Abstract

Pengadaan tanah untuk pembangunan adalah untuk kepentingan umum Kegiatan Pengadaan Tanah Ditentang Pembayaran Kompensasi Kepada mereka yang membebaskan tanah, bangunan, tanaman dan hal-hal lain dalam kaitannya dengan tanah. Kegiatan tersebut seringkali menimbulkan masalah di masyarakat ketika sengketa pengadaan tanah sering disebabkan untuk kepentingan umum Karena ketidaksepakatan dalam menentukan harga kompensasi termasuk yaitu Diwajibkan oleh para pihak, baik ditentukan oleh pemerintah Penetapan harga sepihak, dan penerima manfaat properti Ini tidak adil. itulah dasarnya menulis makalah untuk memperbaiki masalah sehingga tidak terjadi lagi Masalah Pengadaan Tanah Untuk Kepentingan Umum, Maka Harus Jenis, dasar, dan metode keputusan kompensasi internal diketahui Pengadaan tanah untuk kepentingan umum

Abstract

Peralihan hak atas tanah merupakan peristiwa hukum beralihnya hak kepemilikan atas tanah dari satu pemegang hak kepada yang dialihkan atas hak tersebut. Peralihan hak termasuk dalam tindakan hukum yang diadakan secara sengaja dengan maksud supaya hak atas tanah beralih dari yang mengalihan hak kepada penerima hak. Dalam hal ini yang termasuk sebagai bentuk peralihan hak atas tanah antara lain seperti jual beli tanah, perwakafan tanah, dan pewarisan tanah, serta penghibahan tanah. Dalam perkembangannya, saat ini banyak transaksi jual beli sebagai bentuk peralihan hak atas tanah yang mana oleh masyarakat tidak dilakukan do hadapan PPAT. Jual beli tersebut hanya dihadapkan pada Kepala Kecamatan/Desa belum ditunjuk sebagai PPAT. Sementara itu jual beli akan dinyatakan sah bila mana terjadi atau dilakukan di hadapan PPAT, yang selanjutnya akan diterbitkan akta sebagai bukti autentiknya.1 Ketika jual beli tidak dilakukan dihadapan PPAT maka tidak dapat diterbitkan aktanya. Hal ini menimbulkan pertanyaan yuridis yakni apakah transaksi tersebut dapat dikatakan sah menurut hukum

Abstract

The issuance of MUI Fatwa number 83 of 2023, addressing the Law and Support for the Palestinian Struggle, has elicited diverse reactions from the public. Some view it as a means of expressing solidarity with the Palestinian people's struggle against colonialism. In contrast, others harbor skepticism due to potential negative repercussions, especially for Muslim families targeted by the fatwa. Consequently, this study aims to assess the support of Muslim families for MUI Fatwa No. 23 of 2023, particularly those directly impacted and unaffected by the fatwa. Employing a quantitative-qualitative method, this research uses psychological and philosophical approach by utilizing attitude and Maqashid theory. The research utilized a Likert scale measuring support for the MUI fatwa, validated and tested for reliability. The scale was administered through the Google Form application in an online distribution. The study involved 176 Muslim families, encompassing both those affected and unaffected by the fatwa. Overall, the findings indicate a moderate level (mean 62,81). It covered 35,8% of the respondent's support for the MUI fatwa among Muslim families. Post hoc analysis revealed a significantly higher mean for the affective aspect (3.94) compared to the cognitive (3.75) and behavioral aspects (3.65), emphasizing the emotional nature of the support. Furthermore, a comparison of support between affected (64.02) and unaffected (62.3) families revealed an insignificant difference (p-value 0.152 > 0.05). In the perspective attitude theory, the Muslim family's response to the MUI fatwa falls within the moderate range and leans towards an emotional rather than cognitive and behavioral inclination. In the Maqashid perspective, they tend to fight for the value of human protection (hifdh an-nafs) for themselves and their families. On the one hand they also condemn Israel's crimes against Palestinians. Here it can be stated that their attitude and legal consciousness in the cognitive aspect is not comparable to the practical aspect.

Abstract

The enactment of Law of the Republic of Indonesia Number 33 of 2014 concerning Halal Product Assurance, so that the submission of halal certification by producers is mandatory. The provisions regarding the obligation of halal certification for all products are stated in Article 4 which states that: "Products entering, circulating and traded in the territory of Indonesia must be halal certified". The enactment of this Law is 5 years from the time the Law is enacted. So, in 2019 is the time for the implementation of the regulation which results in all products, including food products, having to be halal certified. Therefore, this study aims to analyze the contribution of the Indonesian Ulema Council (MUI) of East Java Province in developing the halal industry through the role of the MUI Fatwa Commission during the period 2022-2024. In this context, this study explores how the two institutions influence the development of the halal industry in East Java, especially in terms of issuing halal fatwas, product certification, and empowerment and assistance to industry players, including Micro, Small and Medium Enterprises (MSMEs). The method used in this study is the Asset-Based Community Development (ABCD) approach. Data collected through literature and field studies, namely data sources obtained from interview research on the elite of the East Java MUI, community leaders and business actors. The results of the study indicate that the MUI Fatwa Commission has a strategic role in providing a legal basis and fatwa that serves as a guideline for the community and industry players in ensuring that their products are in accordance with Islamic law principles. On the other hand, LPPOM MUI functions as an institution that manages the halal certification process, provides education and training for business actors, and supervises products that have been halal certified.However, this study also identified a number of challenges faced in efforts to develop the halal industry in East Java, such as the limited number of trained halal auditors, the high cost of certification for SMEs, and the lack of public understanding regarding the importance of halal products. However, MUI's contribution to developing the halal industry in East Java has proven significant, both in improving the quality of halal products and in strengthening the competitiveness of local industries in national and international markets. The suggestion from this assistance is for the MUI of East Java Province to increase human resource capacity, simplify halal certification procedures for SMEs, and strengthen socialization programs to the community about the importance of choosing halal products. Thus, it is hoped that the halal industry in East Java can develop more rapidly and provide a positive impact on the regional economy and the welfare of the people.
