Abstract

Putusan Mahkamah Konstitusi telah memperluas kewenangannya yang terdapat pada putusan No. 21/PUU-XII/2014 untuk menambah beberapa hal dalam pengajuan praperadilan yaitu memeriksa dan memutus sah atau tidaknya penetapan sebagai tersangka dan memeriksa dan memutus sah atau tidaknya suatu penggeledahan dan penyitaan Seorang tersangka yang namanya tercantum dalam (DPO) dalam mengajukan praperadilan, jika dilihat dan berkaca pada KUHAP maka berhak mengajukan praperadilan. Hal ini didasarkan bahwa setiap tersangka berhak mengajukan praperadilan berdasarkan KUHAP tanpa mempermasalahkan tersangka tersebut dalam penahanan ataukah sedang dalam status DPO. Sehingga Mahkamah Agung menerbitkan SEMA Nomor 1 Tahun 2018 tentang Larangan Pengajuan Praperadilan Bagi Tersangka yang Melarikan Diri atau sedang dalam status DPO. Dengan diterbitkannya aturan mengenai SEMA Nomor 1 Tahun 2018 tersebut tentu saja menjadi konflik norma antara KUHAP dan SEMA serta terjadi juga pelanggaran Hak Asasi Manusia (HAM) terhadap tersangka khususnya tersangka yang termasuk dalam DPO (Daftar Pencarian Orang) tersebut.

Abstract

Penjualan properti dengan sistem pra-pembangunan telah menjadi praktik yang umum namun belum diimbangi dengan perlindungan hukum yang memadai bagi konsumen. Penelitian ini bertujuan untuk mengkaji regulasi hukum terhadap kewajiban penggunaan rekening bersama (escrow account) dalam Perjanjian Pengikatan Jual Beli (PPJB) sistem pra-pembangunan dan menganalisis akibat hukum apabila mekanisme tersebut tidak diterapkan. Metode yang digunakan adalah pendekatan hukum normatif dengan teknik studi pustaka terhadap peraturan perundang-undangan dan literatur hukum yang relevan. Hasil penelitian menunjukkan bahwa hingga saat ini belum terdapat ketentuan hukum positif yang secara tegas mewajibkan penggunaan escrow account dalam transaksi pra-pembangunan, sehingga dana konsumen tidak terlindungi secara maksimal apabila terjadi wanprestasi dari pihak pengembang. Implikasi dari temuan ini menekankan perlunya pembentukan regulasi bersifat imperatif terkait escrow account sebagai mekanisme perlindungan hukum preventif dalam kontrak jual beli properti, guna memperkuat posisi konsumen dan meningkatkan transparansi dalam industri properti nasional.

Abstract

Peningkatan kebutuhan perumahan di Indonesia menjadi salah satu tantangan terbesar dalam pembangunan berkelanjutan, terutama akibat pertumbuhan penduduk, urbanisasi, dan keterbatasan lahan. Penelitian ini bertujuan menganalisis peran notaris dalam mewujudkan asas keseimbangan pada pembuatan Akta PPJB, mengidentifikasi hambatan yang dihadapi dalam praktik, dan merumuskan strategi penguatan perlindungan hukum bagi para pihak. Penelitian ini menggunakan pendekatan hukum normatif dengan analisis kualitatif berbasis kajian literatur, doktrin hukum, regulasi, dan praktik terbaik internasional. Hasil penelitian menunjukkan bahwa penerapan asas keseimbangan sangat bergantung pada peran aktif notaris dalam memverifikasi keadilan klausul perjanjian, memberikan penyuluhan hukum, serta memastikan adanya kesetaraan hak dan kewajiban. Namun, tantangan seperti dominasi pengembang, lemahnya literasi hukum konsumen, dan keterbatasan pengawasan regulasi seringkali menghambat penerapannya. Oleh karena itu, diperlukan penguatan regulasi, peningkatan kompetensi notaris, dan reformasi sistem perlindungan konsumen untuk menciptakan ekosistem transaksi perumahan yang adil, transparan, dan berkelanjutan.

