Abstract

Perkembangan teknologi digital telah mendorong penerapan Rupiah Digital sebagai Mata Uang Digital Bank Sentral (DBI) berdasarkan Undang-Undang Nomor 4 Tahun 2023. Rupiah Digital diharapkan dapat meningkatkan efisiensi transaksi, memperluas inklusi keuangan, dan menjaga stabilitas moneter. Namun, penerapannya menghadapi tantangan dari segi regulasi, keamanan, dan pemerataan akses bagi seluruh lapisan masyarakat. Penelitian ini menggunakan metode kualitatif dengan pendekatan maqāṣid al-muʿāmalah, dengan menganalisis Rupiah Digital berdasarkan lima prinsip utama: ar-rawāj (peredaran kekayaan), al-wuḍūḥ (transparansi), al-ḥifẓ (perlindungan aset), ats-tsabāt (stabilitas), dan al-‘adl (keadilan). Temuan penelitian menunjukkan bahwa Rupiah Digital berpotensi meningkatkan transparansi dan aksesibilitas keuangan, tetapi memerlukan regulasi yang lebih inklusif untuk mencegah kesenjangan digital. Kerangka maqāṣid al-muʿāmalah menyoroti pentingnya menyeimbangkan efisiensi teknologi dengan perlindungan pengguna. Studi ini menyimpulkan bahwa keberhasilan Rupiah Digital bergantung pada desain kebijakan yang mengutamakan keadilan ekonomi, perlindungan aset, dan distribusi manfaat yang adil di semua lapisan masyarakat. Dengan mengadopsi pendekatan maqāṣid, implementasi Rupiah Digital dapat diposisikan sebagai instrumen keuangan yang tidak hanya inovatif tetapi juga selaras dengan prinsip-prinsip keuangan Islam.

Abstract

The exclusivism of Islamic legal schools often limits the adaptability of Islamic jurisprudence in addressing the complex realities of the contemporary Islamic economy. This study departs from the academic concern that rigid adherence to a single madhhab potentially causes legal stagnation in responding to global financial challenges. The research aims to formulate a conceptual and methodological framework for madhhab moderation as an epistemic foundation for contemporary Islamic economic jurisprudence. Using a qualitative method with critical-comparative analysis of classical and contemporary fiqh literature, this study synthesizes diverse madhhab approaches through maqāṣid al-sharī‘ah, maṣlaḥah, and ḥikmah principles. The findings reveal that madhhab moderation enables integrative, context-sensitive legal reasoning that harmonizes textual sources, socio-economic contexts, and higher legal objectives. This study proposes madhhab moderation as a model of tarjīḥ wasatī as a new methodology for formulating inclusive, responsive, and sustainable Islamic economic fatwas. The implications extend to the renewal of tarjīḥ and talfīq methods, strengthening trans-madhhab collaboration, and enhancing the global relevance of Islamic economic jurisprudence

Abstract

The relationship between Islamic law and the pitu market tradition in the form of practices carried out by Javanese society as part of pre-marriage is a form of strengthening in the development of Islamic law and gluing together traditions that develop in the community, so that this tradition is based on the maqosid sharia approach by involving prospective brides that visit seven different markets before getting married needs to be tested for its relationship and contribution to Islamic law and the community tradition. The research method used in the study used a qualitative study by conducting in-depth interviews with analysis using maqosid sharia. This research shows that the pitu market tradition has values in line with several fundamental aspects in the maqosid sharia framework such as hifz al-din and hifz al-'aql, hifz al-nasl, hifz al-mal. Thus the market pitu tradition carried out by the community as a pre-marriage has social, spiritual, and economic values in running the bride and groom's household life in the future. This market pitu tradition is a practice that is believed to provide blessings and introduce a form of responsibility if after a marriage from various aspects in the practice of the market pitu tradition.

Abstract

The advancement of digital technology has driven significant transformation in the economic sector, including trade through marketplaces, which offer transaction efficiency. This study examines the understanding and implementation of the Wakalah bil ujroh contract among students of An-Nawawi Berjan, Purworejo, who have a background in Islamic education and whose activities are not far behind digital applications. With a qualitative descriptive-analytical approach, data were obtained through interviews, observations, documentation, and literature reviews related to Islamic law. The analysis shows that the Wakalah bil ujroh contract is implemented by fulfilling the pillars and requirements of sharia, such as the legal capacity of the parties involved, clarity of ijab-qabul, halal transaction objects, and agreements regarding ujrah, accompanied by high values of trust and accountability. Although there are technical obstacles such as differences in perception regarding the nominal ujrah, the implementation of this contract reflects a good understanding of sharia principles in digital transactions. This research contributes to the literature on Islamic economic law and offers practical guidance for Muslim communities to integrate sharia values into the digital economy.

Abstract

Government Regulation No. 35 of 2024 on Franchising aims to create a fair and transparent business relationship between franchisors and franchisees. This study examines the application of the maqashid al-adl principles, particularly the principles of i’ṭā’ al-ḥuqūq (giving rights to those entitled), man‘ az-zhulm (preventing injustice), al-musāwah (equality), al-wuḍūh (clarity), and at-takāful (solidarity), in the regulation to ensure the creation of a fair system that benefits both parties. Descriptive qualitative research methodology is employed, examining the text of the regulation and associated legal papers. It is anticipated that this research would aid in the creation of just and sustainable franchising regulations as well as Islamic economic law. The practical implications of this research include strengthening transparency and accountability in franchising relationships and providing protection for franchisees' rights.

