Abstract

Abstrak Peran Yayasan Lembaga Konsumen Indonesia (YLKI) Dalam Perlindungan Konsumen Di Indonesia adalah mereka harus secara eksklusif mewakili kepentingan-kepentingan konsumen, kemajuan perdagangan akan tidak ada artinya jika diperoleh dengan cara-cara yang merugikan konsumen, mereka harus non profit making dalam profil aktivitasnya, mereka tidak boleh menerima iklan-iklan untuk alasan-alasan komersial apapun dalam publikasi-publikasi mereka, mereka tidak boleh mengizinkan eksploitasi atas informasi dan advis yang mereka berikan kepada konsumen untuk kepentingan perdagangan, mereka tidak boleh mengizinkan kebebasan tindakan dan komentar mereka. Dan Peran Badan Perlindungan Sengketa Konsumen (BPSK) Dalam Perlindungan Kon-sumen Di Indonesia adalah Menangani perkara konsumen melalui mediasi, konsiliasi, dan arbitrase, membuka konsultasi perlindungan konsumen, mengawasi pencantuman klausul baku, jika ada pelanggaran Undang-Undang Perlindungan Konsumen. BPSK wajib melaporkan kepada penyidik, BPSK wajib menerima pengaduan seacara tertulis ataupun tidak tertulis mengenai berbagai jenis pelanggaran, BPSK bertugas melakulan pemerik-saan perkara dan penelitian terkait masalah perlindungan konsumen, BPSK berhak me-manggil pelaku usaha yang diduga melanggar undang-undang perlindungan konsumen, BPSK berhak menghadirkan saksi ahli, saksi atau seorang yang dianggap mengetahui tindak pelanggaran undang-undang perlindungan konsumen, BPSK bisa meminta bantuan penyidik dalam hal mendatangkan saksi, saksi ahli dan pelaku usaha jika mereka tidak mau memenuhi undangan dari BPSK, memeriksa kebenaran alat bukti untuk tujuan penyelidikan, memastikan ada atau tidaknya kerugian di pihak konsumen, BPSK harus memberitahukan setiap putusan atas pelangaran kepada pelaku usaha, BPSK berhak menjatuhkan sanksi administratif kepada pelaku usaha yang melakukan pelanggaran. Kata Kunci : Yayasan Lembaga Konsumen Indonesia (YLKI), Badan Perlindungan Sengketa Konsumen (BPSK), Perlindungan Konsumen. Abstract The Role of the Indonesian Consumers Foundation (YLKI) in Protection Consumers In Indonesia, they must exclusively represent the interests of consumers, the progress of trade will be meaningless if it is obtained in ways that are detrimental to consumers, they must be non-profit making in their activity profiles, they must not accept advertisements for reasons in their publications, they must not allow the exploitation of the information and advice they provide to consumers for commercial purposes, they must not allow their freedom of action and comment. And the role of the Consumer Dispute Protection Agency (BPSK) in Consumer Protection in Indonesia is to handle consumer cases through mediation, conciliation and arbitration, open consumer protection consultations, supervise the inclusion of standard clauses, if there is a violation of the Consumer Protection Law. BPSK is obliged to report to investigators, BPSK is obliged to accept written or unwritten complaints regarding various types of violations, BPSK is tasked with conducting case examinations and research related to consumer protection issues, BPSK has the right to summon business actors suspected of violating consumer protection laws, BPSK has the right to present witnesses experts, witnesses or someone who is deemed to know the act of violating the consumer protection law, BPSK can ask investigators for assistance in bringing witnesses, expert witnesses and business actors - if they do not want to fulfill the invitation from BPSK, check the correctness of the evidence for the purpose of the investigation is to ensure whether or not there is a loss on the part of consumers, BPSK must notify business actors of any decision regarding violations, BPSK has the right to impose administrative sanctions on business actors who commit violations.