Abstract

Corruption is an extraordinary crime that not only causes massive state financial losses but also impedes national development. Efforts to eradicate corruption are insufficient if limited to the imprisonment of perpetrators; they must be accompanied by state asset recovery. The prosecutor, as the dominus litis in the criminal justice sistem, plays a central role in the process of seizing assets derived from corruption. This research aims to analyze the authority of prosecutors to seize assets in corruption cases, identify the obstacles encountered, and formulate solutions to optimize the exercise of this authority. The research method employed is normative juridical, utilizing a statutory approach and a case approach. The findings indicate that prosecutors have a strong legal basis for asset seizure, as stipulated in the Criminal Procedure Code (KUHAP), the Anti-Corruption Law, and other relevant regulations. However, in practice, prosecutors face various obstacles, both juridical, such as legal loopholes in the evidentiary process, and non-juridical, such as the complex modus operandi of perpetrators in concealing assets, slow inter-agency coordination, and challenges in tracing assets located abroad. Therefore, it is imperative to strengthen the regulatory framework through the enactment of the Asset Forfeiture Bill, enhance the capacity and integrity of prosecutors, and bolster international cooperation to maximize the recovery of state losses.

Abstract

Although expired Building Use Rights (Hak Guna Bangunan/HGB) have received attention in various agrarian law studies, research that specifically discusses the legal standing of the Deed of Sale and Purchase (Akta Jual Beli/AJB) as the basis for applying for the renewal of rights after the expiration of HGB remains limited. This study aims to analyze the legal force of an AJB made while the HGB was still valid and to explore legal certainty for AJB holders in applying for the renewal of land rights. This study used a qualitative approach with a normative legal research design. Primary and secondary legal materials were obtained through documentation studies and literature searches of legislation, court decisions, books, and legal journals. The data were analyzed using qualitative analysis techniques with deductive legal reasoning. The results show that an AJB made while the HGB was still valid retains legal force as evidence of the acquisition of rights and physical control over the land, although it can no longer be used as the basis for the transfer-of-name process after the HGB has expired. These findings contribute to the development of agrarian law theory, particularly concerning legal protection for good-faith buyers in land administration practices. The conclusion of this study affirms that good faith, the validity of the AJB at the time it was made, and actual physical control of the land are important factors in applying for the renewal of land rights. The implications of this study include strengthening the literature on land registration law and providing practical recommendations for the National Land Agency (BPN) in formulating a clearer, more consistent, and more equitable administrative mechanism for granting new rights over state land. This study also opens opportunities for further research on socio-legal aspects in the variation of land policy implementation across regions.

Abstract

Although notarial responsibility has received attention in various legal studies, research that specifically discusses notarial negligence in verifying the legal status of expired intellectual property rights, particularly patent rights, remains limited. This study aims to analyze whether a notary can be deemed negligent if they fail to examine the legal status of a lapsed patent right before preparing a deed of transfer and to examine the legal consequences arising from such negligence. This study used a normative legal research method with statutory, conceptual, and analytical approaches. The legal materials used consisted of primary legal materials in the form of Law Number 2 of 2014 concerning Notary Position, Law Number 13 of 2016 concerning Patents, the Indonesian Civil Code, as well as relevant legal regulations and doctrines. The data were analyzed prescriptively using the theory of fault, the theory of legal protection, the theory of negligence, the theory of prudence, and the theory of legal events. The results show that a notary can be deemed negligent if they do not verify the legal status of the patent right that becomes the object of transfer because a notary is required to act honestly, carefully, independently, and with full prudence in carrying out their office. Examining the legal status of a patent right is part of the application of the principle of prudence to ensure that the right being transferred remains valid and can become the object of a legal act. Negligence in such verification has implications for the notary’s legal liability and has the potential to weaken legal certainty in patent right transfer transactions. The conclusion of this study emphasizes the importance of verifying legal status before preparing a deed of transfer of patent rights. These findings provide a theoretical contribution to the development of the literature on notarial law and intellectual property law, as well as practical implications for notaries, legal practitioners, and policymakers in strengthening legal certainty in intangible asset transactions.

