Abstract

This study focuses on the juridical analysis of consumer protection in e-commerce transactions in Indonesia, considering the sector's rapid growth, which reached a total transaction value of IDR 631 trillion in 2023. On the other hand, consumer complaints have continued to rise, involving issues such as fraud, defective products, and data privacy violations. This study aims to evaluate the effectiveness of existing regulations, such as Law No. 8 of 1999 and its supporting regulations, in protecting consumer rights. Using a normative-juridical approach, the study examines the legal substance, implementation, and gaps between national regulations and international standards like the European Union's General Data Protection Regulation (GDPR). The findings indicate that although national regulations provide basic protections, their effectiveness is considered low, particularly in the aspect of personal data protection, which only achieves 40% effectiveness, significantly lagging the GDPR at 95%. Additionally, inefficient complaint mechanisms and weak coordination among government agencies are major obstacles to resolving consumer disputes. Low digital literacy among consumers further exacerbates the ineffectiveness of the protection provided by existing regulations. The study concludes that national regulations require significant reform to be more adaptive to digital challenges. Policy recommendations include adopting GDPR principles, strengthening government oversight, and enhancing consumer education. This study's contribution is expected to strengthen a safe, transparent, and equitable e-commerce ecosystem in Indonesia while boosting consumer trust in online transactions.

Abstract

Gender-based violence in digital spaces has become an escalating issue globally, impacting individuals through harassment, stalking, and unauthorized sharing of private content. This study aims to examine and compare the legal frameworks of Indonesia, India, Singapore, Malaysia, and the Philippines in addressing such violence, focusing on victim protection and enforcement effectiveness. Using a qualitative descriptive approach and comparative analysis, this research reviews primary legal documents, policies, and relevant literature to identify the strengths and limitations of each country’s approach. Findings indicate that Indonesia relies on the Domestic Violence Act (UU PKDRT) and the Women and Children Protection Unit (PPA), though limited resources and a lack of specialized training for law enforcement remain challenges. India combines strict IT regulations with public digital education campaigns, effectively raising awareness but still faces social stigma in reporting. The study highlights the importance of accessible reporting mechanisms, public awareness initiatives, and cross-country collaboration within ASEAN to enhance the effectiveness of legal protections against gender-based violence in digital spaces. This research contributes by providing insights into the contextual adaptations of legal frameworks and suggests future studies to conduct fieldwork for a deeper understanding of implementation and policy adaptation.

Abstract

Era digital telah membawa dampak yang signifikan pada penggunaan data pribadi, sehingga mempengaruhi berbagai aspek kehidupan masyarakat. Di Indonesia, pengaturan penggunaan data pribadi telah dilakukan melalui beberapa peraturan perundang-undangan, namun masih terdapat kelemahan dan ketidakjelasan yang perlu diperbaiki. Penelitian ini bertujuan untuk menganalisis kebijakan hukum terkait penggunaan data pribadi di Indonesia, dengan fokus pada perlindungan hak-hak privasi individu. Hasil penelitian menunjukkan bahwa kebijakan hukum yang ada masih belum efektif dalam melindungi hak-hak privasi individu. Oleh karena itu, penelitian ini merekomendasikan beberapa perubahan kebijakan hukum untuk meningkatkan perlindungan hak-hak privasi individu, seperti memperluas definisi data pribadi, meningkatkan transparansi dalam penggunaan data pribadi, dan meningkatkan sanksi terhadap pelanggaran privasi.

