Abstract

Fiqh as a product of Islamic law must always be up to date to become a religious solution for society. This fact requires scholars to have high creativity in doing ijtihad so that actualizing of Islamic law can be realized perfectly in today's contemporary era. One of the scholars who focus on the actualization of Islamic law is Yūsuf al-Qaraḍāwī. His fatwas, which contain actualizations of Islamic law, are fatwas on Muslim minority issues (fiqh al-aqalliyāt). This study highlights the role of Islamic legal maxims (al-qawāid al-fiqhiyyah) in al-Qaraḍāwī's fatwa on fiqh al-aqalliyāt. The data comes from books and articles related to the theme. This research proves that Islamic legal maxims have a dominant role in the methodology of al-Qaraḍāwī’s ijtihad. In establishing his fatwa, al-Qaraḍāwī based the argument on the opinion of the islamic scholars in accordance to the basic values of fiqh principles. Therefore, his fatwa can be an actual solution for minority Muslim communities in Western countries. Thus, Islamic legal maxims (al-qawāid al-fiqhiyyah) play a role in controlling and systematizing the laws around fiqh al-‘aqalliyāt so that it always leads to convenience and avoids difficulties.

Abstract

Ihya’ ‘Ulum al-Din is one of the most studied books in the pesantren, especially in the pesantren of Sidogiri. The main reason is because the book has been considered as a book of sufism with high values of moderation. This study aims to identify the moderation values of da'wah in the Ihya’ and examine its effect on the da'wah paradigm of pesantren of Sidogiri. This study uses Gadamer's hermeneutic approach to connect the theory in the ihya' and the reality of da'wah at the pesantren of Sidogiri. Data obtained through documentation, interviews and observations. This study shows that the concept of da'wah in the Ihya’  is full of high values of religious moderation. This can be understood from the concept of amr ma'ruf nahi munkar which al-Ghazali explained in his work. This research also shows that the moderation value in the Ihya’ affects the da’wah paradigm of pesantren of Sidogiri which is moderate and full of persuasive approaches.

Abstract

This article aims to discover the concept of environmental ethics in the book Tafsir Pelestarian Lingkungan Hidup compiled by the Team of Lajnah Pentashihan Al-Qur’an, Ministry of Religion of the Republic of Indonesia. The article is a qualitative research with descriptive-analytical method. This article uses the theory of environmental ethics developed by Sonny Keraf as the basis for the analysis. This study shows that the interpretation of Tim Lajnah Pentashihan Al-Qur’an on environmental issues in Tafsir Pelestarian Lingkungan Hidup tends to put the basis of life to include all elements of nature, both human and others. Conservation of mountains, seas, water, animals and plants cannot be ignored just for the human necessity only. In exploring nature, humans are bound by the ethics that have been stipulated in the Qur'an, including learning from every natural disaster, not being excessive and extravagant, and a healthy life style. This paper shows that the environmental ethics discussed in Tafsir Pelestarian Lingkungan Hidup is tend towards an intermediate environmental ethic that is biocentric, strikethrough a view that makes all elements in the natural ecosystem as the basis of life.

