Abstract

The purpose of this study is to determine the legal position of the digital credit service financing agreement (PayLater) according to the fiqh school, to determine the legal position of the digital credit service financing agreement (PayLater) according to positive law. To find out how to resolve disputes over digital credit service financing agreements (PayLater) due to default. In answering these problems, the author uses normative (syar'i) and juridical theology. This research is classified as library research (library research), data collected using library data in the form of books, journals, articles in both electronic media and print media as data, then analyzes the contents of the literature relating to the problems discussed, then reviews and The results of this study show that the scholars of the madhhab agree that in this transaction it is not allowed to qardh which aims to bring profit to the borrower. Meanwhile, according to positive law, the position of debt and receivables is explained in OJK Regulation Number 77/POJK.07/2016 concerning Information Technology-Based Money Loan Services which regulates the implementation of Fintech peer to peer lending (P2PL) as business actors who pay attention to the form of registration and licensing of the organizing institution, future governance and risk management and periodic reports to the OJK as well as a form of education to consumers regarding legal protection. And based on the positive law that applies in Indonesia, there are two routes that can be used in dispute resolution, namely the litigation route and the non-litigation route. In dispute resolution carried out by the lender and the loan recipient, they do not choose to use dispute resolution methods with these channels, but the lender and loan recipient prefer to carry out internal settlements, and provide administrative sanctions for defaulters.

Abstract

This article discusses how to protect children outside of marriage from an Islamic jurisprudence perspective. This type of research is qualitative in nature and is carried out using the Library Research method, namely a method of analyzing, interpreting and classifying data obtained from various suitable sources. The results of this research are that protection for children outside of wedlock is only obtained through their mothers and their mothers' families. Because illegitimate children only have a lineage relationship with their mother, the protection they get from their father does not get protection because they don't have a lineage relationship. As illegitimate and illegitimate children, children born in this context do not receive protection for the right to livelihood, educational guardianship, inheritance and cannot be provided with services in state administration.

Abstract

This study aimed to determine the effect of work experience, discipline, Work, Compensation, and motivation on employee performance in regional public hospitals Rantauprapat. Samples in this study were employees of the Regional General Hospital with a total of 90 rantauptapat. From the research, there is a positive and significant effect of work experience variables on performance with t count X1 equal to 4.571 smaller than T table equal to 1.67 with significance 0.000<0.05, there is a positive but not significant effect of work discipline variables on Employee Performance With t count X1 equal to 0.090 smaller than T table 1.67 and significance 0.242 > 0.05, there is 1.67 and significance 0.132>0.05, there is a positive and significant effect of motivation on Employee Performance With t count X 2 of 4.271 greater than T table of 1.96 and significance of 0.000 < 0.05, there is a simultaneous influence of independent variables work experience, work discipline, compensation and motivation on performance shows F count of 30.549 greater than F table of 2, 60 with significance of 0.000< 0.005.

Abstract

This research analyzes the psychological dimensions of the character Pertiwi in the film Kejarlah Janji by Garin Nugroho. The author's aim in conducting this research is to describe characters that can be seen from one of the three dimensions of character, namely psychological, which can trigger conflict. The theory applied in this research uses the theory of characterization, character and conflict, using direct and indirect methods in the film Kejarlah Janji, especially the character Pertiwi. The research method used is qualitative with a descriptive approach. The results of this research show that there are 10 scenes that can show the psychological dimension of Pertiwi as a trigger for conflict in the film Kerjarlah Janji. The conclusion of this research is that the psychology, character and conflict experienced by the character Pertiwi in the film Kejarlah Janji can produce results that can be seen from the character's firmness, wisdom and anger, which can cause problems for other characters as well as for themselves and the environment surroundings.
