Abstract

Penelitian ini menganalisis implementasi Public Trust Doctrine (PTD) dalam pengambilan kebijakan di tingkat daerah dan pusat di Indonesia dengan menggunakan pendekatan penelitian normatif. PTD, yang berfungsi sebagai prinsip hukum untuk memastikan pengelolaan sumber daya alam secara berkelanjutan, telah diintegrasikan ke dalam kerangka hukum Indonesia. Meskipun regulasi sudah ada, penerapannya masih menghadapi berbagai tantangan. Studi ini menemukan bahwa pemahaman yang kurang mendalam tentang konsep PTD dan keterbatasan kapasitas teknis di kalangan pengambil kebijakan menghambat implementasi yang efektif. Selain itu, koordinasi yang terfragmentasi antara pemangku kepentingan menghalangi evaluasi dampak yang komprehensif. Namun, penelitian ini juga mengidentifikasi peluang untuk perbaikan, termasuk peningkatan pemahaman, kapasitas teknis, dan koordinasi antar pemangku kepentingan, serta penguatan mekanisme pengawasan. Oleh karena itu, diperlukan upaya lebih lanjut untuk memastikan implementasi PTD yang efektif dan menyeluruh dalam pengambilan kebijakan di Indonesia, guna mencapai tujuan pembangunan yang berkelanjutan dan seimbang.

Abstract

This article aims to explore the process of economic development through Baitul Mal as a solution for resolving property disputes inherited from deceased individuals who have no heirs in Indonesia. The methodology of this article employs doctrinal or normative legal research, utilizing statutory, conceptual, and comparative approaches. The discussion results indicate that Baitul Mal can serve as a solution in inheritance cases where the deceased does not leave behind any heirs, as well as the allocation of the Baitul Mal portion, which needs to be supported by additional rules. These rules will function as a legal umbrella and a basis for implementation at the national level. Furthermore, positive regulations must always incorporate relevant legal provisions, considering the importance of the principle of legality in decision-making. In conclusion, with a clear legal framework in place, Baitul Mal can significantly contribute to the economic development of the community and the effective management of inherited property.

Abstract

The Constitutional Court was established in 1945 as part of a plan to ensure that people rights under the Constitution of the State Republic of Indonesia would be upheld. One aspect of the Constitution that has changed significantly since it was ratified in 1945 is that it provides greater and more genuine protection for people constitutional rights in particular and human rights in general. Since the Constitution of 1945 has been fundamentally altered, any discussion of constitutional complaints in connection to that document must focus on that document. Because Therefore, it is crucial to explain the existence of a constitutional complaint process and the need for it for the reader to have a firm grasp on the significant changes that have transpired since The 1945 Constitution. As a result, the Constitutional Court is now empowered to hear and rule on complaints of a constitutional nature.Â