Abstract

Abstract: The authority to issue fatwa in Indonesia sometimes puts Indonesia Ulema Council (MUI) under the microscope, where society criticize some of MUI’s fatwas.  One of fatwas that raise pros and cons in society is religious freedom matters. Their fatwas on deviant groups and sects are widely regarded as a threat to religious freedom in Indonesia. Based on this explanation, this study aims to discuss the suitability of the legal reasoning in the MUI fatwa regarding the digression of religious pluralism with human rights instruments. This MUI fatwa will be studied using the theory of religious freedom instruments of David Llewellyn, which human rights enforcement agencies have widely used. This study has two conclusions. Firstly, most of the MUI legal reasoning are based on the classic books of Quranic and hadith interpretation. Secondly, the MUI fatwa on religious pluralism is intended to maintain public order, which is one of permissible restriction on degradable-human rights.Abstrak: Sepak terjang Majelis Ulama Indonesia (MUI) menjadi suatu yang menarik untuk dikaji, khususnya terkait argumen dan peran fatwa-fatwanya dalam dinamika hukum di Indonesia. Hal ini penting untuk dikaji karena MUI telah menjadi lembaga yang dianggap paling otoritatif dalam menerbitkan sebuah fatwa di Indonesia. Meski demikian, fatwa-fatwa MUI sering menimbulkan pro dan kontra di tengah masyarakat, khususnya dalam persoalan kebebasan beragama. Fatwa-fatwanya tentang kelompok dan aliran menyimpang banyak dianggap sebagai ancaman atas kebebasan beragama di Indonesia. Atas dasar penjelasan di atas, penelitian ini bertujuan untuk membahas kesesuaian argumen dalam fatwa MUI tentang kesesatan paham pluralisme agama dengan instrumen-instrumen hak asasi manusia. Fatwa MUI tersebut akan dikaji menggunakan teori instrumen kebebasan beragama David Llewellyn yang telah banyak digunakan oleh lembaga-lembaga penegak HAM. Penelitian ini menggunakan pendekatan kualitatif dengan dua hasil penelitian. hasil penelitian pertama menunjukkan mayoritas argumen MUI dalam fatwanya tentang pluralisme agama bersifat normatif, yakni berupa ayat-ayat al-Quran dan hadis dengan berlandaskan kepada penafsiran-penafsiran para ulama klasik. Kedua menunjukkan bahwa fatwa MUI tentang pluralisme agama ini juga menggunakan argumen hak asasi manusia. Argumen tersebut dapat dipahami dari alasan menjaga ketertiban umum yang menjadi dasar keputusan fatwa MUI tentang kesesatan pluralisme agama.

Abstract

The objectives set in this study are: (1) to find out how the WKS Curriculum strategy is in Effective Learning through Student Grouping Teams at SMP Plus Darussalam Blokagung for the 2021/2022 academic year; (2) to find out what are the inhibiting factors for the implementation of the Student Grouping Team learning model at SMP Plus Darussalam Blokagung for the 2021/2022 academic year. This research method uses descriptive qualitative. Collecting data through interviews, observation, and documentation. There are four research subjects, namely the principal, WKS curriculum, one subject teacher, and two students. Data analysis using SWOT analysis. The data validity technique uses triangulation. Research results: The strategies obtained through SWOT analysis are: (1) With good communication students can solve problems quickly, team grouping discipline, mutual cooperation, and responsibility can provide maximum results in groups. (2) There is socialization from the curriculum so that teachers pay more attention to students when grouping activities take place, there is direct guidance from teachers to students who are not serious in team grouping activities. (3) With the existence of a group leader, it is hoped that they can be responsible for whether or not their group members can, each group is expected to create a comfortable atmosphere in the group so that teaching and learning can run smoothly. (4) Maintaining an attitude of responsibility, mutual cooperation, and discipline in team grouping, maintaining good communication between students in team grouping groups.

Abstract

The lives of fishermen are said to have a profound influence on the lives of coastal towns. Their attitude toward marine resources effects their theological perspective as well. This fact is supported by Kiai Anwar's book ‘Aysh al-Baḥr, which discusses the legal position of consuming numerous aquatic animals. This article seeks to trace the book ‘Aysh al-Baḥr's understanding of culinary fiqh. As an analytical tool, this paper employs a normative approach and the notion of Islamic epistemology pioneered by al-Jābirī and Mulyadhi. This article demonstrates how the epistemology of culinary fiqh in ‘Aysh al-Baḥr employs an empirical approach to determining the legal status of ingesting animals by viewing and direct observing them. Kiai Anwar's background as a fisherman gives him an edge in developing normative and empirical reasons for marine animal laws. This conclusion demonstrates that coastal cultures have an extensive understanding of aquatic animal environments. Abstract

Indonesian Council of ‘Ulama (MUI) has been issuing fatwas since its establishment in 1975. Among all the fatwas, there is the fatwa on Ahmadiyah group that aims to keep the orthodoxy of Sunni away from deviant theology. This study aims to examine the role of MUI in its fatwa on Ahmadiyah from the perspective of Islamic law and human rights. This research is qualitative research with a pattern of normative research through an in-depth study of the arguments of MUI. This fatwa on the Ahmadiyah group is based on two arguments. The first argument is Islamic law based on the Quran, hadith, and ijma’ concerning the exegesis and opinion of classical scholars. The second argument is the restrictions on human rights by arguing that the Ahmadiyah group can be a threat to public order. MUI assumes that every group or theology that is declared as “deviant” and incompatible with Quran, hadith, and ijma‘ is considered as a threat to public order. In other words, MUI still makes the classic literature as a reference for his fatwas, but at the same time, he tries to understand the public order as the principles of human rights. This position shows that MUI has a dual role, namely as the agent of modernization and conservatism in human rights discourse.

