Abstract

Kelompok tani merupakan suatu kelompok yang dapat meningkatkan potensi desa. Desa Ranah Baru merupakan salah satu desa yang berada di Kecamatan Kampar Kabupaten Kampar yang memiliki lahan pertanian yang dapat dikelola oleh masyarakat maupun kelompok tani sebagai sumber pangan dan sumber mata pencaharian masyarakat setempat. Untuk meningkatkan potensi desa maka dibuatlah suatu model pemberdayaan kelompok tani. Metode yang digunakan untuk penelitian ini adalah metode kualitatif dengan cara pengisian kuisioner serta melakukan wawancara kepada masyarakat dan kelompok tani di Desa Ranah Baru. Abstract

This study aims to analyze the responsibilities of the Witness and Victim Protection Agency (LPSK) and the state in implementing restitution for victims of sexual violence, particularly when the perpetrators are unable to pay or are sentenced to death. The background of this research lies in the weak implementation of restitution, which should be a fundamental right of victims, as illustrated by the case of Herry Wirawan based on the Bandung High Court Decision Number 86/Pid.Sus/2022/PT Bdg. The research addresses two main problems: (1) how the state and LPSK ensure the victims’ rights to restitution under such circumstances, and (2) what obstacles hinder the implementation of restitution based on the decision. The study employs a normative juridical method with a statutory and case study approach. The findings show that the implementation of restitution still faces serious obstacles, such as the absence of technical mechanisms, the lack of designated executing institutions, and the lack of coordination among law enforcement agencies. LPSK plays a role in proposing and calculating restitution amounts but lacks execution authority. Moreover, the state has not yet fulfilled its role as the ultimate guarantor for victims when the perpetrator is unable to comply. In conclusion, Indonesia’s legal system needs to strengthen technical regulations, ensure inter-agency coordination, and affirm the state's role as a guarantor of restitution to achieve meaningful restorative justice for victims of sexual violence

Abstract

Study Interest State Administrative Law, Implementation of Business Licensing for Laundry Services Activities in Barong Tongkok District, West Kutai Regency, under the guidance of Dr. Siti Kotijah S.H., M.H and Agustina Wati S.H., M.H. Business licensing is an important aspect in the implementation of business activities, including laundry service businesses that are increasingly growing in urban communities. Laundry businesses require official permits from the local government as a form of compliance with regulations governing economic activities and environmental protection. With licensing, the government can supervise business activities and ensure that business actors comply with operational standards, including in the management of domestic waste generated from the washing process. Laundry business licensing is also an instrument to ensure consumer safety and comfort. Business permits include technical and administrative requirements, such as location permits, environmental permits (UKL-UPL/SPPL), and operational permits from related agencies such as the Investment and One-Stop Integrated Services Agency (DPMPTSP). Without complete permits, business actors can be subject to administrative sanctions to criminal penalties, as regulated in various laws and regulations such as Law Number 32 of 2009 concerning Environmental Protection and Management. Research on laundry business permits is important to provide a comprehensive picture of the processes, obstacles, and legal and environmental implications that may arise if business actors do not comply with applicable licensing provisions. Social legal research, with field studies at the Investment and One-Stop Integrated Service Office of West Kutai Regency, Barong Tongkok District and Laundry businesses in Barong Tongkok, West Kutai. Laundry businesses that have permits are 7, while there are still many laundry businesses that do not have laundry business permits. Business actors do not have business permits, because the reason is that their business is small, and the permit process is very difficult, and business actors avoid paying local taxes.

Abstract

Samarinda City is one of the cities located in East Kalimantan Province and is often found to have cases of Domestic Violence. The implementation of Law Number 23 of 2004 concerning the Elimination of Domestic Violence should be a solution to participate in preventing and overcoming acts of Domestic Violence as a law enforcement effort. However, in its implementation it turns out that there are still cases of Domestic Violence. The research approach used in this research is a Social Legal Research approach which aims to examine two main points of discussion, first to examine the handling of victims of Domestic Violence in Samarinda City. Second, to examine the role of the Perempuan Academy program in empowering community groups for Family Welfare Empowerment to prevent Domestic Violence in Samarinda City. The results of the research show that the handling of Domestic Violence in the City of Samarinda is provided both repressively and preventively, not only to deal with it after it occurs and is experienced by the victim, but also to participate in preventing it before the crime occurs in order to reduce cases of Domestic Violence in the City Samarinda and the Women's Academy program is considered sufficient to help the Family Welfare Empowerment group in Karang Anyar Village, Samarinda City to prevent Domestic Violence.

Abstract

This research discusses the Legal Protection for the Community in Population Administration Services. However, population administration services are misused with the use of brokers by the community. This research uses a social legal approach. The inhibiting factors in legal protection for the community of Sumber Sari Village, Long Mesangat District, Kutai Timur Regency, in population administration services, are complex bureaucracy, lack of knowledge and development of low human resources about law, and limited access. Legal protection for the community in population administration services is very important to ensure that the rights of the Sumber Sari Village community are fulfilled and protected.

Abstract

Minors today are increasingly involved in criminal acts, and this does not happen without reason. One contributing factor is the consumption of alcoholic beverages. Children in Ujoh Bilang Village have started consuming alcohol, influenced by several factors, despite being underage. They consume both branded alcoholic drinks and traditional beverages such as arak. Based on research conducted in Ujoh Bilang Village, Mahakam Ulu, several factors have been identified as reasons why minors consume alcohol. These include internal factors within the child, external factors such as family influence, environment, alcohol vendors, and cultural factors. These elements serve as the background for underage alcohol consumption in the village. According to the research findings, minors who consume alcohol are not subjected to criminal punishment but are instead given warnings or educational guidance and then returned to their parents. However, minors can be held criminally responsible under the juvenile criminal justice system if they are unable to control themselves due to intoxication, leading to criminal acts such as accidents, fights, or even murder. In such cases, minors may be prosecuted for their actions.
