Abstract

The advancement of digital technology has driven significant transformation in the economic sector, including trade through marketplaces, which offer transaction efficiency. This study examines the understanding and implementation of the Wakalah bil ujroh contract among students of An-Nawawi Berjan, Purworejo, who have a background in Islamic education and whose activities are not far behind digital applications. With a qualitative descriptive-analytical approach, data were obtained through interviews, observations, documentation, and literature reviews related to Islamic law. The analysis shows that the Wakalah bil ujroh contract is implemented by fulfilling the pillars and requirements of sharia, such as the legal capacity of the parties involved, clarity of ijab-qabul, halal transaction objects, and agreements regarding ujrah, accompanied by high values of trust and accountability. Although there are technical obstacles such as differences in perception regarding the nominal ujrah, the implementation of this contract reflects a good understanding of sharia principles in digital transactions. This research contributes to the literature on Islamic economic law and offers practical guidance for Muslim communities to integrate sharia values into the digital economy.

Abstract

Waqf is a vital instrument in Islamic socio-religious development. However, its management at the village level faces significant challenges, as seen in Entak Village, Ambal Subdistrict, Kebumen Regency. This study aims to identify the main problems in waqf land management in the village and to formulate strategic solutions for improving local waqf governance. Using a qualitative case study approach, the research involved field observation, interviews with nadzir (waqf managers), and document analysis. The findings reveal three major challenges: weak capacity of nadzir in asset management, lack of formal legal status for waqf lands, and low community awareness about waqf principles and laws. As a result, many waqf assets remain underutilized or are at risk of disputes. To address these issues, the study recommends capacity-building programs for nadzir, accelerated land certification through collaboration with BPN and BWI, and community-based public education. These strategies are expected to promote more professional, productive, and sustainable waqf management at the grassroots level.

Abstract

This qualitative-comparative case study aims to analyze and compare the traditional practice of land pawn (rahn) in Padureso Village, Kebumen, from the perspective of Islamic jurisprudence (fiqh) according to the Imam Abu Hanifah and Imam Syafi'i Schools of Thought (Madzhabs). This study is relevant as it highlights the unique customary aspects concerning the utilization of the pledged object (marhun). Primary field data indicate a deviation in practice, where the pledged land is entirely managed and utilized by the creditor (murtahin), who also takes all the produce without any revenue sharing with the landowner (rahin), despite receiving permission for use. The analysis reveals fundamental differences in the juristic views. The Imam Abu Hanifah Madzhab generally prohibits the murtahin from benefiting from the marhun as it is deemed potential usury (riba), even with the rahin's permission. Conversely, the Imam Syafi'i Madzhab tends to prohibit utilization by the murtahin if it is stipulated in the contract (akad), but may permit it if there is genuine consent from the rahin outside the contract. Therefore, the practice in Padureso Village, which grants full profit to the murtahin, is categorized as a void pledge (rahn fasid) because it contains an element of usury or violates the essential nature of the collateral contract.
