Abstract

Tujuan penulisan ini adalah untuk menganalisa bagaimana pola electoral engagement dan realisasi politik programatik yang dilakukan Koalisi Buruh Jakarta (KBJ) pada saat dan sesudah pemilihan Gubernur DKI Jakarta tahun 2017. Analisis kami membuktikan bahwa adanya policy broker, kesamaan program-program antara kontrak politik buruh-kandidat serta kolaborasi dan konsolidasi yang sistemik lintasfederasi/serikat merupakan faktor-faktor pendukung terjadinya kontrak politik antara KBJ dan pasangan kandidat. Kandidat menjanjikan realisasi program-program kontrak politik apabila terpilih, sedangkan KBJ bersedia menjadi mesin politik kandidat yang otonom selama pemilihan kepala daerah di Jakarta berlangsung. Setelah kandidat terpilih, realisasi kontrak politik didistribusikan secara kolaboratif oleh kelompok buruh-Pemerintah Daerah DKI Jakarta. Distribusi politik tidak hanya ditujukan kepada para pekerja yang mendukung kandidat, namun juga para pekerja yang tidak mendukung kandidat serta kelompok lain di luar kelompok buruh. Artikel ini berargumen bahwa kontrak politik yang identik dengan pertukaran yang partikularistik antara kandidat dan pemilih dalam politik kontemporer di Indonesia tidak terjadi di studi kasus ini sedangkan distribusi politik secara programatik efektif dilakukan oleh kelompok buruh di tengah fregmentasi politik lintas federasi dan reformasi elektoral di Indonesia.

Abstract

This research aims to analyze the political dynamics of the approval of Perppu No. 2/2017 on community organizations into law. In addition, it also looks at the attitudes of each faction in parliament and its relationship with community organizations, especially those related to religion. The research used a qualitative method with data obtained from DPR meeting minutes, laws and regulations, journals, books, and news from mainstream media. The results showed that the technocratic debate in parliament on the discussion of the Perppu Ormas was that the issuance of the Perppu did not meet the specified requirements, and the substance of the Perppu was still considered problematic. In the discussion, political parties were also not unanimous. The factions that support the Perppu are F-Golkar, PDIP, Golkar, Nasdem, and Hanura. The factions that supported with notes were PPP and PKB from supporting the government and F-Democrats from the opposition. The factions that refused were F-PKS, PAN and Gerindra, where F-PKS and Gerindra are in opposition to the government. Those in favor are the majority of nationalist-secular parties and government coalition parties. As for parties with Islamic ideology, some support with notes and some reject. There are different views in the factions supporting the government, where F-PAN completely rejects, while PKB and PPP continue to support, although with notes. The attitude of Islamic parties cannot be separated from the party's affiliation with Islamic organizations that oppose the Perppu Ormas becoming lawPenelitian ini bertujuan menganalisis dinamika politik disetujuinya perppu nomor 2 tahun 2017 tentang organisasi kemasyarakatan menjadi undang-undang. Selain itu juga melihat dari masing-masing sikap fraksi di parlemen dan hubungannya dengan organisasi kemasyarakatan khususnya yang berkaitan dengan agama. Penelitian menggunakan metode kualitatif dengan data diperoleh dari notulen rapat DPR, aturan perundang-undangan, jurnal, buku, dan berita dari media maestream. Hasil penelitian menunjukkan, perdebatan teknokrat dalam parlemen pada pembahasan Perppu Ormas ini yaitu terbitnya Perppu tidak memenuhi syarat yang ditentukan, dan subtansi dari Perppu yang dianggap masih bermasalah. Dalam pembahasannya, partai politik juga tidak satu suara. Fraksi yang mendukung yaitu F-Golkar, PDIP, Golkar, Nasdem, dan Hanura. Fraksi yang mendukung dengan catatan yaitu PPP dan PKB dari yang mendukung pemerintah serta F-Demokrat dari oposisi. Fraksi yang menolak adalah F-PKS, PAN dan Gerindra, dimana F-PKS dan Gerindra adalah oposisi pemerintah. Kelompok yang mendukung adalah mayoritas partai yang berideologi nasionalis-sekuler dan partai koalisi pemerintah. Adapun partai berideologi Islam, ada yang mendukung dengan catatan dan ada yang menolak. Terdapat perbedaan pandangan pada fraksi pendukung pemerintah, dimana F-PAN sepenuhnya menolak, sedangkan PKB dan PPP tetap mendukung, walaupun dengan catatan. Sikap partai Islam ini tak lepas dari afiliasi partai dengan organisasi Islam yang menentang Perppu Ormas tersebut menjadi undang-undang.

Abstract

Regional Regulation Number 10 of 2021 on the Protection and Fulfillment of the Rights of Persons with Disabilities in Kudus City is a hope for the realization of an inclusive city. The number of people with disabilities in Kudus City reaches 0.5% of the total population of Kudus. Still, data in the field reveal that implementing the Disability Regional Regulation in Kudus faces significant implementation barriers. This study examines legal reforms that can be carried out by focusing on complementing the shortcomings of previous studies, which more often portrayed the success of the implementation of the Regional Regulation and disregarded the aspects of obstacles and barriers in the implementation process. In addition, this study analyzes the failure of implementing the Disability Regional Regulation and the factors causing it. The design of this study is qualitative, where data collection was performed through interviews, online sources, and reports. The leading theory used in this study is the implementation of policies from George C. Edward III. The findings of this study stated that four variables must be re-evaluated in implementing the Disability Regional Regulation in Kudus, including communication, resources, disposition, and bureaucratic structure. The results of this study include a recommendation for the regional government to promptly enact the Regent Regulation (Perbup) so that the goals of protecting and fulfilling the rights of persons with disabilities can be achieved without further delay.

Abstract

This study aims to fill the gap and explore how Islamic parties have attempted to legalize Islamic law in both countries over the past three decades. Most scholarly works on Islamic revivalism in Indonesia and Malaysia focus on it as a sociocultural phenomenon. However, there is a lack of scholarship investigating Islamic revivalism through a political approach. This article employs qualitative research methodology, drawing on academic books, journal articles, reports, and online news to examine the efforts of Islamic parties to legalize Islamic law in Indonesia and Malaysia. The findings suggest that the accessibility of political channels significantly influences these efforts. During the Mahathir era in Malaysia, the availability of political channels facilitated the goal of legalizing Islamic law. Conversely, the agenda for legalizing Islamic law was hindered in Indonesia during the Soeharto era due to limited political channels. Additionally, the moderation of Islamic parties affects the agenda for legalizing Islamic law in both countries. In post-Soeharto Indonesia, the incorporation of moderation by Islamic parties has led to a decrease in prioritizing the agenda of legalizing Islamic law. On the other hand, in Malaysia during and after the Mahathir era, the persistence of the obsession with legalizing Islamic law was due to Islamic parties distancing themselves from moderate positions.