Abstract

The rapid growth of the digital economy has transformed the landscape of legal disputes, particularly in Indonesia, where e-commerce transactions continue to increase significantly. This study examines the role of the State Attorney (Jaksa Pengacara Negara/JPN) in handling digital economic disputes, which remain limited despite the normative authority granted by law. Using a juridical-empirical approach, the research combines document analysis, in-depth interviews with prosecutors, judges, consumer protection officials, and digital law experts, and observation of selected cases. The findings reveal that JPN’s involvement remains concentrated on conventional disputes, such as breaches of electronic contracts and online fraud. In contrast, their role in strategic issues such as data protection and digital monopoly remains negligible. Comparative analysis with other jurisdictions highlights that prosecutors in the United States, the European Union, and Singapore have adopted more proactive and efficient roles in protecting public interests in the digital domain. The study concludes that the gap between JPN’s normative authority and its practical implementation reflects weaknesses in technical capacity, regulatory framework, and inter-institutional coordination. This research contributes to academic discourse by providing empirical and comparative insights into JPN’s role in digital disputes and by offering practical recommendations to strengthen its function through regulatory reform, capacity building, and institutional synergy. Strengthening JPN’s role is not only necessary to protect consumers and ensure legal certainty but also essential to enhance Indonesia’s legal competitiveness in the global digital economy.

Abstract

The design and development of a web-based information system to improve the quality of service and education at Nurul Hidayah Islamic Boarding School represented a strategic effort to utilize information technology in enhancing administrative efficiency and information accessibility. The system was developed to address problems related to ineffective information dissemination and the manual registration process for new students. The web-based application, developed using the Waterfall method, enabled online student registration and provided faster and more accurate access to educational information. System development involved requirements analysis, Unified Modeling Language design, interface and backend implementation, and system testing. To evaluate the effectiveness of the developed system, user acceptance was assessed using User Acceptance Testing based on a five-point Likert scale questionnaire involving 15 system users. The evaluation focused on system usability, ease of use, information clarity, system efficiency, and user satisfaction. The evaluation results showed an overall average acceptance score of 4.39, indicating a high level of user acceptance. These results demonstrated that the system was capable of improving administrative efficiency and supporting educational services in a more structured and effective manner.

Abstract

The concept of decentralization has gained popularity as a means to enhance regional self-governance, but the most recent regions established must cope with the challenge of legal consistency in policy application. The objective of the current research is to evaluate the legal consistency of decentralized policy implementations in newly created regions by examining the relationship between the national government's legal norms and local policy practices in these areas. The research employs a qualitative socio-legal method, using a comparative case study approach involving some newly autonomous regions. The data for the research were gathered through analysis of legal documents, policy records, and in-depth interviews with key regional policy actors; the researchers also used thematic and comparative analyses to work through the data. The results of the research show that legal consistency remains irregular, with inconsistencies occurring mainly during implementation rather than in the drafting stage. Differences in institutional capacity and varying understandings of legal responsibilities are the main factors driving these inconsistencies. The study makes a significant contribution to the understanding of decentralization by placing the spotlight on legal consistency as a crucial bridge between the normative frameworks and policy practice. It recommends that the effective functioning of decentralization depends not only on coherent legal arrangements but also on strong institutional mechanisms to ensure consistent implementation at the regional level.

Abstract

Given resource constraints and competitive pressures, we would have expected most SMEs to focus on the performance of AI over ethics. Our findings, however, ran squarely against those expectations and forced us to revise our assumptions about technological adoption in the smaller enterprise. Digital transformation in SMEs is not just about technology adoption; it is about trust building and organizational learning. While AI affords significant advantages in terms of competitiveness, the "black-box" nature of AI generates accountability gaps in ways that hit small businesses harder because they have limited capacity to absorb risk. Our study illustrates precisely how the integration of Explainable AI with digital ethics shifts decision quality in unexpected ways, to the benefit of both ethical compliance and business performance. Drawing on advanced simulation modeling and realistic synthetic data that represents SME scenarios, we compared three competing approaches: pure black-box AI, XAI without ethical safeguards, and XAI with full ethical integration. We were surprised by how the integrated approach improved not only ethical metrics but also improved strategic outcomes along many dimensions, such as in fairness, transparency, and decision quality. We provide a practical, evidence-based framework that guides SMEs through AI adoption via safe simulation environments, thereby avoiding expensive mistakes in the real world while systematically fostering stakeholder trust and organizational capability.
