Abstract

This study aims to analyze the legal provisions on marital violence with a focus on the implementation of the Law on the Protection of Women and Children. The problem analysis highlights the shortcomings in the implementation of the law that result in a lack of protection for victims of domestic violence. In addition, the challenges in law enforcement against perpetrators of marital violence are also discussed. The research method used is the normative legal research method, which analyzes various laws and regulations, official documents, and related court decisions. The analysis results show that although there is already a law that regulates the protection of women and children, namely the PPA Law. In the implementation of the PPA Law, there are efforts made to protect women and children from marital violence. These steps include case identification, handling reports, investigation processes, prosecution of perpetrators of violence, and protection and rehabilitation for victims. Further efforts are needed to strengthen law enforcement and increase public awareness of the rights of women and children in the context of marriage.

Abstract

Studi ini meneliti dampak Usaha Mikro, Kecil, dan Menengah (UMKM) terhadap perekonomian Indonesia, dengan fokus pada Wahyu Miniatur, sebuah usaha kerajinan tangan yang unik yang didirikan pada tahun 2022. Mengingat sekitar 90% bisnis di Indonesia diklasifikasikan sebagai UMKM, yang secara kolektif berkontribusi sekitar 60% terhadap perekonomian nasional, memahami dinamika mereka sangat penting untuk pembangunan ekonomi. Penelitian ini menggunakan metodologi studi kasus kualitatif, melibatkan pemilik Wahyu Miniatur dan menganalisis proses produksi dan strategi pemasaran yang digunakan dalam konteks Desa Kalimalang. Temuan penelitian mengungkapkan bahwa Wahyu Miniatur menonjol karena komitmennya terhadap kualitas pengerjaan, praktik berkelanjutan melalui penggunaan bahan daur ulang, dan strategi branding dan pemasaran yang efektif, terutama melalui media sosial dan platform e-commerce. Implikasi dari penelitian ini menunjukkan bahwa UMKM seperti Wahyu Miniatur memainkan peran penting dalam pengembangan ekonomi lokal dan pelestarian budaya. Dengan mengintegrasikan keterampilan tradisional dengan praktik-praktik inovatif, bisnis-bisnis ini dapat berkembang di pasar yang kompetitif dan berkontribusi pada ekonomi yang lebih luas. Kasus ini dapat menjadi contoh bagi pengusaha lokal lainnya yang ingin meningkatkan kreativitas dan keberlanjutan dalam usaha bisnis mereka.

Abstract

Law No. 18 of 2003 explains that someone who wants to be an advocate must take advocate professional education. This professional education is based on the enforcement of justice and pursues to strengthen the Rule of Law principles. This study offers the importance of spirituality in advocate education, in order to create an officium nobile who puts justice for the marginal community over the injustice rules. This research method uses a non-doctrinal qualitative approach based on law implementation in society, combined with a philosophical system related to spirituality that integrates science and religion. This study concludes that advocate education with a spiritual dimension is an effort to uphold the advocate profession as an official representative, prioritizing justice access in the community rather than profit, especially in bribery or corruption.

Abstract

The practice of gratification has become commonplace in the corporate environment. A Gratification Control Unit was formed within PT PJB UBJOM Pacitan to prevent gratification practices. With the establishment of the Gratification Control Unit, it is hoped that it can prevent and control gratification practices at PT PJB UBJOM Pacitan which incidentally is one of the subsidiaries of the State Electricity Company, which is part of the State-Owned Enterprises. This study aims to explain the basis of gratification control within the company and how gratification control is practised at PT PJB UBJOM Pacitan. This study uses a normative and empirical juridical approach, which is the relationship between statutory provisions and the implementation mechanism in the company. Prevention and control efforts have been carried out by establishing a code of conduct between employees and stakeholders inside and outside the company. The field that plays a role in this gratification action is MMR (Quality and Risk Management), with socialization among parties within the company.

Abstract

The population level of citizens must be balanced with the high level of welfare of the Indonesian population. Every citizen has the right to obtain it by allowing it to grow and develop optimally, physically, mentally, socially and as a personality. One of the efforts is to protect against violence, in this case, sexual violence. This study aims to reveal the impact caused by victims of sexual abuse. The results of this study explain that the psychological impact of sexual harassment is quite a lot, such as somatization, nervous pain, chronic pain, changes in sexual behaviour, schooling, learning problems, and problems including the use of illegal drugs, self-harm, cruelty to animals, human crime. Grown up and committed suicide. Therefore, the state's role is to provide legal protection to create a sense of security and legal guarantees for the obscenity that befalls them.

