Abstract

Arbitration serves as a dispute resolution method that offers notable benefits, especially in cases related to medical issues. In contrast, other methods such as litigation are often seen as less effective, while mediation lacks executory power due to the absence of legal enforceability, making agreements vulnerable to cancellation. In Indonesia, arbitration has not yet been adopted for resolving medical disputes, as specific technical regulations are still needed to guide relevant institutions and establish effective mechanisms. This research highlights the importance of implementing arbitration in Indonesia’s medical dispute resolution framework, using a comparative analysis of practices in the United States. Employing normative legal research with qualitative data analysis and comparative examination of international legal practices, the findings reveal that arbitration offers a binding and final resolution, making it a highly effective approach for handling medical disputes. To facilitate its adoption in Indonesia, comprehensive technical regulations and a legal framework—similar to the United States’ Uniform Arbitration Act (UAA), which outlines arbitration requirements for individual states—are necessary.

Abstract

Regional integration in ASEAN has been a delicate and ongoing issue over the years. Such goal is hard to achieved due to the ASEAN Way, including its “Non-Intervention Principle” which consequently has transformed ASEAN into a governmental driven regional institution, instead of supranational organization. The case of South China Sea is one prime example of how incompetent ASEAN is in dealing with regional security threat inflicting its member states. This conflict poses an even larger threat if it is not tackled seriously. This paper uses Juridical normative method by looking at international legal instruments in analyzing ASEAN’s empowerment for regional integration to tackle regional security matters. By looking at EU Model as a source of reference. This paper shows ASEAN-EU relations has grown significantly and many believe ASEAN has the capacity to transform like the EU in the future. There are a number of international legal instruments which under serious amendment, can transform ASEAN towards that goal, particularly in helping to deal with the never ending South China Sea conflict.

Abstract

AbstrakEksistensi hak kesehatan sebagai fundamental right yang dimiliki oleh setiap individu telah diakui secara kontitusional. Hakikatnya, kesehatan harus dijamin dengan adanya suatu kepastian hukum melalui upaya peningkatan kualitas kesehatan. Namun, beberapa daerah masih memiliki keterbatasan akses pelayanan kesehatan dasar di puskesmas. Hambatan tersebut terlihat dari minimnya jumlah puskesmas dan kesenjangan fasilitas antardaerah, kurangnya berbagai faktor penunjang, serta terbatasnya kuantitas tenaga kesehatan yang akan mempengaruhi capaian kesehatan masyarakat. Pemberlakuan jam operasional dalam rangka mengurangi angka penyebaran covid-19 mengakibatkan terjadinya dua kondisi yang kontras. Kondisi pertama menimbulkan overcapacityyang berisiko memicu kerumunan, sedangkan kondisi kedua menyebabkan penurunan jumlah kunjungan masyarakat ke puskesmas. Hal ini perlu menjadi fokus pemerintah, guna meningkatkan pemerataan pelayanan kesehatan pada daerah terdampak. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan studi kepustakaan. Hasil penelitian ini menunjukkan bahwa perlu strategi oleh pemerintah dalam mengatasi dinamika kesehatan sebagai suatu penyempurnaan kerangka kebijakan dalam mewujudkan target Sustainable Development Goals (SDGs) pada sektor pelayanan kesehatan di daerah. Untuk itu, penulis beranggapan perlu adanya kepastian jaminan melalui Primary Health Care Improvement sebagai solusi alternatif yang tepat, guna meningkatkan kualitas pelayanan puskesmas di daerah terdampak dalam memitigasi covid-19. Abstract The existence of the right to health as a fundamental right that every individual owns has been recognized constitutionally. In essence, health must be guaranteed by the presence of a legal certainty through efforts to improve the quality of health. However, some areas still have limited access to essential health services at community health centres. These obstacles can be seen from the minimal number of community health centres and the gap in facilities between regions, the lack of various supporting factors, and the limited quantity of health workers that will affect public health outcomes. The implementation of operating hours to reduce the spread of COVID-19 resulted in two contrasting conditions. The first condition causes overcapacity, which risks crowds, while the second condition causes a decrease in the number of community visits to the community health centres. These conditions need to be the government's focus to increase the distribution of health services in affected areas. This study uses a normative legal research method with an approach to legislation and literature study. The results of this study indicate that the government needs a strategy in overcoming the dynamics of health as a refinement of the policy framework in realizing the Sustainable Development Goals (SDGs) targets in the regional health service sector. For this reason, the authors think that there is a need for guarantees through Primary Health Care Improvement as an appropriate alternative solution to improve the quality of community health centres services in affected areas in mitigating COVID-19.

Abstract

Law Number 16 of 2025 allows foreign nationals to occupy strategic positions in State-Owned Enterprises, triggering debate between the demands of modernization in a globalized economy and the principle of national economic sovereignty under Article 33 of the 1945 Constitution. This normative legal study applies a statute approach, an analytical approach, and Talcott Parsons’ AGIL framework to examine the legal and sociological implications of this policy. The findings show that the policy functions as an adaptive strategy to improve governance and competitiveness, but it also raises challenges in integrating international professional standards with local organizational culture and in maintaining economic nationalism. While foreign involvement may reduce political pressures in decision making, it simultaneously generates resistance related to the sovereignty of public resources. The effectiveness of this policy therefore depends on the ability of the legal system and SOE management to balance global openness with the preservation of national values, supported by clear implementing regulations and mechanisms for domestic capacity building through knowledge transfer.

Abstract

The rapid development of Artificial Intelligence (AI), particularly deepfake technology, presents both opportunities and risks, including fraud, disinformation, and digital sexual crimes. In Indonesia, the legal framework primarily holds users accountable while leaving AI developers largely unregulated, creating legal gaps and weakening victim protection. This study examines criminal liability for AI developers under Indonesian law and proposes an ideal model inspired by the European Union, where developers face obligations for transparency, labeling, and liability for defective AI products. Using normative legal research and comparative analysis, the study finds that shifting accountability toward developers would enhance victim protection, close regulatory gaps, and establish a balanced legal framework that aligns AI innovation with responsibility.

Abstract

Public participation in Indonesia has increasingly shifted toward digital models following the COVID-19 pandemic, yet substantive engagement remains limited despite 221.56 million internet users and persistent urban–rural digital disparities. Using a socio-legal approach, this study examines the alignment between regulatory frameworks and digital participation practices in the Indonesian House of Representatives (DPR RI), focusing on initiatives such as DPR Now! and the Public Aspiration Agency. The findings show that participation mechanisms remain at the tokenistic consultation level on Arnstein’s Ladder, reflected in a low response rate of 3 percent, weak feedback loops, fragmented platforms, and the absence of a legal mandate to integrate public input into legislative decision-making. Comparative analysis with international models, including Decide Madrid and Taiwan, demonstrates the potential to significantly enhance participation through co-creation mechanisms supported by blockchain and AI-based sentiment analysis. Accordingly, this study proposes the establishment of Digital Deliberation Councils, regulatory harmonization, and constitutional amendments to guarantee digital participation rights, providing a foundation for a more inclusive and deliberative digital democracy in Indonesia.
