Abstract

Gadai atau ar-rahn adalah akad utang piutang antara ar-rahin dengan al-murtahin, di mana ar-rahin selaku pihak yang berutang menyerahkan suatu barang sebagai jaminan pelunasan utang yang telah diterimanya (al-marhun bih) kepada al-murtahin. Al-marhun yang berada dalam penguasaan al-murtahin menjadi amanah baginya. Sehingga ia berkewajiban menjaga dan memeliharanya sebagaimana ia menjaga harta bendanya sendiri. Jika barang yang menjadi al-marhun hilang atau rusak dalam penjagaan dan pemeliharaannya, maka ia tidak berkewajiban menggantinya. Dalam Islam, harta benda, tak terkecuali al-marhun yang berada di bawah penguasaan al-murtahin tidak boleh disia-siakan dan ditelantarkan. Kenyataan ini memunculkan masalah hukum. Siapakah yang mesti memanfaatkan al-marhun tersebut.? Ar-rahin selaku pemilik barang ataukah al-murtahin selaku pihak yang menguasai al-marhun? Untuk menjawab masalah hukum tersebut, artikel ini disusun secara sistematis. Metode penulisan yang digunakan adalah studi kepustakaan atau biasa disebut library research, dengan jalan mengumpulkan, menelaah, dan mengkaji berbagai literatur terkait, kemudian disusun dalam sebuah artikel ilmiah. Dari hasil telaah terhadap berbagai literatur, dapat disimpulkan bahwa ulama’ tidak mencapai kata sepakat tentang pemanfaatan al-marhun, baik oleh ar-rahin sendiri maupun oleh al-murtahin. Menurut jumhur ulama’, ar-rahin selaku pemilik barang tidak dibenarkan memanfaatkan al-marhun. Adapun ulama’ Syafi’iyah berpendapat bahwa ar-rahin dibolehkan memanfaatkan al-marhun sepanjang dapat dijamin dalam pemanfaatan tersebut tidak merugikan dan menimbulkan kemudharatan bagi pihak al-murtahin. Sementara pemanfaatan al-marhun oleh al-murtahin menurut pendapat jumhur ulama’ adalah tidak boleh. Berbeda dengan pendapat jumhur, ulama’ Hanabilah menyatakan bahwa jika yang dijadikan sebagai al-marhun adalah binatang, maka al-murtahin dibolehkan memanfaatkan al-marhun tersebut sesuai dengan kadar biaya yang dikeluarkan untuk menafkahi al-marhun.

Abstract

This study aims to determine the planning of teacher performance improvement, organizing teacher performance improvement, implementing teacher performance improvement and evaluating teacher performance improvement. The method used in this study is qualitative research with a phenomenological approach and the techniques used are observation, interviews and documentation. Research subjects of the Principal, vice-principal and teacher. Data analysis techniques use data reduction, data presentation and conclusions. Guarantor of the validity of the researcher's data using trust, transferability, dependability and assertiveness The results of the research obtained in this study are: (1) Planning for improving teacher performance at the Sulthon Rinjani NW Dasan Poto IT Junior High School Foundation has been carried out with meetings / meetings between the principal, teachers and other school personnel so that appropriate planning can be determined in teacher performance. (2) Organizing teacher performance improvement in SMP IT Foundation Sulthon Rinjani NW Dasan Poto is still lacking, because there are still teachers at the high school / MA education level for the junior high school level and there are still groups of teachers who teach who are not in accordance with their expertise with those taught. (3) The implementation of teacher performance at the Sulthon Rinjani NW Dasan Poto IT Junior High School Foundation is still not carried out because the school's facilities and support for the teaching and learning process are still lacking. (4) Evaluation of teacher performance improvement at SMP IT Sulthon Rinjani NW Dasan Poto Foundation is carried out by providing direction / guidance and improvements in teacher performance

Abstract

This research examines the leadership patterns of parents in educating children in the family in Montong Belandeng Dusun Ganti I, Ganti Village, East Praya District, Central Lombok. Apart from that, this research also examines how parents lead the family in Montong Belandeng, Ganti I Hamlet, Ganti Village, East Praya District, Central Lombok. This research uses descriptive qualitative research. By using data collection techniques in the form of observation, interviews and documentation. The aim of this research is to understand the form of parental leadership in educating children in Montong Belandeng Dusun Ganti I Ganti Village, and also to understand how parents lead in the family in Montong Belandeng Dusun Ganti I Ganti Village. The analysis used in this research refers to analysis according to Sugiyono, the research procedures are: data reduction, data display, and data validation. The research results obtained from this research are that the leadership pattern of parents in educating children in Montong Belandeng Dusun Ganti I, Ganti Village is a permissive leadership pattern and parents lead by giving children the freedom to do whatever they want
