Abstract

This study aims to explore the concept and urgency of mediator’s good faith in mediating civil law. It is a normative juridical study (doctrinal) with secondary data from primary and secondary legal materials, using bibliography technique. Those materials are analyzed with a qualitative descriptive method. Further, good faith is put as the highest principle in agreement, including mediation and expecting to be implemented by all dispute parties and mediators as well. A mediator’s good faith should be carried out with earnest effort and intention formerly, instead of pushed by constitution to mandatory mediating dispute parties. This study has shown that good faith visibly implements if the mediator actively conducts the functions and responsibilities with confidentiality, volunteer, empowerment, neutrality, and exclusive solutions as the principles.

Abstract

Penelitian ini bertujuan untuk mengetahui tingkat keberlanjutan sistem pertanian padi organik. Lokasi penelitian ini akan dilakukan di Kecamatan Wasuponda Kabupaten Luwu Timur dengan waktu selama 3 (tiga) bulan, mulai bulan September sampai bulan Nopember Tahun 2023. Populasi petani organik di Kecamatan Wasuponda berjumlah 21 orang. Hasil penelitian menunjukkan bahwa dimensi ekologi termasuk dalam kategori sangat berlanjut, sedangkan dimensi ekonomi dan sosial budaya termasuk dalam kategori cukup berlanjut. Tantangan dalam pengembangan pertanian padi organik di Kecamatan Wasuponda adalah tingkat kemiskinan dan pengetahuan petani padi organik. Strategi yang dapat diterapkan dengan peningkatan kapasitas petani dan juga penyediaan sarana prasarana pertanian organik.

Abstract

This article is to analyze the value of the benefits of mediation in child custody cases.This research is normative research with a statutory approach and a conceptual approach. Types and sources of legal materials are primary legal materials, secondary legal materials and tertiary legal materials. Searching for legal materials uses the literature study method to search for legal materials, including regulations governing mediation, child custody, journals and literature books. The collected materials are then inventoried and identified and all existing legal materials are systematized. The results of the research show that the integration of mediation is based on the provisions of Article 130 HIR & Supreme Court Regulation No. 1 of 2016 concerning Mediation Procedures in Court requiring that cases be resolved through mediation including child custody. This method of resolving cases will prioritize the interests of the child because it is through a peace agreement which is confirmed by a deed. peace will enable joint parenting of children, this method will provide benefits in the child's growth and development even though the parents are divorced

Abstract

Abstract: This study aims to analyze the regulation of civil law in Indonesia concerning the protection of women workers' reproductive rights and the application of civil law in employment contracts related to these rights. The research employs an empirical legal research method. The findings reveal two main points: First, the protection of women workers' reproductive rights in Makassar has been partially implemented, such as maternity leave, but rights related to menstrual leave, pregnancy leave, and breastfeeding facilities remain inadequate. Second, the application of civil law in employment contracts for women workers is not yet optimal. The contributing factors include the need to enhance monitoring and enforcement of regulations regarding women workers' reproductive rights. Education for companies and workers is also necessary to raise awareness and compliance. Additionally, more specific regulations are required to ensure the effective implementation of these protections in Makassar. Keywords: Legal Protection, Reproductive Rights, Women Workers/Laborers Abstrak: Penelitian ini bertujuan untuk menganalisis pengaturan hukum perdata di Indonesia terkait perlindungan hak reproduksi pekerja/buruh wanita dan penerapan hukum perdata dalam kontrak kerja yang berkaitan dengan hal tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris. Hasil penelitian menunjukkan dua hal utama: Perlindungan hak reproduksi pekerja wanita di Makassar sudah diterapkan sebagian, seperti cuti melahirkan, namun hak terkait cuti haid, cuti hamil, dan fasilitas menyusui masih kurang dan Penerapan hukum perdata dalam kontrak kerja pekerja wanita belum optimal. Kemudian yang menjadi alasan antara lain adalah meningkatkan pengawasan dan penegakan aturan terkait hak-hak reproduksi pekerja wanita. Edukasi kepada perusahaan dan pekerja juga perlu dilakukan untuk meningkatkan kesadaran dan kepatuhan. Selain itu, aturan yang lebih spesifik diperlukan agar implementasi perlindungan hak-hak tersebut dapat berjalan lebih efektif di Kota Makassar. Abstract

