Abstract

This legal research aims to determine the application of E-Court in dispute resolution in the Semarang state administrative court and to find out what obstacles are encountered in the application of E-Court both in court in general and in the Semarang state administrative court. This research belongs to the type of empirical legal research that aims to analyze the law which is seen as patterned community behavior in people's lives who always interact and relate to social aspects. Where in this study is used to analyze the process of implementing E-Court in dispute resolution at the Semarang State Administrative Court. According According to this research, it is known that the Semarang State Administrative Court has provided E-Court services fully effectively starting from registration, litigation, to reading the verdict. The implementation of E-Court in the Semarang state administrative court has a very significant impact on the court process, which includes encouraging high mobility and increasing the productivity level of case handling so that it can realize the realization of an effective and efficient court based on the principles of simple, fast, and low-cost justice.

Abstract

Kita hidup di masyarakat dengan berbagai aturan yang disebut norma. Bentuk norma pokok adalah norma agama, norma kesusilaan, norma kesopanan, dan norma hukum. Pembelajaran tentang norma sangat penting untuk meningkatkan kebajikan perilaku siswa. Karena itu, pembelajaran norma tidak bisa hanya diajarkan, tetapi juga harus dipraktikkan. Meskipun demikian, pembelajaran norma bisa diajarkan dengan model saintifik pada amata pelajaran Pendidikan Pancasila dan kewarganegaraan Tingkat SMP/MTS yang bersintak: mengamati, menanya, mengeksplorasi, mengasosiasi, dan mengomunikasikan. Metode Penelitian yang dipakai adalah empiris. Kesimpulan yg diambil Pembelajaran saintifik tentang norma tidak hanya memberikan pengetahuan, tetapi juga pengalaman belajar secara mental dan sosial. Siswa tidak hanya mendapatkan pengetahuan, tetapi juga meningkatkan juga pengalaman hidupnya sehingga akan selalu menaati norma yang berlaku di masyarakat.

Abstract

Follow the asset is the right approach to use in eradicating corruption in this era. The trend of low verdicts for corruptors and the suboptimal recovery of assets resulting from corruption are reasons to prioritize confiscation of assets rather than criminalizing corruptors. The aim of this research is to analyze the importance of implementing Non-Conviction Based Asset Forfeiture in corruption regulations in Indonesia. The method used in writing this article is a normative legal research method with a conceptual approach. The results of this research are that the use of NCB can optimize the recovery of assets resulting from corruption because it does not depend on a complicated criminal case examination process. The defendant's fault is not a criterion for confiscating assets, but proving that the assets are illegal is the basis for confiscating assets.

Abstract

The implementation of WvSvNI as a rule of criminal law in Indonesia after the proclamation of independence of the Republic of Indonesia automatically enforces the principle of formal legality embedded in it. The principle of formal legality is rigid because it places criminal law as the only basis for punishing someone's actions for an act regulated therein. The principle of formal legality also negates the existence of living law in Indonesian society, which is often known as customary law. Criminal law reform through the ratification of the National Criminal Code seeks to integrate living law as a source of criminal law. This article will discuss issues related to the existence of living law (Adat law) in the renewal of national criminal law. The method used in this legal research is a normative legal research method with a statutory approach. The results of this study indicate that the inclusion of living legal provisions (Adat law) into criminal law is an effective effort to achieve comprehensive justice for the Indonesian people, the actual form of which is to protect society (especially victims) from actions that are detrimental to themselves. Society is protected from not only mala prohibita acts but also extraordinary criminal acts, one of which is customary crime.

Abstract

Kasus korupsi terus mengalami peningkatan dari waktu ke waktu di Indonesia. Korupsi yang terjadi tidak hanya berdampak terhadap kerugian bagi keuangan negara, akan tetapi juga menghambat pembangunan serta kesejahteraan masyarakat. Melihat dampak korupsi yang begitu besar, tidaklah berlebihan jika korupsi disebut sebagai kejahatan luar biasa. Penanganan terhadap kejahatan luar biasa ini memerlukan upaya yang luar biasa pula. Upaya luar biasa yang dimaksud adalah tidak lagi memfokuskan pemberantasan korupsi pada pemidanaan terhadap koruptor, akan tetapi dengan mengejar dan menyita aset-aset ilegal hasil korupsi.

Abstract

The principle of formal legality promoted by the WvS-NI translation of the Indonesian Criminal Code (Old Criminal Code) has laid down statutory regulations (written law) as the only basis for implementing criminal law provisions. The principle of formal legality has closed the existence of the living law of Indonesian society which has existed since the Indonesian state was still in the form of kingdoms. The purpose of writing this article is to analyze the integration of living law into criminal law in updating the principle of legality, which was originally only a formal legality principle, but now also includes a material legality principle. This article was written using a normative legal research method with a conceptual approach. The result of this research is that the integration of living law as a source of criminal law to implement criminal law provisions is a positive step to provide space for the application of the original laws of the Indonesian nation. However, in its implementation, comprehensive regulations are needed, especially regarding the institutionalization of living law because its nature is local, while criminal law is national. Apart from that, there is also a need for a common perception regarding the measures of justice so as to create legal certainty regarding the application of living law in criminal law.

Abstract

The Draft State Bill Law has been a topic of discussion since the early reform era. However, this draft law often generates polemics among the press and democracy activists because it is considered to reverse the pace of reform that has been fought for. In the end, the House of Representatives decided to include this State Secrets Bill in the National Legislation Program (Prolegnas). This bill will be a legal regime for state secrets which will be a guideline for all State Institutions in matters of state secrecy which includes documents, objects, property and so on. This bill is also being pushed on the grounds that currently Indonesia does not have definite regulations regarding the protection and safeguarding of state secrets. Thus, it is hoped that this bill will be a breath of fresh air for the protection of state secrets in order to ward off threats to state defense and security. However, this bill faces challenges in being able to balance the public's right to access information and openness as stipulated in Article 28F of the 1945 Constitution of the Republic of Indonesia.

Abstract

The development of criminal acts that occur in a country moves with the development of social civilization. One of the criminal acts in the economic sector that has arisen as a result of modern civilization is the crime of money laundering, namely the concealment of assets resulting from a crime so that it appears as if they originate from a legal source. This article will examine the asset tracing strategy which is an effective step in tackling money laundering crimes. The approach used in discussing the problem is a case study. The results of the research in this article are that efforts to trace assets with a fund tracking process need to be developed and adopt existing technological developments. This is to ensure the effectiveness of handling money laundering in Indonesia.

Abstract

Experts are parties who play a very important role in obtaining material truth in a criminal case. Law enforcement officers certainly need to get help from experts in fields of knowledge they don't understand. One of them is in determining the mental condition of a defendant who is suspected of committing a criminal act in relation to his ability to take responsibility for his actions. The problem that often arises is when the psychiatrist's information may contain inaccuracies, which raises concerns that the expert could be blamed under criminal law for the information he provides. This article was written using a normative legal research method with a statutory approach. The results of this research are that psychiatric experts (psychiatrists) have received protection in Law Number 13 of 2006 concerning Protection of Witnesses and Victims, so that in providing information, experts cannot be blamed because the expert has been bound by an oath of office and has expertise based on his science.
