Abstract

Penelitian ini bertujuan untuk mendeskripsikan tingkat toleransi beragama siswa. Penelitian ini menggunakan pendekatan kuantitatif dengan metode pengumpulan data melalui angket yang disebarkan melalui Google Formulir. Penelitian ini menyimpulkan bahwa tingkat toleransi beragama siswa MA Al Mujahidin berada pada kategori “toleran” yaitu dengan skor 78,18% dari aspek saling menerima, saling menghormati, dan saling menghargai. Sementara itu, masih ada sebagian kecil siswa yang berada pada sikap “kurang toleran”, yaitu 21,81%. Meskipun angka ini kecil, namun perlu menjadi perhatian pihak madrasah untuk menjaga keharmonisan antar umat beragama dan meminimalisir terjadinya intoleransi di masyarakat.

Abstract

Efforts to prevent gender-based violence will progress slowly without involving men. Socialization and education tend to be targeted towards women’s groups, with few including men as subjects in the anti-violence education process. This article discusses several important lessons learned from the mentoring process of Marriage Registrar Officials at the Office of Religious Affairs in East Lampung, Indonesia, by the Rahima Association. The study is the result of observations on the mentoring process of Marriage Registrar Officials who have internalized the values of justice and reciprocity in family relations. The research data are supported by interviews, focus group discussions, and documentation. This article argues that the involvement of male religious figures in preventing family violence is essential for two reasons. First, in textual societies, male ulama have a strategic role in reproducing more egalitarian and just knowledge. Second, the process of building gender-just awareness requires authoritative actors in the process of building knowledge from shared experience to be more legitimate. The article also explains the theoretical foundations of the successful mentoring approach that has transformed the outlook of male Marriage Registrar Officials who have the drive to effect change in Muslim society regarding equal and just family relations through their duties and functions.

Abstract

This article discusses the regulation of polygamy in Law No. 1 of 1974 and its derivative rules, as well as the Compilation of Islamic Law with an analysis of Islamic legal philosophy/maqashid al-shari’ah. This research is based on the legitimacy of polygamy as stated in Law Number 1 of 1974 concerning Marriage, article 3, paragraph 2. Polygamy also has rules that require the husband to obtain formal permission from the wife through a court process. Why do the Marriage Regulations regulate this? This research is based on a qualitative descriptive literature review. The method of analysis employed was content analysis, which involved creating an inventory of Indonesian family law norms and analyzing them using the maqashid al-shari’ah theory. This study finds that the regulation of polygamy in Indonesia is carried out to protect women's rights and children's rights. Furthermore, the rule aims to build a happy, peaceful, and prosperous family in the long run (sakinah, mawaddah, wa rahmah). This is in accordance with maqashid al-shari’ah, particularly in terms of soul preservation and descendent preservation.

Abstract

Female justice seekers are vulnerable and find it difficult to access justice due to psychological factors (fear, inferiority, nervousness), financial problems, limited access to facilities and resources, limited knowledge in the legal field, and negative stigma about going to court. In these circumstances, East Lampung district may turn to the pamong desa (village officials). Unfortunately, village officials sometimes act as justice brokers, preventing women from further accessing justice. This paper refers to how the safety net was built and strengthened to protect justice seekers from the clutches of justice brokers. Therefore, this paper uses qualitative research with a socio-legal approach. Data was collected through conversation and focused group discussion among village officials, religious counselors, the Office of Religious Affairs (KUA), and Rumah Perempuan dan Anak (RPA) Lampung Timur to strengthen the position of female justice seekers. The data was analyzed using feminist legal studies, access to justice, and mediation as a framework. As a finding, female justice seekers are vulnerable and have limited access. Therefore, support should be provided by close community assets, namely religious counselors and village officials. These two parties need to be strengthened in terms of understanding the importance of the perspective of vulnerable women as legal subjects, prioritizing the interests of victims, the urgency of resolving both litigious and non-litigious cases, strengthening close, trusted networks, consolidating and distributing roles among community assets, strengthening mediation and advocacy skills, strengthening the role of the KUA and its assets, strengthening preventative functions, and strengthening the economic family based on the uniqueness of the village.