Abstract

Although digital transformation in notarial practice has received attention in various previous studies, research that specifically discusses the weaknesses of conventional signatures and the feasibility of digital signatures as their replacement from the perspective of progressive law remains limited. This study aims to analyze the weaknesses of conventional signatures in the preparation of notarial deeds and to assess the feasibility of digital signatures as an alternative replacement based on the perspective of progressive law. This study used a normative juridical method with statutory and conceptual approaches. Data were collected through library research on primary, secondary, and tertiary legal materials, and then analyzed using descriptive qualitative techniques. The results showed that conventional signatures have fundamental weaknesses. Philosophically, conventional signatures are contrary to substantive justice because they may discriminate against people in remote areas and persons with disabilities. Juridically, conventional signatures are vulnerable to forgery and denial, lack a non-repudiation mechanism, and may lead to the degradation of the legal force of authentic deeds. Sociologically, conventional signatures create structural exclusion and inefficiency in notarial services. Practices in the United States, Germany, France, Belgium, Estonia, and Singapore show that digital signatures have been implemented in notarial systems using varied approaches. These findings contribute to the development of notarial law theory and expand understanding of legal reform in the digital era. The conclusion of this study affirms that regulatory harmonization between the Notary Office Law and the Electronic Information and Transactions Law is an important prerequisite for the implementation of digital signatures in notarial deeds. The implications of this study include theoretical contributions to the development of notarial law literature and practical implications for the government in explicitly revising the Notary Office Law and strengthening the digital infrastructure of notarial practice.

Abstract

Although the use of covernotes in bank credit agreements has become an established practice in Indonesia, studies examining their legal status, legal certainty, and regulatory model remain limited. This study aims to analyze the status of covernotes in bank credit agreements and formulate an ideal regulatory model to ensure legal certainty for the parties. The study employed a descriptive-analytical normative legal method using statutory and conceptual approaches. Legal materials were collected through a literature review and analyzed qualitatively using Gustav Radbruch’s and Jan Michiel Otto’s theories of legal certainty and Hans Kelsen’s theory of legal responsibility. The findings indicate that a covernote has the status of an innominate agreement that is accessory to the principal credit agreement and binds the parties pursuant to Article 1338 of the Indonesian Civil Code. However, its legal certainty remains inadequate because no normative provisions explicitly regulate its status, form, time limit, and legal consequences. This uncertainty is reflected in the differing legal considerations between Supreme Court Decision Number 4242 K/Pid.Sus/2023 and Supreme Court Decision Number 1233 K/Pid.Sus/2019. The ideal regulation of covernotes should be based on the principles of legal certainty, justice, accountability, and proportionality through a three-tier regulatory model, namely the revision of the Notary Office Law, the formulation of comprehensive Financial Services Authority regulations, and the establishment of professional standards by the Indonesian Notary Association. These findings contribute to the development of notarial and banking law studies by clarifying the legal vacuum surrounding the use of covernotes. This study affirms that the normative recognition and regulation of covernotes are necessary to provide legal protection for the parties and serve as a basis for policy formulation by legislators, the Financial Services Authority, and notarial professional organizations.

Abstract

Legal certainty (rechtssicherheit) is a fundamental pillar of the Rule of Law, ensuring that legal provisions are clear, consistent, and predictable. In the Indonesian criminal justice system, the Public Prosecutor holds a central position as the Dominus Litis (the master of the suit), possessing the exclusive authority to determine which cases proceed to court. However, the current implementation of prosecutorial authority often leans towards rigid legal positivism, creating a paradox where procedural certainty is achieved at the expense of substantive justice. Disparities in prosecution demands for similar crimes often lead to public distrust and legal uncertainty for justice seekers. Furthermore, prosecutors often lack the cognitive flexibility to handle complex cases that require discretionary wisdom. This study aims to analyze the challenges in maintaining legal certainty and proposes a strategy to enhance the prosecutor's role through the integration of Restorative Justice and a reform in prosecutorial competency. The research employs a normative juridical method with statutory and conceptual approaches, analyzing Attorney General Regulation No. 15 of 2020. The study finds that enhancing legal certainty requires shifting the paradigm from "mechanical prosecution" to "discretionary prosecution" based on conscience. To achieve this, prosecutors must be equipped with high-level cognitive skills specifically "Creative Thinking" to interpret "certainty" not just as textual compliance, but as the consistent application of fairness.
