Abstract

The significance of establishing an age limit for marriage cannot be overstated, as marrying at a young age often leads to heightened domestic conflicts, encompassing instances of domestic violence and an increased likelihood of divorce. This study employs an empirical juridical research method, combining field research and library materials, to delve into the factors contributing to child marriages. The findings reveal various drivers of child marriages, notably rooted in economic hardships within families (poverty), parental-arranged marriages, influence from peer groups with a high prevalence of early marriages, cultural perspectives on marriage age, discontinued education, and instances of premarital sexual activities. The repercussions of child marriages extend beyond the act itself, jeopardizing fundamental rights that the young individuals may have otherwise enjoyed. This research underscores the vulnerability of several rights in the context of child marriages, including the right to education, the right to a sustainable livelihood, the right to holistic growth and development, and the right to live free from violence. The forms of violence stemming from child marriages are manifold, encompassing both physical and psychological abuse perpetrated by partners or individuals with familial ties, such as blood relations, marital bonds, and guardians residing in the household. Addressing these multifaceted factors is crucial for the protection and well-being of individuals ensnared in early marriages, paving the way for more informed policies and interventions.

Abstract

The age of marriage has an impact on household problems that can arise such as moral crises, disharmony, and irresponsibility which will have a high potential to experience domestic violence. In principle, child marriage brings a lot of harm and not a few ends in divorce. Based on this paradigm, child marriage must be prevented. The aim of the research is to identify, describe, and analyze the factors that cause domestic violence that occurs in child marriages, forms of domestic violence (domestic violence) that occur in child marriages, efforts to prevent child marriages. The nature of the research is descriptive and the legal research approach uses an empirical legal approach. The results of the study: the causes of domestic violence (KdRT) that occur in child marriages in the Bengkulu City area, namely their life is not sufficient (economic factors), excessive jealousy, excessive emotion or hardness, this is influenced by internal and external factors . Forms of domestic violence (KdRT) that occur in child marriages are physical violence, emotional violence, economic violence. The efforts to prevent child marriage are through cultivating an understanding related to maturing the age of marriage and the dangers of child marriage as a trigger for domestic violence.

Abstract

Penelitian ini mengkaji mekanisme penyelesaian konflik melalui hukum adat Cempalo Tangan yang masih dipraktikkan di berbagai komunitas adat di Provinsi Bengkulu. Cempalo Tangan, yang berkaitan dengan perbuatan fisik atau tindakan nyata yang melanggar norma dan nilai adat, memiliki proses penyelesaian yang khas melalui jalur musyawarah adat. Melalui pendekatan kualitatif dengan metode wawancara mendalam terhadap tokoh adat, observasi partisipatif, dan studi dokumentasi, penelitian ini menganalisis tahapan-tahapan penyelesaian konflik mulai dari identifikasi pelanggaran, investigasi adat, musyawarah, hingga pemberian sanksi dan pemulihan keseimbangan sosial. Hasil penelitian menunjukkan bahwa mekanisme penyelesaian konflik melalui Cempalo Tangan masih memiliki relevansi dan efektivitas dalam menjaga keharmonisan sosial. Namun, implementasinya menghadapi beberapa tantangan seperti benturan dengan sistem hukum formal, berkurangnya pengetahuan generasi muda tentang adat, modernisasi dan perubahan nilai dalam masyarakat, serta inkonsistensi dalam penerapan sanksi adat. Penelitian ini menyimpulkan bahwa diperlukan upaya integrasi yang harmonis antara hukum adat dan sistem hukum formal, serta revitalisasi nilai-nilai adat melalui pendidikan dan pemberdayaan lembaga adat untuk mempertahankan eksistensi dan fungsi hukum adat Cempalo Tangan dalam kehidupan masyarakat modern di Bengkulu.