Abstract

Abstrak Laju penularan Virus Covid-19 yang semakin tinggi membuat Pemerintah kembalimenetapkan kebijakan pengetatan kegiatan masyarakat. Faktor mobilitas warga yang tinggi saat libur lebaran dan varian baru SARS-CoV-2 (Delta) diperkirakan sebagai penyebab tingkat laju penularan Virus Covid-19 menjadi semakin tinggi. Situasi tersebut meng-haruskan pemerintah mengeluarkan peraturan dan kebijakan baru, ini sangat di perlukan dalam keadaan Negara yang tidak normal seperti sekarang, diharapkan dengan diberla-kukannya hukum dan kebijakan baru ini dapat menjaga ketertiban dan ketentraman masyarakat. Metode penelitian yang digunakan adalah penelitian hukum normatif yaitu sebuah metode penelitian hukum yang dilakukan dengan meneliti bahan pustaka atau data sekunder. Pemberian atau penerapan sanksi pidana jika dikaji dari segi keadilan dalam masyarakat, penerapan sanksi dan putusan yang diberikan dinilai belum memberikan rasa keadilan dalam masyarakat tidak relavan jika pelaku pelanggar PSBB langsung dikenakan sanksi pidana. Kata Kunci : Asas Keadilan, Pandemi, Sanksi Pidana Abstract The higher rate of transmission of the Covid-19 Virus has made the government re-establish a policy of tightening community activities. The high mobility factor of citizens during eid holidays and the new variant of SARS-CoV-2 (Delta) is estimated to be the cause of the rate of transmission of the Covid-19 Virus to be higher. The situation requires the government to issue new regulations and policies,thisis very necessary in the state of the country that is not normalas it isnow,it is hope dthatwith theen actment of this new law and policy can maintain public order and tranquility.The type of research that the author uses is normative legal research, a legal research method that is carried out by examining library materials or secondary data. The approach used by researchers is a normative juridical approach.The provision or application of criminal sanctions if studied in terms of justice in society, the application of sanctions and verdicts given is considered to have not provided a sense of justice in the community is not willing if the perpetrators of PSBB violators are directly subject to criminal sanctions.

Abstract

Abstrak Tindak pidana korupsi di Indonesia telah masuk dalam kategori membahayakan. Persoalan bangsa yang bersifat darurat yang dihadapi Negara Indonesia dari masa ke masa dengan rentang waktu yang relatif lama belum dapat terselesaikan dengan baik, tetap saja para pelaku tindak pidana korupsi hadir di negeri ini sebagai penjajah yang menjadi musuh seluruh elemen masyarakat. Sehubungan dengan korupsi tersebut melahirkan sejumlah pelaku utama korupsi salah satunya Pejabat Publik. Pejabat mempunyai peran yang strategis untuk melakukan korupsi lewat wewenang yang melekat pada jabatan itu. Perbuatan mereka dapat mengakibatkan kebangkrutan nasional. metode penelitian yuridis normatif . Dasar hukum penjatuhan pidana tambahan berupa Pencabutan Hak Menduduki Jabatan Publik Bagi Pelaku Tindak Pidana Korupsi. Di Indonesia dikarenakan Pencabutan hak-hak tertentu hanya untuk tindak pidana yang tegas ditentukan oleh undang-undang bahwa tindak pidana tersebut diancam oleh pidana tambahan . Kata Kunci : Pencabutan , Hak , Korupsi Abstract Corruption in Indonesia has been categorized as dangerous. The nation's emergency problems faced by the Indonesian state from time to time with a relatively long time span have not been properly resolved, but the perpetrators of criminal acts of corruption are present in this country as invaders who are enemies of all elements of society. In connection with this corruption gave birth to a number of main perpetrators of corruption, one of which was Public Officials. Officials have a strategic role to commit corruption through the authority attached to the position. Their actions can result in national bankruptcy. normative juridical research method. The legal basis for imposing additional penalties in the form of revocation of the right to occupy public positions for perpetrators of criminal acts of corruption. In Indonesia, due to the revocation of certain rights only for criminal acts that are expressly stipulated by law that the crime is punishable by additional punishment.

Abstract

This study seeks to explore and analyze constitutional law research published in the Scopus database over the past two decades, from 2005 to 2024. Using bibliometric analysis combined with VOSviewer software, it examines trends, patterns, and developments in the field during this time frame. The findings reveal that constitutional law studies published over the last two decades have yet to provide a comprehensive contribution. Based on these findings, the study highlights the need for constitutional law research that focuses on the adaptation and transformation of legal orientations in the era of globalization, both conceptually and in practical application. By addressing these processes, future challenges in constitutional law can be more effectively managed, paving the way for a more progressive legal system. The study underscores the importance of bold and forward-thinking constitutional law research that tackles fundamental issues and offers transformative solutions for the governance of national legal systems.
