Abstract

Since the past, stigma and various forms of discrimination have continued to haunt disabled groups. They become a group that is marginalized from society due to the limitations they experience. Diffable groups should be seen as part of a society that has different abilities. In Islamic doctrine, marginalization and discrimination against these disabled groups is an act that is blamed and prohibited because basically all humans have the same position before God and the only difference is the degree of holiness. Therefore, Islamic law through fiqh products must participate in legitimizing the fulfillment of rights for disabled groups from a religious perspective. This paper will examine the importance of the formulation of fiqh with disabilities as part of respecting human values ​​taught by Islam. Using the theo-anthro-juridical term, this paper will also describe the foundations in formulating the fiqh of persons with disabilities, including theological, humanist, and legal foundations.

Abstract

This research aims to examine the interpretation of constitutional judges regarding the age limit for marriage, which is considered to contain compatibility and efforts to harmonize sharia and human rights principles in their decisions. This is motivated by child marriage tends to ignore the rights of children and women. Unfortunately, religious understanding and even state law often affirmed this practice. The research method used is normative juridical using secondary data. This research will analyze Constitutional Court Decision Number 22/PUU-XV/2017. This research will show the conflict between the interpretation of sharia -which has been the authoritative area of religious leaders- and the principles of Human Rights (HAM). Meanwhile, the interpretation of the judges of the Constitutional Court seems to contain discourse on the compatibility and harmony of sharia and human rights. This research reflects the Constitutional Court's approach and the petitioners' strategy to review the constitutionality of the minimum age for marriage as stated in the Marriage Law. The various approaches and arguments show that the applicant made a strategic decision by breaking a patriarchal culture and injustice before the Constitutional Court.

Abstract

This study addresses the challenge of maintaining integrity and judicial ethics in Indonesia’s Religious Courts, which are often threatened by social, political, and economic pressures. In response to the modern crisis of spirituality, Sufi education offers a prophetic paradigm that emphasizes purification of the soul, honesty, and justice as divine orientations. This research, based on library study of classical and contemporary Sufi literature alongside legal regulations on judicial ethics, argues that Sufi education provides a spiritual foundation for strengthening judges’ moral integrity and professional ethics. The findings reveal that the internalization of teachings such as tazkiyat al-nafs, muraqabah, and ihsan can enhance ethical awareness, foster judicial independence, and reduce the risk of abuse of authority. Rather than replacing formal codes of ethics, Sufi education complements them with a deeper spiritual framework. The study recommends integrating Sufi educational modules into judicial training and continuous professional development. Its novelty lies in framing Sufi education not merely as private spirituality but as an institutional instrument for building a clean, dignified, and just Religious Court system in Indonesia. Penelitian ini membahas tantangan menjaga integritas dan etika peradilan di Pengadilan Agama Indonesia yang kerap terancam oleh tekanan sosial, politik, dan ekonomi. Di tengah krisis spiritualitas modern, pendidikan tasawuf menawarkan paradigma profetik yang menekankan pensucian jiwa, kejujuran, dan keadilan sebagai orientasi ilahiah. Dengan menggunakan metode studi pustaka terhadap literatur tasawuf klasik dan kontemporer serta regulasi hukum terkait kode etik hakim, penelitian ini menegaskan bahwa pendidikan tasawuf dapat menjadi fondasi spiritual untuk memperkuat integritas moral dan etika profesional hakim. Temuan menunjukkan bahwa internalisasi ajaran seperti tazkiyat al-nafs, muraqabah, dan ihsan mampu meningkatkan kesadaran etis, menumbuhkan independensi peradilan, dan meminimalisasi potensi penyalahgunaan kewenangan. Pendidikan tasawuf tidak dimaksudkan menggantikan kode etik formal, melainkan melengkapinya dengan kerangka spiritual yang lebih mendalam. Penelitian ini merekomendasikan integrasi modul pendidikan tasawuf dalam pelatihan calon hakim maupun pengembangan profesional berkelanjutan. Kebaruan penelitian terletak pada argumentasi bahwa pendidikan tasawuf bukan sekadar urusan spiritualitas privat, tetapi juga instrumen institusional untuk membangun peradilan agama yang bersih, bermartabat, dan berkeadilan.

Abstract

Article 33 of the constitution of the Republic of Indonesia 1945 as the juridical foundation of natural resources management by the state mandates that the management of natural resources is intended for the greatest prosperity of the people. The customary law community which is part of the people has been recognized in the constitution. However, such recognition becomes a dilemma when speaking of the management of natural resources especially in areas of customary territory (ulayat). Various conficts in the field of natural resources beetwen indigenous peoples and government (state) and companies (investor) interesting to be observed. This study attempts to explore and explain the discourse of state control and the fulfillment of indigenous peoples’ right related to the management of natural resources in the prevailing laws and regulations. Pasal 33 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sebagai landasan yuridis pengelolaan sumber daya alam oleh negara mengamanatkan agar pengelolaan sumber daya alam tersebut diperuntukkan untuk sebesar-besarnya kemakmuran rakyat. Masyarakat hukum adat yang merupakan bagian dari rakyat selama ini memang masih diakui eksistensinya di dalam konstitusi. Namun, pengakuan tersebut menjadi dilematis ketika berbicara pengelolaan sumber daya alam, terlebih yang dilakukan dalam cakupan wilayah adat (ulayat). Berbagai konflik di bidang sumber daya alam antara masyarakat adat dan pemerintah (negara) ditambah keterlibatan perusahaan (investor) selalu menarik untuk dicermati. Penelitian ini mencoba menggali dan menjelaskan diskursus penguasaan negara dan pemenuhan hak masyarakat adat terkait pengelolaan sumber daya alam tersebut dalam berbagai peraturan perundang-undangan yang berlaku.

Abstract

This paper concisely and analytically presents the history of tasyri', or the formation of Islamic law in the Prophet's era. By using the term "Theo-Prophetic Jurisprudence," this paper also provide a response and rebuttal to the view that Islamic law is a product of Muhammad's jurisprudence. The results of this qualitative research with conceptual and historical approaches indicate that the formation of Islamic law began in the prophetic period. The period of the formation of Islamic law or the Prophet Muhammad's jurisprudence is divided into two phases, namely the Mecca phases which includes everything related to belief, morals-ethics, and fiqh (law); and the Medina phase which is more oriented to the formation of law, including social situations or the social construction phase. Islamic law or the Prophet Muhammad's jurisprudence is not a product of Muhammad's ideology like some scholars view that Islamic law does not have theological and juristic nuances but only historical-sociological aspects.
