Abstract

AbstractIndonesian Competition Commission (KPPU) conducted an initiative case research to the alleged tying-in Rapid Test services agreement in several hospitals. In the research, all hospitals that offer Rapid Test services are the objects of research. KPPU conducts market structure analysis, compliance with the elements of Article 15 paragraph (2) of Law No. 5 of 1999 on Prohibition of Monopolistic Practices and Unfair Competition, and the consequences of implementing closed agreements. Implementing this tying agreement may fall into the investigation category if, in practice, it causes monopolistic practices and or unfair business competition. Analyzing the KPPU's efforts to handle suspected business competition violations committed by hospitals, legal research will use a statutory and conceptual approach. Considering that the tying agreement can actually or potentially hinder business competition, based on KPPU's duties and authorities can enforce the law and advocate for business competition.Keywords: Tying Agreement; Rapid Test; Hospital; KPPU.AbstrakKomisi Pengawas Persaingan Usaha (KPPU) melakukan penelitian perkara inisiatif terhadap dugaan adanya perjanjian tying yang dilakukan sejumlah rumah sakit pada layanan Rapid Test. Dalam penelitian tersebut, seluruh rumah sakit yang menawarkan layanan Rapid Test menjadi objek penelitian, KPPU melakukan analisis struktur pasar, pemenuhan unsur-unsur Pasal 15 ayat (2) Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persainan Usaha Tidak Sehat, dan akibat pelaksanaan perjanjian tertutup. Pelaksanaan perjanjian tying ini dapat masuk kategori penyelidikan jika dalam praktiknya menyebabkan praktik monopoli dan atau persaingan usaha tidak sehat. Dalam menganalisis upaya KPPU menangani dugaan pelanggaran persaingan usaha yang dilakukan rumah sakit, digunakan penelitian hukum melalui pendekatan peraturan perundang-undangan dan konseptual. Mengingat perjanjian tying secara aktual maupun potensial dapat menghambat persaingan usaha, maka KPPU berdasarkan tugas dan wewenangnya dapat melakukan penegakan hukum maupun advokasi persaingan usaha.Kata Kunci: Perjanjian Tying; Rapid Test; Rumah Sakit; KPPU.

Abstract

Pada awalnya dasar kepemilikan atas ruko tidak dimungkinkan sebagai hak milik, karena dianggap hak milik hanya untuk tempat hunian, sedangkan ruko untuk kegiatan usaha. Namun, dalam perkembangannya ruko juga dimungkinkan sebagai hunian. Hal ini dianggap bertentangan dengan landasan filosofis adanya hak milik yang notabene hanya untuk hunian. Berdasarkan latar belakang tersebut, maka rumusan masalah di dalam artikel ini adalah pertama karakteristik hak milik di Indonesia dan kedua karakteristik hak milik terhadap rumah toko. Metode penelitian di dalam artikel ini adalah penelitian hukum dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus. Adapun hasil dari artikel ini adalah pertama Adapun karakteristik hak milik di Indonesia adalah turun temurun, terkuat, dan terpenuh. Kedua, selaras dengan teori legal evolution dalam konsep hak milik atas tanah dan bangunan ruko di Indonesia, maka kepemilikan atas ruko dapat berupa hak milik dengan syarat: (1) tanah dan bangunan tersebut memiliki izin pendirian sebagai rumah tinggal sekaligus untuk tujuan komersial yang berupa pertokoan; (2) Hak Guna Bangunan atau Hak Pakai masih berlaku atau telah berakhir; dan/atau (3) atas nama pemegang hak yang masih hidup atau meninggal dunia.

Abstract

AbstractThe law will continue to develop to achieve justice. In social life, the Indonesian National Police is essential in ensuring security and order, including demonstrations by certain groups of people. Indonesia, as a democratic country, absolutely guarantees the existence of public opinion, namely freedom of speech, freedom of the press, intellectual freedom, and freedom of religion, as stated in Article 28E paragraph (3) of the 1945 Constitution of the Republic of Indonesia and detailed in other laws and regulations. Departing from the issue of violence in demonstrations, we will discuss the legal urgency of granting constitutional rights to demonstrations, the status and criminal responsibility of the Indonesian National Police in security and state order. The inconsistency in the recognition of constitutional rights at demonstrations can be seen in the criminal sanctions for the Indonesian National Police who commit acts that violate the law that have not been applied strictly and proportionately.Keywords: Rally; Constitutional Rights; Human Rights; Criminal Liability; The Indonesian National Police. AbstrakHukum akan terus berkembang untuk mencapai suatu keadilan. Dalam kehidupan sosial bermasyarakat, Kepolisian Republik Indonesia memegang peranan penting untuk menjamin keamanan dan ketertiban salah satunya aksi unjuk rasa yang dilakukan oleh sekelompok orang tertentu. Indonesia sebagai negara demokrasi secara absolut menjamin eksistensi pendapat umum yakni kebebasan berbicara, kebebasan pers, kebebasan intelektual, dan kebebasan beragama sebagaimana Pasal 28E ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan diperinci dalam peraturan perundang-undangan lainnya. Berangkat pada isu kekerasan dalam aksi unjuk rasa, akan dibahas urgensi hukum pemberian hak konstitusi pada unjuk rasa, kedudukan dan pertanggungjawaban pidana Kepolisian Republik Indonesia dalam keamanan dan ketertiban negara. Inkonsistensi pengakuan hak konstitusi pada unjuk rasa nampak pada sanksi pidana bagi POLRI yang melakukan perbuatan melanggar hukum yang belum diterapkan secara tegas dan proporsional.Kata Kunci: Unjuk Rasa; Hak Konstitusi; Hak Asasi Manusia; Pertanggungjawaban Pidana; Kepolisian Negara Republik Indonesia.

Abstract

Indonesia, as a nation where foreign space objects are discovered, holds the right to seek compensation, thereby addressing the country's claims to reinstate pre-damage conditions. Under international regulations, any country launching objects into outer space from its territory or launch facilities assumes responsibility for damages incurred in other nations. This research employs a qualitative legal research methodology, employing both statutory and conceptual approaches. The statutory method scrutinizes laws pertinent to the identified legal concerns. The primary sources encompass the 1967 Treaty on the Principles Governing State Activities in Space Exploration and Utilization, including the Moon and Celestial Bodies, and Indonesia's Law Number 16 of 2002, Gazette Number 34 of 2002, Supplement State Gazette No. 4195. The study's findings highlight that the 1968 Rescue Agreement broadened a state's obligations concerning astronaut rescue, recovery, and repatriation, extending these responsibilities to encompass the return of space objects for exploration purposes. The repatriation of foreign space objects mandates compensation for any damage resulting from the descent of celestial bodies. Therefore, Indonesia, under international legal frameworks, can pursue restitution for damages caused by space objects from other nations, ensuring accountability and restoration of affected conditions.

Abstract

The importance of the bank in applying the precautionary principle contributes to ensuring a sound banking system and protecting the country’s economy. In lending, the precautionary principle was manifested in a standard agreement between the bank as the creditor and the customer as the debtor. Credit agreements can lead to disputes, where the debtor sues the bank for violating the principle of consumer protection because it applies standard clauses in the credit agreement. The research method used is legal research with a statute approach and a conceptual approach). The results state that the application of the precautionary principle in making standard agreements manifests itself in the prohibition of financial service business actors including exoneration clauses to the detriment of financial service consumers as stipulated in Article 18 paragraph (1) of the Consumer Protection Act and OJK Regulation No. 6/POJK.07/Tahun 2022 concerning Consumer and Community Protection in the Financial Services Sector.