Abstract

A solid society based on nationalism is absolutely necessary for the Indonesian nation during the Pandemic. However, in reality there are still internal conflicts due to excessive religious practices (tatharruf) which are based on the verses of the Qur'an. The forms of tatharruf include the existence of a discourse on the basis of the state, acts of intolerance, and narrow interpretations of religious texts. This is certainly an obstacle in efforts to deal with the impact of the pandemic. Surah Al-Baqarah [2]: 143 confirms that the position of Islam is to be in the middle (wasatiyah), not to overdo it and not to underestimate it. This study will examine the reconstruction of verses that have the potential to be taharruf with the Islamic perspective of wasatiyah in the pandemic era. This research is the result of a descriptive qualitative literature review with an inductive approach. The results of the study show that wasatiyah Islam as an interpretive strategy is reflected in 'moderate' theology in the al-Asy'ariyyah doctrine which emphasizes two things, namely: a contextual approach by considering the context of space and time; and pay attention to aspects of benefit. As a tatharruf solution, Islam wasatiyah as an interpretation strategy provides the following views: On the issue of the basic discourse of the state, the caliphate is not a solution that can be applied in viewing the issue of government failure during a pandemic because it is prone to causing conflict in a multicultural society. On the issue of intolerance, Wasatiyah Islam recognizes the right for adherents of other religions to allow them to choose and carry out the guidance of their respective religions. Then on the issue of narrow religious interpretations about Covid-19, it is important for us to anticipate fear by considering the benefit, as stated in the MUI Fatwa.

Abstract

Until now, the religious views of the Indonesian Government, known as official Islam, tend to be masculine and patriarchal in determining laws. The masculinity of official Islam can easily be found in some regulations in Indonesia. The establishment of the Indonesian Congress of Women Islamic Scholars (Kongres Ulama Perempuan Indonesia, KUPI) has introduced a new perspective on gender amid the dominance of official Islamic masculinity. This article focuses on the role and position of KUPI amid the dominance of official Islamic masculinity in Indonesia. Through content analysis and Charles Peirce's theory of knowledge construction, the author found that KUPI has successfully become a center for reproducing female authority in Islamic law. This is achieved by reinterpreting several government rules and policies that tend to be masculine and disadvantageous to women. The success of KUPI as a center for the reproduction of the authority of women Islamic scholars plays a role in revising official Islam. KUPI accomplishes this by offering a new paradigm that embodies the values of justice and gender equality.  Abstrak: Pandangan-pandangan keagamaan Pemerintah Indonesia yang dikenal dengan istilah official Islam selama ini masih cenderung maskulin dan patriarki dalam menetapkan hukum. Maskulinitas official Islam dapat dengan mudah ditemukan dalam sebagian aturan di Indonesia. Penyelenggaraan Kongres Ulama Perempuan Indonesia (KUPI)  memunculkan perspektif baru terkait gender di tengah dominannya maskulinitas Official Islam tersebut. Artikel ini menganalis peran dan posisi KUPI di tengah dominannya maskulinitas Official Islam di Indonesia. Melalui pendekatan content analysis dan teori konstruksi pengetahuan Charles Peirce, penulis berargumen bahwa KUPI telah berhasil menjadi pusat reproduksi otoritas ulama perempuan di Indonesia. Hal ini dicapai dengan melakukan penafsiran ulang terhadap beberapa aturan dan kebijakan pemerintah yang cenderung maskulin dan merugikan perempuan. Keberhasilan KUPI menjadi pusat reproduksi otoritas ulama perempuan ini berperan dalam merevisi Official Islam tersebut. Hal ini dilakukan oleh KUPI dengan menawarkan paradigma baru yang lebih mengandung nilai-nilai keadilan dan keseteraan gender.

Abstract

Lampung’s patriarchal customary law faces severe challenges from the millennial generation, who constitute more than 29% of the total population of Lampung. This challenge is based on the fundamental character of the millennial generation, who are open-minded and obtain the opportunity of having an interethnic marriage. This article maps the dialectic of the public sphere vs. private sphere in millennial families in the Lampung customary law community and how women’s strategies survive the confines of patriarchy. This article explored data from a millennial married couple who live in four districts/cities in Lampung using a qualitative, socio-legal study approach standing with ten principles of marriage on happy family (SMART)’s Khoiruddin Nasution. The findings: The boundaries between the public and the private were no longer tight because husband and wife could work collaboratively, even though there were some challenges due to the dominance of patriarchal mindset in extended families, which was sometimes affirmed, even enjoyed by the husband. However, the subconscious of the millennial family was still patriarchal even though it no longer applied strictly at the practical level. Meanwhile, women survived passively by taking advantage of the economic conditions of their families or changing environments. In addition, the active strategy is to improve formal education; live separately from the extended family; have a stable job (before marriage), and manage working time

