dan meningkatkan imun kekebalan tubuh pada masa     pasca pandemi. Produk kesehatan tersebut menjadi kebutuhan dasar selama masa pasca pandemi dimana  seringkali mengalami kelangkaan barang dan kenaikan harga permintaan. Disamping itu, ekosistem mangrove kawasan Delta Mahakam kian mengalami kerusakan akibat kurang pemanfaatan dan pengetahuan dalam rangka pelestarian mangrove. Oleh karena itu, perlu dioptimalisasi pengembangan potensi sumberdaya alam berbasiskan mangrove sebagai daya dukung pembangunan sosial ekonomi dan kesehatan lingkungan secara berkelanjutan salah satunya melalui pemanfaatan biomassa tumbuhan Bakau (Rhizophora mucronata) sebagai produk herbal hand sanitizer, disinfektan dan sabun tangan antiseptik guna mencegah penyebaran Covid-19 pada era pasca pandemi.

Abstract

The decision to build a new capital on the Kalimantan Island called Nusantara caused various conflicts, such as the neglect and marginalization of indigenous peoples and the ignoring of their certainty of access and meaningful participation. This paper explains how the substance of the Nusantara Capital development regulation is to provide full protection to Indigenous peoples or vice versa, how it impacts the protection of Indigenous people's rights, as well as how the affirmative action model fulfills the rights of Indigenous peoples in the Nusantara Capital area. Through a socio-legal approach as the method, the results of the study found that the constitution has regulated the recognition of indigenous peoples, but in the substance of regulations related to the Nusantara capital, the phrases that regulate are very weak. The phrases used do not explicitly ensure the protection of the rights of indigenous peoples, which has an impact on various neglect of the existence of indigenous peoples. As a result, a model of affirmative action is needed for indigenous peoples in the regulation of the Nusantara capital. This includes ensuring access for indigenous peoples to be involved in policymaking. Furthermore, transparency of information in the development of the Nusantara capital is important to formulate policies that accommodate the protection and fulfillment of the rights of indigenous peoples. It is important to ensure the recognition of indigenous peoples and their living space through an affirmative action model regulated by the head of the Nusantara capital authority.

Abstract

This research aimed to find out the urgency and construction of climate change legal reformulation in a sustainable and justice manner. Political legislation related to climate change currently manifests mainly through implementation regulations or even through policy products with less legal standing and binding force than if it is regulated in a law. The method used is normative legal research with a regulatory and conceptual approach. The results show that reformulation is required considering that climate change control efforts have not been effective. The environmental organisations state that various regions are still affected by climate change, experiencing deforestation and depending on the exploitation of natural resources. For these reasons, a new formulation of climate change regulation that ensures justice is to establish an omnibus law on Climate Change. This idea is new, yet still in line with the results of previous studies and research regarding the lack of climate change regulation that is still dispersed in many regulations and/or policies. The omnibus law on climate change is expected to be an instrument of climate change control that has dimensions of justice for society and the environment.

Abstract

The wrongful arrest by investigators simultaneously occurs during the arrest process, resulting in a violation of someone's human rights. The responsibility of investigators for wrongful arrests has been regulated in the Criminal Procedure Code and the police professional code of Ethics. The research approach used is a socio-legal approach that aims to find out two main points of discussion. First, the author wants to know and analyze the legal responsibility of investigators who commit wrongful arrests from the perspective of criminal law and human rights. Second, the writer wants to know and analyze the enforcement of criminal responsibility laws against investigators who commit wrongful acts of arrest in the Kutai Kartaneagara Police area. Based on the results of the research, it can be concluded that the responsibility of the investigator is towards the occurrence of wrongful arrests from a criminal law perspective, namely by imposing sanctions on the professional code of ethics of police and disciplinary law or further regulated in Article 13 PP No. 1 of 2003 concerning the Intentions of Members of the National Police of the Republic of Indonesia. Apart from that, from a human rights perspective on wrongful arrests, investigators must be processed following Perkap No. 8 of 2009 concerning the Implementation of Human Rights Principles and Standards in implementing the Duties of the Republic of Indonesia Police. Then the obstacles in enforcing the criminal law against wrongful arrests are caused by the lack of strict application of the police code of ethics sanctions against investigators, specifically regarding sanctions against investigators who violate the police code of ethics.

Abstract

Food production derived from processed types of mangroves fruit does not appear to have been widely developed or in demand by the Muara Badak community. Many people are unaware that mangrove fruit can be consumed and used as food or snacks. The potential and benefits of mangroves as a food source are still unknown and underutilized. This activity aims to disseminate information about the benefits of various types of fruit processing mangroves into processed food products through socialization. Sonneratia ovata (Pedada), a variety of mangroves that grows abundantly on the river's edge in the village of Muara Badak Ulu, is one of them. This activity was carried out on farmers and communities in the Salo Sumbala watershed in Kutai Kartanegara Regency, Muara Badak Subdistrict, and Muara Badak Ulu village. The approach taken in this activity is to lecture and provide knowledge about the many species of mangroves found in the vicinity of Muara Badak Ulu, particularly the Salo Sumbala watershed, which has the potential to produce processed food from mangrove fruit.
