Abstract

Tren Tiktok sebagai media sosial yang banyak digunakan oleh generasi milenial dan generasi Z karena penggunaan fitur editing video yang baru dan beragam dapat meningkat kreativitas para konten kreator dalam membuat karya. Akan tetapi hal tersebut ternyata tidak menjadi jaminan originalitas konten video yang dibuat karena terdapat konten-konten video di Tiktok yang terindikasi melakukan pelanggaran hak cipta. Penelitian ini akan menganalisis jenis pelanggaran hak cipta yang terjadi pada konten video Tiktok dan bagaimana upaya perlindungan hukumnya. Hasil penelitian menunjukan bahwa terdapat indikasi pelanggaran hak cipta video Tiktok baik hak moral dan hak ekonomi pencipta dan pemegang hak cipta. Upaya perlindungan hukum telah diatur dalam UU Hak Cipta No 28 Tahun 2014 dimana pencipta dan pemegang hak cipta dapat melakukan upaya hukum perdata maupun pidana serta perlu peran lebih dari penyedia aplikasi Tiktok dalam mengontrol konten-konten yang terindikasi melakukan pelanggaran hak cipta. Metode penelitian yang digunakan adalah secara normatif melalui kajian kepustakaan.

Abstract

The practice of debt receivables was used as a means to get income from giving debts with excess from the moment of return which became known as loan sharks. In Bima City, the practice of loan sharking became known as the "kalampa piti" system or silencing money from loans. The law in Indonesia itself does not prohibit interest in every lending and borrowing transaction. This can be seen in article 1754 BW which is also strengthened in article 1765 BW which allows interest in every lending transaction. However, the problem is the process of agreeing on debt receivables agreements based on verbal statements without a written agreement that causes conflicts between kalampa piti parties and customers in the form of physical, psychic violence to the seizure of valuables. For this reason, it is necessary to have concrete procedures to ensure legal certainty and protection for the parties.

Abstract

The character of geographical indications from the provisions of international law refers to the area of the object of geographical indications. The purpose of this research is to find the characteristics of Ponda Wasampela Mats so that they have the potential to meet the criteria to be given legal protection as a geographical indication product and analyze the local government's efforts in encouraging legal protection of Ponda Wasampela Mats as geographical indication products. This research uses the type of Socio-Legal Legal Research. The legal approach taken is the legislation approach, concept approach and case approach. The results showed that the Ponda Wasampela mat has met the criteria to be submitted for registration of geographical indications, this is reflected in the aspect of reputation, namely that it has been used during the Buton Sultanate era in traditional rituals of marriage, death events, from the aspect of quality, namely the raw material of the mat (pandan leaves) used, raw materials (dyes and seawater), leaf drying techniques, shapes / motifs, weaving techniques, the level of neatness, and the quality of the resulting mats, aspects of characteristics namely Pandanus duri leaves (as raw material), dyes (as coloring materials), economic aspects namely Ponda Wasampela Mats currently have a selling price in the range of IDR. 50,000 (fifty thousand rupiah) and has been marketed both locally and nationally. While the government's efforts in order to encourage Ponda Wasampela Mats in geographical indication registration are the local government of Buton Regency needs to initiate commitment and efforts in carrying out supervision and guidance in encouraging Ponda Wasampela Mats to be submitted for Geographical Indication registration

Abstract

The development of generative artificial intelligence (GAI) has impacted various fields, including higher education. This research examines the use of GAI as an evaluator and feedback provider in distance legal education. This study tested five GAI models: ChatGPT, Perplexity, Gemini, Bing, and You, using a sample of 20 students and evaluations from legal experts. Descriptive statistical analysis and non-parametric tests, including Wilcoxon, intraclass correlation coefficient (ICC), Kappa, and Kendall's W, were used to assess accuracy, feedback quality, and usability. The results showed that ChatGPT was the most effective GAI, with the highest mean scores of 4.22 from experts and 4.12 from students, followed by Gemini with scores of 4.15 and 4.07. In terms of binary judgement accuracy, Gemini scored 80%, ChatGPT 60%, while Perplexity, Bing, and You had lower scores. Statistical analysis showed moderate agreement (ICC=0.439) and low alignment (Kappa=-0.058) between the GAIs and expert evaluations, with a Kendall's W value of 0.576 indicating moderate consistency in judgements. These findings emphasize the importance of selecting effective GAIs such as ChatGPT and Gemini to improve academic evaluation and learning in legal education, and pave the way for further innovations in the use of AI.