Abstract

This paper discusses the problem of buying and selling brown sugar in Metro City, which in practice has several exciting things to study related to Islamic law. First, weighing brown sugar together with wooden crates that have different weights. Second, weighing brown sugar using samples or samples. This paper focuses on discussing how Islamic law views the practice of considering brown sugar in Metro City. This phenomenon is studied using qualitative research and a case study approach. The data were obtained using field observation techniques, interviews with traders as sources, then analyzed through three stages: data reduction, data presentation, and conclusion drawing. The results showed that the practice of buying and selling brown sugar in the Metro City Market fulfills the pillars and requirements of buying and selling in Islamic law. Quantification of the objects of sale and purchase in packages at Metro Market based on Islamic Economic Law (HESy) refers to the concept of ‘urf (traditional customs). This practice is included in ‘urf hasan because it is based on convenience, trust, and volunteerism between the seller and the buyer. Thus, the applicable law of weighing brown sugar in Metro City is valid (shahih).

Abstract

Cervical cancer is the most common cause of death among gynaecological neoplasms. Management of advanced cervical cancer currently has not been able to improve the prognosis. Standard intervention therapy, chemotherapy and radiotherapy, as well as the emerging pain could lead to psychological stress till depression, thus reduce patients' quality of life. CBT for psychological stress and depression is expected to improve the fruitfulness of standard therapy. Serotonin is a neurotransmitter which plays a role in the patophysiology of depression. The aim of this study is to analyze the effect of cognitive behavioral therapy on serotonin level, depression score and quality of life in advanced cervical cancer patient with experimental quasi pre and post test design methods. The samples are 15 subjects in both intervention and control groups. Intervention group was given CBT and standard therapy, while control group was given standard therapy only. Study was held in Department of Obstetric and Gynecologic Dr. Moewardi Hospital Surakarta and Prodia Laboratory, in January to March 2015. Independent variable was advanced cervical cancer patients underwent CBT intervention and dependent variables were serotonin level, depression score and quality of life score. The result, serotonin level and quality of life scores were higher after intervention compared with control, (219.43±33,42 vs 89.57±23.23) and (85.13±14.62 vs 41.86±7.24), respectively. Depression score was lower after intervention than without CBT intervention (11.20±4.94 vs 17.00±4.86) and statistically significant (p < 0.05). So, there were effects of cognitive behavioural therapy on serotonin level, depression score and quality of life score in cervical cancer patients and were statistically significant.

Abstract

Penelitian ini bertujuan untuk menganalisis Pola Pembiasaan Guru dalam Pembelajaran Tahfizd al Qur’an di Ponpes Al Mujahidin. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif dengan pendekatan deskriptif. Rumusan masalah dalam penelitian ini yaitu: Pertama, Bagaimanakah pola pembiasaan Guru dalam pembelajaran al Qur’an di pondok pesantren Al-Mujahidin? Kedua, Apa sajakah yang menjadi factor pendorong pada pola pembiasaan Guru dalam pembelajaran al Qur’an di pondok pesantren Al-Mujahidin? Ketiga, Bagaimanakah cara mengatasi hambatan yang dihadapi dalam melaksanakan pola pembiasaan Guru dalam pembelajaran al Qur’an di pondok pesantren Al-Mujahidin? Teknik pengumpulan data dalam penelitian ini adalah observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukan bahwa pola pembiasaan yang diterapkan guru dalam pembelajaran tahfiz di pondok pesantren Al-Mujahidin menggunakan beberapa tahapan, yaitu tahap tahsin, tahfidz dan talaqqi. Faktor pendorong dari pola pembiasaan guru dalam pembelajaran tahfidz al Qur’an di pondok pesantren al Mujahidin. Dan Cara mengatasi hambatan yang dihadapi dalam melaksanakan pola pembiasaan Guru dalam pembelajaran al Qur’an di pondok pesantren al Mujahidin yaitu Kurangnya alokasi menjadi hal yang menghambat dari proses berjalannya pembiasaan pembelajaran tahfizh santri di pesantren al Mujahidin ini. Sebagai langkah untuk mengatasi hambatan tersebut adalah, mencari solusi dari permasalahan tersebut telah dirumuskan bersama oleh pihak sekolah. Hasil akhir dari kegiatan ini perlu dikaji ulang sejauh mana tingkat keberhasilan itu membawa dampak bagi proses pembelajaran di pondok pesantren al Mujahidin dalam jangka panjang.