Abstract

Artikel ini mengkaji fatwa Dewan Syariah Nasional-Majelis Ulama Indonesia (DSN-MUI) tentang transaksi emas secara elektronik dari perspektif sosiologis. Hadits-hadits Nabi yang mengatur perdagangan emas dan perak menjadi landasan fatwa DSN-MUI, yang mensyaratkan agar dilakukan secara tunai untuk menghindari transaksi riba. DSN-MUI mempertimbangkan konteks sosio-historis dan pendapat ulama klasik hingga kontemporer, yang menyatakan dahulu uang dapat dibuat dengan emas dan perak. Saat ini, perak dan emas dianggap sebagai komoditas, bukan alat pembayaran sah. Oleh karenanya, sepanjang emas belum menjadi alat tukar resmi, DSN-MUI berkesimpulan bahwa transaksi emas nontunai dapat diterima. Fatwa ini berlandaskan pada pemikiran hukum ushul dan fikih yang berlaku, serta ada atau tidaknya 'illat dan adat istiadat masyarakat, semuanya berperan dalam penerapan hukum tersebut.

Abstract

This study integrates the epistemology of uṣūl al-fiqh with blockchain ontology to formulate a digital ijtihad-maqaṣidī model relevant to the digital Islamic economy. The problem examined: how to develop an istinbāṭ methodology that is able to read and design laws in a blockchain algorithmic system? The novelty of this research lies in the combination of maqaṣid-driven ijtihad with technological architecture (smart contracts, digital identity, governance), a philosophical approach that has never been formulated systematically. The methods used are multi-methodological philosophical-normative: ontological analysis of technology, ushulī hermeneutics on nash and rules, and conceptual synthesis validated through thought experiments and expert panels; Data are derived from selected literature, fatwas, whitepapers, and case studies. The findings show three operational pillars (sharia design thinking; maqaṣid-guided algorithmic ethics; qawaʿid-based smart contracts) that enable the instilling of sharia values in system design. Implications: ijtihad becomes a proactive digital legal design tool and guideline for fatwas, regulators, and sharia fintech developers.

Abstract

This study discusses the DSN-MUI fatwa regarding the dropship business practice from the sharia perspective using the maqashid al-muamalah approach. Dropship is an innovative business concept where merchants sell goods to customers without stocking inventory. Although the DSN-MUI Fatwa has provided legal guidance regarding dropshipping, understanding the Sharia principles underlying this Fatwa remains inadequate. The aim of this research is to evaluate the maqashid al-muamalah dimensions introduced in the DSN-MUI Fatwa on dropship and to understand its consequences and relevance within the framework of sharia economics and law. The research method employed is literature review, involving the collection and review of the DSN-MUI Fatwa on dropship and related literature on dropship and maqasid al-mu’amalah. The findings indicate that the DSN-MUI Fatwa reflects characteristics and principles relevant to the maqashid al-muamalah dimensions, such as sustainability, transparency, stability, protection, and justice. The fatwa aims to regulate dropship practices fairly, transparently, and in accordance with sharia values in the context of modern economics. This research provides practical guidance for merchants, consumers, and religious authorities involved in dropship. It is hoped that this research will strengthen the sharia legal framework related to modern business in the context of the global economy and enhance understanding of dropship practices from the perspective of maqashid al-muamalah

Abstract

The use of new transactions in Islamic finance has faced criticism, particularly regarding the implementing of ḥȋlah (legal stratagem) which is seen as adopting conventional financial instruments that go against religious morals. This research examines the application of ḥȋlah in the Indonesian Ulama Council's (DSN-MUI) fatwa, or religious ruling, on funds that are not considered to be halal (funds that cannot be recognized as income). A way to divide up accounts and direct non-halal money toward social causes is offered by the DSN-MUI. Using a normative-philosophical perspective, this study reveals how ḥċlah is applied in the fatwa. The results show indications of the application of ḥȋlah, as seen from: (1) the recognition of non-halal funds, (2) the obligation to have a special account to separate halal and non-halal funds, and (3) the distribution of non-halal funds for socio-religious activities as an effort to avoid the stagnation of wealth. Overall, this fatwa tends to use ḥȋlah by referring to the practice of the Prophet Muhammad in handling assets with unclear legal status.

Abstract

This article departs from a new anxiety in the world of Islamic law: human dignity is now threatened not only in the social-physical space, but also in the digital space. The deepfake phenomenon has given birth to a form of slander that is so convincing that it can damage reputations, collapse public trust, and even cause economic losses. With a doctrinal qualitative approach enriched by the AIRE (authenticity, integrity, reliability, explainability) digital forensic standard, this study reconstructs the concept of ḥifẓ al-ʿirḍ in uṣūl al-fiqh to be relevant to contemporary digital challenges. The results of the study map the typology of digital slander: sexualization, political manipulation, and financial fraud and classify digital evidence into three levels: valid as bayyinah, just forensic qarīnah, or must be rejected. The analysis of maqāṣid shows that the protection of dignity can defeat the claim of freedom of expression when the negative impact is greater. From this was born new ideas: al-bayyinah al-raqmiyyah as a standard of digital evidence, karāmah al-raqmiyyah, which equates digital insults with qadhf, and the selective application of the principle of sadd/fatḥ al-żarāʾiʿ to AI technology. This article then offers a maqāṣid framework for the protection of digital dignity with four layers: prevention, detection, adjudication, and remediation as a bridge between classical legal theory and modern forensic practice, while presenting a blueprint for the protection of dignity in the digital age