Many people have selected mediation as a dispute resolution procedure to get the best agreement and solution. However, it is not uncommon for parties to fail to consistently implement an agreement reached through mediation. The purpose of this article is to examine the essence of peace agreements reached through mediation, as well as the importance of the principle of good faith as a form of protection for the parties involved in such agreements. This is normative research that takes both a statutory and conceptual approach. The exploration of data in the form of primary and secondary legal materials was carried out through a literature review and descriptive-qualitative analysis. The analytical results reveal that the mediation process, which concludes with a peace agreement, represents the end of a dispute based on the ideals of benefit and justice. On that premise, its execution must be based on the principle of good faith to provide legal protection to the parties, whether mediation takes place in or out of court. Good faith in implementing a peace agreement is interpreted as an attitude that develops within the parties in dispute to carry out their commitments as a moral obligation to obey and accomplish things that have been agreed upon voluntarily.

Abstract

The COVID-19 pandemic that shocked Indonesia has resulted in not only a health issue, but also additional problems such as a sudden rise in domestic violence (KDRT). This study aims to analyze the form of legal protection for victims of domestic violence during the COVID-19 pandemic as well as find out the obstacles faced in the process. This study is empirical legal research that uses a statutory approach and a case approach to analyze primary and secondary data. The research activities was carried out in Makassar City, namely at the Women and Children Protection Unit of the Makassar City Police (PPA Polrestabes Unit) and the Makassar City Women and Children Empowerment Integrated Services Unit (UPTPPA). The results of the study show that legal protection for victims of domestic violence that occurred during the COVID-19 Pandemic have been carried out in accordance with existing legal provisions but have not been optimal due to several factors related to restrictions on community activities and strict health protocols. A number of obstacles that affected the legal protection of victims during the pandemic included: 1) The limited number of personnel from the Makassar Polrestabes PPA Unit; 2) limited infrastructure; and 3) restrictions on community activities and strict health protocols.

Abstract

This paper analyzes the problem of electronic mediation as a manifestation of the principles of fast, simple and low-cost justice. The main problem in researching the essence of the principle of fast, simple, low-cost justice through electronic trials and the beneficial value of mediation carried out electronically. This research is normative juridical research with primary and secondary legal materials analyzed descriptively qualitatively. The essence of the principle of fast, simple and low-cost justice is legal certainty for the parties involved in the case without prejudice to the value of justice and benefit, while the value of the benefit of electronic mediation is the ease in resolving disputes, the relatively short time compared to settlement by judge's decision, and the costs involved. affordable.

Abstract

This research aims to know and understand the regulation of customary criminal law of the Bugis community against samen leven acts that violate customary norms and to know and understand the social impact on samen leven offenders in society. This research uses normative research methods, namely the type of research conducted by analyzing legal rules. This type of research is conducted by means of a literature study, namely by reading and analyzing written materials. The results show that customary criminal law still plays a role in upholding the norms of decency in society, especially in dealing with the phenomenon of samen leven . In Bugis society, the value of Siri'na Pacce reinforces the view that this behavior tarnishes honor and social balance, so customary sanctions are still applied even though national law has regulated it in the Criminal Law Code. In addition to being socially stigmatized, samen leven perpetrators also face impacts such as family disharmony and unclear child status. Therefore, customary law is still considered relevant in resolving cases culturally and maintaining social harmony in society. The recommendations of this research are 1. Socialization of the negative impact of samen leven and the importance of customary norms and laws need to be improved through education, media and communities so that the younger generation understands the consequences. 2. A policy that harmonizes customs and national laws is needed, so that the settlement of samen leven cases still consider cultural aspects, justice and protection for all parties.

Abstract

This study aims to determine the efforts of the Parepare Police in combating online gambling crimes and the factors that hinder these efforts.The research method used by the researcher in this study is empirical legal research, in which the researcher conducted direct interviews with two members of the Makassar Police Traffic Unit. The research findings concluded that the efforts of the Parepare Police Department in combating online gambling crimes include collaborating with government authorities to conduct awareness campaigns about the dangers of online gambling through the installation of banners, posters, and video screens at specific locations in the city of Parepare, blocking websites, and restricting access to online gambling websites, as well as prohibiting internet service providers from selling internet packages for online gambling activities such as domino chips. Factors hindering efforts to combat online gambling crimes in the city of Parepare include the difficulty of tracking down bookmakers, who are generally located overseas, limitations in technology and human resources among law enforcement officials, a lack of specific and strict regulations, and economic motives and a consumerist lifestyle.