Abstract

Until now, the religious views of the Indonesian Government, known as official Islam, tend to be masculine and patriarchal in determining laws. The masculinity of official Islam can easily be found in some regulations in Indonesia. The establishment of the Indonesian Congress of Women Islamic Scholars (Kongres Ulama Perempuan Indonesia, KUPI) has introduced a new perspective on gender amid the dominance of official Islamic masculinity. This article focuses on the role and position of KUPI amid the dominance of official Islamic masculinity in Indonesia. Through content analysis and Charles Peirce's theory of knowledge construction, the author found that KUPI has successfully become a center for reproducing female authority in Islamic law. This is achieved by reinterpreting several government rules and policies that tend to be masculine and disadvantageous to women. The success of KUPI as a center for the reproduction of the authority of women Islamic scholars plays a role in revising official Islam. KUPI accomplishes this by offering a new paradigm that embodies the values of justice and gender equality.  Abstrak: Pandangan-pandangan keagamaan Pemerintah Indonesia yang dikenal dengan istilah official Islam selama ini masih cenderung maskulin dan patriarki dalam menetapkan hukum. Maskulinitas official Islam dapat dengan mudah ditemukan dalam sebagian aturan di Indonesia. Penyelenggaraan Kongres Ulama Perempuan Indonesia (KUPI)  memunculkan perspektif baru terkait gender di tengah dominannya maskulinitas Official Islam tersebut. Artikel ini menganalis peran dan posisi KUPI di tengah dominannya maskulinitas Official Islam di Indonesia. Melalui pendekatan content analysis dan teori konstruksi pengetahuan Charles Peirce, penulis berargumen bahwa KUPI telah berhasil menjadi pusat reproduksi otoritas ulama perempuan di Indonesia. Hal ini dicapai dengan melakukan penafsiran ulang terhadap beberapa aturan dan kebijakan pemerintah yang cenderung maskulin dan merugikan perempuan. Keberhasilan KUPI menjadi pusat reproduksi otoritas ulama perempuan ini berperan dalam merevisi Official Islam tersebut. Hal ini dilakukan oleh KUPI dengan menawarkan paradigma baru yang lebih mengandung nilai-nilai keadilan dan keseteraan gender.

Abstract

Abstract: Due to its significant impact on the environment, gold mining is often a particular concern. This paper examines the effect of granting gold mining permits on Mount Tumpak Pitu, Banyuwangi Regency, East Java, from the perspective of social fiqh developed by Sahal Mahfudh. Social fiqh prioritizes benefits framed in maqâshid al-syarî'ah, with indicators of hifz al-dîn (existence of religion), al-nafs (salvation of the soul), al-'aql (health of the mind), al-mâl (safety of property), al-nasl (safety of honor) and al-bî'ah (environmental sustainability). This research used the normative juridical approach and qualitatively analyzed data collected through literature and field studies. The research results show that granting gold mining permits was not accompanied by adequate supervision from the authority. This gives rise to mining practices that are not environmentally friendly and do not fulfill the basic principles of environmental ethics in Sahal Mahfudh’s social fiqh.Abstrak: Penambangan emas seringkali menjadi perhatian khusus mengingat aktvitas tersebut memiliki dampak yang signifikan terhadap lingkungan. Tulisan ini mengkaji dampak pemberian izin penambangan emas di Gunung Tumpak Pitu, Kabupaten Banyuwangi, Jawa Timur; dari perspektif fikih sosial yang dikembangkan oleh KH Sahal Mahfudh. Fikih sosial mengedepankan kemaslahatan yang dibingkai dalam maqâshid al-syarî'ah, dengan indikator hifz al-dîn (eksistensi agama), al-nafs (keselamatan jiwa), al-‘aql (kesehatan akal), al-mâl (keselamatan harta), al-nasl (keselataman kehormatan) dan al-bî’ah (kelestarian lingkungan). Dengan pendekatan juridis normatif terhadap data-data yang dikumpulkan baik melalui studi kepustakaan maupun lapangan dan dianalisis secara kualitatif, hasil penelitian menunjukkan bahwa pemberian izin penambangan emas yang diberikan tidak diiringi dengan pengawasan yang memadai. Hal tersebut menimbulkan praktek pertambangan yang tidak ramah lingkungan dan tidak memenuhi prinsip dasar etika lingkungan dalam fikih sosial KH. Sahal Mahfudh.

