Abstract

The aim of this research is to know some descriptions of the situation, conditions, circumstances, and realities of population administration management and marriage registration in the Baduy community. Then another goal is to know how the role of the government is to overcome this. The specific target to be achieved from this research is to ensure that the Baduy community can complete their population administration and be more maximal in registering their marriage to the KUA and having a marriage certificate as a manifestation of obedience to Law Number 1 of 1974, especially Article 2 paragraph 1 and paragraph 2 and National Law. For more than 40 years, believers of faith have been discriminated against and cannot legally register their marriage because they have to marry based on one of the religions recognized by the state. A few moments later Joko Widodo issued Government Regulation (PP) Number 40 of 2019 concerning Implementation of Law No. 23 of 2006 concerning Population Administration, one of which recognizes and regulates the procedures for marriage between religious believers. The issuance of this PP eliminates the discrimination that has so far been experienced by believers. Believers of faith experience discrimination to get population services as Indonesian citizens (WNI). This raises various problems in the form of discrimination in making e-ID cards, registration of marriage certificates, and others. The research method used is by using the juridical normative and sociological normative approaches. Juridical Normative in the form of discussion of several laws and regulations made by the government which are enforced to regulate population administration and marriage registration for believers. Sociological Normative Research on law constructs law as a system of statutory regulations that have existed so far constructed in a society's behavior. The research specification used is descriptive analytical which aims to describe, analyze, and systematically analyze certain facts. The data in this study were collected and compiled in a narrative form and then analyzed qualitatively. Sources of data used in this study were obtained from Library Research. This study also uses primary and secondary data sources which are analyzed using qualitative methods, with data collection techniques from literature studies and field studies to Baduy. Interviews and observations were conducted to obtain the necessary data. The results of the study show that Government Regulation Concerning Marriage Recording For Baduy Banten Believers has not been effective. Socialization from all parties regarding this Government Regulation to the KUA leader of the Ciboleger area and the Banten Baduy people must be carried out because even though the government has facilitated Population Administration and marriage registration for believers in Government Regulation Concerning Marriage Recording For Baduy Banten Believers, in reality this has not been effective.

Abstract

The vice president and Presidentare inter-officerelations. Tetapi the position of Vice President both before and after the change is not clearly described,, padahal authoritative authority environment is a condition of the creation of an authoritative relationship. Therefore, this paper was created with the aim to see how the constitutional dynamics of the Vice President's position in the Indonesian constitutional system. The method used is legal research(legal research)with a type of research library (library research).The results showed that there is a vagueness of the role of the Vice Presidentas an aide to thePresident in article 4 paragraph 2 of the Constitution of the Republic of Indonesia year 1945. Whether the context of the word "assisted" can be interpreted broadly or narrowly. This will have implications on the environmental relations of office and officials Wakil President and President governing the organization and working system of presidential institutions. The author recommends the establishment of special rules to regulate the position of the Vice President and the pattern of relations with the President in order to further clarify the role of each so as to create a harmonious relationship and ensure the legal certainty of governance through the Presidential Bill.

Abstract

Obesitas Regulasi menjadi alasan diterapkannya metode omnibus law dalam pembentukan peraturan perudang-udangan di Indonesia, dengan dimulai melalui pembentukan Undang-Undang No 11 Tahun 2020 tentang Cipta Kerja, namun penerapan metode omnibus law di Indonesia pada hakikatnya belum popular dan masih menuai konflik sebab dalam Indonesia memiliki system Peraturan Perundang-undangan yang diatur dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan dimana dalam membentuk Undang-undang harus mendasarkan pada asas-asas pembentukan peraturan perundang-undangan yang patut (beginselen van begoorlijke regelgeving) dan juga berdasarkan landasan filosofis, yuridis, dan sosiologi. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan. Tujuan penelitian ini untuk melihat implikasi penerapan metode omnibus law dalam sistem pembentukan peraturan perundang-undangan di Indonesia. Berdasarkan hasil penelitian didapatkan bahwa, Dan Indonesia dalam perkembangannya menganut sistem hukum eropa kontinental, sehingga hukum yang dibentuk kemudian dikodifikasi dan tertulis untuk dapat diberlakukan. Dalam pembentukan suatu peraturan perundang-Undangan, pembentukan harus mendapat legitimasi dari UUD NRI Tahun 1945 dengan menjadikannya sebagai landasan ditambah dengan aturan dan ketentuan dalam UU No 12 Tahun 2011. Kemudian berdasarkan problematika yang ada dalam menerapkan omnibus law dapat berimplikasi adanya perubahaan terhadap UU No 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan karena belum memenuhi kaidah pembentukan peraturan perundang-undangan baik dari formil maupun materil. Kata Kunci: implikasi, Omnibus law, sistem pembentukan perundang-undangan.

Abstract

Serang City has the authority to explore its revenue potential in various sectors to increase the Regional Original Income (PAD) in Serang City. PAD is a revenue receipt that exists in each region and is taken based on the statutory policies that have been set by the regional government, especially on regional taxes and regional levies. The fundamental change regarding sports venue levies between Law Number 1 of 2022 and Law Number 28 of 2009 lies in the scope of sports venues that can be subject to levies. Article 136 of Law Number 28 of 2009 states that only sports venues provided, owned, and/or managed by the regional government can be subject to levies. Article 88 of Law Number 1 of 2022 does not offer such limitations. This article aims to find out what the potential regional income is from the sports sector, especially in Serang City and what are the obstacles and barriers for the Serang City regional apparatus to obtain regional original income in the sports sector, using empirical legal research methods. The potential for local revenue owned by Serang City is one of them in the sports sector, in which the Serang City government has not been able to receive PAD. The obstacle that is of concern is the lack of entry of the new legal basis that is currently ratified by the central government regarding Sports as stated in Law Number 1 of 2022 concerning Financial Relations between the Central Government and Regional Governments, and Law Number 11 of 2022 concerning Sports into regional regulations, especially legal products belonging to the Serang City Regional Government
