Abstract

The existence of illegal fintech is still a public concern due to the inadequate regulation tools that are able to regulate and take firm action against the existence of illegal fintech. The difficulty faced by regulators in taking action against illegal fintech is because it is difficult to be tracked and illegal entities that have been blocked can easily recreate new illegal fintech entities. This study was conducted by using normative legal research, which was reviewing material law that contains normative legal rules. As the result, there are conclusion namely, first Illegal fintech P2PL actors try to trick the public by resembling the company’s platform name and/or logo, name, and identity color from legal fintech P2PL that has been registered/licensed at the OJK and SWI’s efforts to take action against these fintech P2PL companies are by blocking sites, conducting joint inspections of business activities which assumed as illegal investments, ordering illegal fintech P2PL companies to stop business activities, and improving coordination in handling cases with related agencies. OJK through SWI seeks to stop the chain of Illegal fintech P2PL by routinely coordinating with the Minister of Communication and Information to block illegal services

Abstract

Photocopied books are sold at much cheaper prices than original books. These pirated books are very popular with college students because of their affordable prices without thinking about the authenticity of the book. Books are objects of Copyright which are protected by law, therefore the author of the book as the creator and/or holder of Copyright for the work of the book has exclusive rights, namely the right to monopolize his creation in an effort to protect his creation from other parties, such as the right to publish and multiplying his creations or giving permission to other parties to gain economic benefits. Even though copyright is an individual right, there are certain limits regarding public authority to provide access to information for society at large. This article examines how copyright is limited in duplicating books for educational purposes and how UUHC enforces book duplication without the author's permission. The method used to study this problem is the normative research method. Based on the results of the study, it can be concluded. Copyright restrictions can be made as long as they do not conflict with morals, religion, public order, decency, national defense and security. The Copyright Law contains restrictions on Copyright related to education as stated in Article 44 jo. Article 86 wherein stating the specified source, or the obligation of the copyright holder concerned to give permission to another party to translate and/or reproduce the work or can also appoint another party to carry out the translation/reproduction of the work. This is done for creations in the fields of education and research. Law enforcement regarding Copyright violations can be resolved through civil dispute resolution and criminal prosecution

Abstract

In March 2020, the WHO stated Covid-19 is pandemic disease. The Indonesian government has taken actions to prevent the spreading of Covid-19 by limiting people’s activities. Covid 19 has resulted in people who loans at lending institutions, having difficulty paying installments. The government issues policies in response to the Covid-19 effect, such as economic relaxation. However, the policy did not cover consumers Fintech Peer to Peer (P2P) Lending, this created a legal vacumm. The problem in this research is the urgency of legal protection for Fintech P2P lending consumers during pandemic Covid-19. The purpose of this research is for OJK policy to issue a stimulus to Fintech P2P Lending consumers. This research applied juridicial normative methodology. It uses secondary data, which consists primary legal material, namely the OJK regulations on Covid-19 prevention and related literature, analyzed descriptively analytically. The research shows that consumer fintech P2P lending are affected by Covid-19 pandemic, so they need to get legal protection, in the form of stimulus given to lenders and borrower of fintech P2P lending.

Abstract

In Indonesia, the status of adopted children is often a complex issue, because the appointment of children who are legally carried out through court decisions does not automatically get the same rights as biological children, including in terms of inheritance. Although basically the inheritance of adopted children has been regulated in certain regulations including in civil law, this is because regulations on the inheritance rights of adopted children do not clearly provide certainty of their rights. Based on this background, this paper aims to discuss how the legal position of adopted children in relation to the right to inherit the property of adoptive parents according to the Civil Code and how legal protection for adopted children whose inheritance rights are neglected or complicated. The research method used is normative juridical by reviewing and analyzing legislation and literature materials. Staatsblad 129 of 1917 which confirms that adopted children have the same equal position as biological children or biological children so that directly applicable rights legitime portie. Legal protection for adopted children will be directly protected by law after the appointment of children through court decisions.