Abstract

Fatwās (Islamic legal opinions) are often perceived as having limited influence on public policy, particularly in environmental and mining-related issues. Existing research suggests that despite opposition from ‘ulamā’ (Islamic scholars) and local communities, mining operations often persist due to strong political and economic backing. However, the fatwā issued by the Jember Branch Board of Nahdlatul Ulama (PCNU Jember)—which declared gold mining in Blok Silo impermissible (ḥarām)—produced a notably different outcome. This fatwā not only successfully halted mining activities but also played a decisive role in the revocation of government-issued mining permits. This study aims to analyze the mechanisms through which the PCNU Jember fatwā influenced public policy in the gold mining conflict in Blok Silo. Employing a socio-legal approach and qualitative methods, the research incorporates in-depth interviews with five key informants, including PCNU Jember officials and local community leaders, alongside document and media analysis from relevant sources. Drawing on Pierre Bourdieu’s theories of field and capital, this study argues that the effectiveness of the PCNU Jember fatwā was not solely rooted in its fiqh-based (Islamic jurisprudence) arguments but was reinforced by the symbolic and social capital held by NU scholars. The strong religious authority of ‘ulamā’ within Silo’s social structure, combined with PCNU Jember’s political connections with the local government, played a crucial role in ensuring the fatwā’s policy impact. This article argues that religious fatwās can function as potent instruments of environmental advocacy, particularly in societies where ‘ulamā’ continue to exert significant influence over political and social spheres. [Fatwa keagamaan sering kali dianggap tidak memiliki pengaruh signifikan dalam kebijakan publik, terutama dalam isu lingkungan dan pertambangan. Studi-studi terdahulu menunjukkan bahwa meskipun terdapat perlawanan dari ulama dan masyarakat, aktivitas pertambangan tetap berlangsung karena kuatnya dukungan politik dan ekonomi. Namun, fatwa Pengurus Cabang Nahdlatul Ulama (PCNU) Jember tentang keharaman pertambangan emas di Blok Silo menunjukkan hasil yang berbeda. Fatwa ini tidak hanya berhasil menghentikan aktivitas pertambangan, tetapi juga mendorong pencabutan izin usaha pertambangan yang telah dikeluarkan oleh pemerintah. Artikel ini bertujuan untuk menganalisis bagaimana fatwa PCNU Jember dapat memengaruhi kebijakan publik dalam konflik pertambangan emas di Blok Silo. Penelitian ini menggunakan pendekatan sosio-legal dengan metode kualitatif, yang melibatkan wawancara mendalam dengan lima informan, termasuk pengurus PCNU Jember dan tokoh masyarakat setempat, serta analisis dokumen dan berita dari sumber-sumber yang relevan. Dengan menggunakan teori field and capital dari Pierre Bourdieu, artikel ini menemukan bahwa keberhasilan fatwa PCNU Jember tidak hanya bertumpu pada argumentasi fikih dalam teks fatwa, tetapi juga pada modal simbolik dan sosial yang dimiliki oleh ulama NU. Otoritas keagamaan ulama yang tinggi dalam struktur sosial masyarakat Silo, serta hubungan politik PCNU Jember dengan pemerintah daerah, menjadi faktor utama yang memungkinkan fatwa tersebut berpengaruh terhadap kebijakan publik.