Abstract

According to the post-positivist figures, basically post-positivists exist to dissect the mistakes made by positivists. Positive law based on objective, empirical and rational nature and supported by systematic, procedural and formal models has become a strong mainstream in Indonesia. The main stream makes legal science feel narrow and underdeveloped. This creates legal problems in society. On the other hand, there are new ideas that carry post-positivism in the field of law with a subjective, abstract and irrational paradigm and supported by theology and God. To overcome the legal problems mentioned above, a comparative dialectic of law between positivistic and post-positivistic law is needed so that it can form a new paradigm in law with an objective-subjective, empirical-abstract, rational-irrational nature and supported by wise systematic, procedural and formal patterns..

Abstract

ABSTRACT Purpose of Study: This research aimed at analyzing Supreme Court Decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985 concerning cumulative lawsuits and tort according to the judge's legal reasoning.  Methodology: This is library research using the normative juridical method. The approach used was the statutory approach. The statutory approach was carried out by analyzing Supreme Court Decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985 in the context of the cumulative lawsuit and tort section. Result: This research found that even though unlawful acts and contracts are conventionally separated, there are still issues regarding overlapping understandings of the concepts of tort, cumulative lawsuit, and default in law. For example, there is an act by one party that, on the one hand, can be classified as an unlawful act, but it also has a contractual element. Similarly, one party’s actions have contractual consequences for the other party, but they can also result in liability based on tort. This condition causes several parties to accumulate lawsuits for unlawful acts and defaults at the same time. Supreme Court accepted the cumulative lawsuit in decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985, indicating that it does not violate procedural law. Applications of this study:  This research is useful for analyzing Supreme Court Decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985. These Supreme Court decisions have a ratio decidendi or jurisprudence that a cumulative lawsuit is permitted and it does not violate procedural law. Novelty: There are no previous researchers who conducted a legal analysis of the Supreme Court's decision, even though the Supreme Court is the jurisprudence in cases or legal issues of cumulative lawsuits and tort.   Keywords: Cumulation, Against the Law, Default, Decision, Ratio Decidendi  ABSTRAK  Tujuan: Penelitian ini bertujuan untuk menganalisis Putusan Mahkamah Agung No. 575 K/Pdt/1983 dan Putusan Mahkamah Agung No. 2686/Pdt/1985 tentang gugatan kumulatif dan perbuatan melawan hukum menurut penalaran hukum hakim.  Metodologi: Penelitian kepustakaan ini menggunakan metode yuridis normatif. Pendekatan yang digunakan adalah pendekatan Perundang-undangan. Pendekatan perundang-undangan dilakukan dengan menganalisis Putusan MA No. 575 K/Pdt/1983 dan Putusan MA No. 2686/Pdt/1985 dalam konteks gugatan kumulatif dan pasal perbuatan melawan hukum.  Hasil: Penelitian ini menemukan bahwa meskipun perbuatan melawan hukum dan perjanjian dipisahkan secara konvensional, masih terdapat permasalahan mengenai tumpang tindih pemahaman tentang konsep gugatan, gugatan kumulatif, dan wanprestasi dalam hukum. Misalnya, ada perbuatan salah satu pihak yang di satu pihak dapat digolongkan sebagai perbuatan melawan hukum, tetapi juga mengandung unsur perjanjian. Demikian pula, tindakan satu pihak memiliki konsekuensi kontraktual bagi pihak lain, tetapi tindakan tersebut juga dapat mengakibatkan pertanggungjawaban berdasarkan kesalahan. Kondisi ini menyebabkan beberapa pihak menumpuk tuntutan atas perbuatan melawan hukum dan wanprestasi secara bersamaan. Mahkamah Agung menerima gugatan kumulatif dalam putusan No. 575 K/Pdt/1983 dan Putusan MA No. 2686/Pdt/1985, yang berarti tidak melanggar hukum acara.  Aplikasi penelitian ini: Penelitian ini berguna untuk menganalisis Putusan Mahkamah Agung No. 575 K/Pdt/1983 dan Putusan Mahkamah Agung No. 2686/Pdt/1985. Putusan Mahkamah Agung ini memiliki ratio decidendi atau yurisprudensi bahwa gugatan kumulatif diperbolehkan dan tidak melanggar hukum acara.  Kebaruan/Orisinalitas: Belum ada peneliti terdahulu yang melakukan analisis hukum terhadap putusan MA, padahal MA merupakan yurisprudensi dalam perkara atau permasalahan hukum kumulatif gugatan dan perbuatan melawan hukum.
