Abstract

Shadra mendapat julukan yang sangat mengagumkan dalam dunia filsafat Islam. Abdul Kadir Riyadi dalam Arkeologi Tasawufnya, menyatakan Mulla Shadra layak menyandang gelar sebagai guru ketiga dalam tasawuf falsafi setelah Ibn Arabi dan Suhrawardi. Sedangkan menurut M. M. Sharif dalam A History of Muslim Philosophy, memandang sosok Mulla Shadra adalah guru ketiga setelah Ibn Sina dan Suhrawardi.1 Dari nama-nama besar inilah Shadra bisa membuktikan dirinya sebagai tokoh yang perlu diperhitungkan dalam kazanah filsafat Islam. Ibn Sina, Ibn Arabi dan Suhrawardi, melalui ketiga tokoh ini Shadra bisa mengkonstruk nalar filsafatnya. Dalam ranah filsafat Parepatetik yang dibangun dari nalar filsafat Aristotelean, ajaran Ibn Sina (980-1037 M) menjadi pondasi awal Shadra untuk mengkonstruk nalar filsafatnya. Semua persoalan filsafat Shadra berpatokan kepada al-syaikh al-rais, sang guru pertama Ibn Sina. Shadra mengambil pendapat Ibn Sina dalam rangka membentuk nalar filsafat teosofinya secara independen, sebagaimana prioritas wujud dan lemahnya esensi. Tentu Shadra tidak hanya mengambil begitu saja pendapat Ibn Sina, sebagai pemikir yang independen Shadra bersikap objektif dalam mengkritisi dan memodifikasi pandangan Ibn Sina.2 Sebagai filosof yang mandiri Shadra dituntut untuk mengambil sikap secara arif, tidak selalu membebek dengan pendapat Ibn Sina

Abstract

The The purpose of writing this article is to find out the Constitutional Rights of Indonesian Citizens Who Become Workers Abroad, Indonesian Migrant Workers (Overseas Migrant Workers) are every citizen who is eligible to work abroad in employment for a certain period of time by receiving wages. The labors are protect by Law Number 39 Year 2004 on the placement and protection of Indonesian Migrant Workers (Overseas Migrant Workers) abroad. The formulation of the problem in this research is how the protection of Indonesian Migrant Workers’ according to Law Number 39 Year 2004 concerning the placement and protection of workers abroad and how the implementation of Law No. 39 of 2004 For Indonesian Migrant Workers. Type of research used is descriptive analytical, the method used in this research is approach legislation. A legislative approach is an approach that is undertaken by incorporating relevant laws and regulations pertaining to legal issues being addressed. Based on the description of the background and discussion of this research, it can be concluded that the protection of Indonesian Migrant Workers according to Law Number 39 Year 2004 concerning the placement and protection of workers abroad of pre-placement, during placement, post-placement. As well as supervision of the implementation and protection of Indonesian workers carried out with the objective of reporting job vacancy, compulsory report on employment in the company, and job training. The application of Indonesian Migrant Workers Law pursuant to Law Number 39 Year 2004 is intended to protect the basic rights of workers / laborers and ensure equal opportunity and treatment without discrimination on any basis to achieve workers' welfare and the government remains accountable The fate of Indonesian Migrant Workers and protection of Indonesian Migrant Workers and with the existence of Article 94 of Law Number 39 Year 2004 mandates to establish BNP2TKI as an institution assigned by the state to provide legal protection to Indonesian Migrant Workers. Abstract

The purpose of this paper is to find out the epistemology of zihar in the family is a phenomenon that needs to be understood in the context of Islamic law. Zihar is an Islamic legal term that refers to the statement or action of a husband who considers his wife as a mahram (a relationship that prohibits marriage) for him. In the view of Islamic law, zihar is considered incompatible with the principles of justice, equality and respect that are the cornerstones of husband-wife relationships in Islam. In this journal, the author presents an Islamic legal understanding of zihar and its impact on family relationships. The author also analyzes the Islamic values that underlie husband-wife relationships, including love, compassion, mutual understanding and respect. In the context of Islamic legal views, zihar is considered an act that violates the principles of justice and equality in conjugal relationships. Islam emphasizes the importance of good communication, deliberation, mediation, and fair problem solving in the family. Zihar has no valid legal basis in Islam, and the author emphasizes the need to avoid demeaning and unfair attitudes towards life partners. Keywords: Islamic Law, Epistemology of Zihar, Family

Abstract

This study discusses the position of wives, children, and property in unregistered marriages based on Islamic law, Law No. 1 of 1974, and Constitutional Court Decision No. 46/PUU-VIII/2010. The method used is a legal-normative approach with a comparative approach to Islamic legal literature and legislation. The results of the study show that according to Islamic law, unregistered marriages are valid religiously if they fulfill the pillars and requirements of marriage, but they do not have legal force because they are not registered. As a result, wives and children find it difficult to obtain legal protection for their status and civil rights, including inheritance rights and joint property. Constitutional Court Decision No. 46/PUU-VIII/2010 recognizes the civil relationship between children born out of wedlock and their biological fathers, thereby strengthening legal protection for children born from siri marriages. Therefore, marriage registration is important to ensure legal certainty for all parties.
