Abstract

Saat ini banyaknya warga negara yang terjerat kasus hukum, menggunakan pintu pengujian undang-undang kepada Mahkamah Konstitusi sebagai wujud upaya hukum yang dapat dilakukan oleh warga negara ketika hak konstitusionalnya dilanggar. Hal demikian terjadi karena didalam Pasal 24C ayat (1) UUD NRI Tahun 1945 masih belum mewadahi suatu pengaturan mengenai pertanyaan konstitusional (constitutional question). Tujuan dari penelitian ini adalah menganalisis bagaimana bentuk pelaksanaan kewenangan Mahkamah Konstitusi dalam menjalankan fungsinya sebagai The Protector of Citizen’s Constitutional Rightsserta urgensi penerapan Constitutional Question di Indonesia, sementara yang kedua adalah mengenai bagaimana mekanisme Implementasi Constitutional Question dan prospek pengaturan yang tepat pada Mahkamah Konstitusi Republik Indonesia kedepan. Darihasilpenelitiandisimpulkansebuah kewenanganMahkamahKonstitusi Republik Indonesia untuk menerapkan mekanisme Constitutional Question secara legal formal dengan mengatur dan menambahkan mekanisme constitutional question ke dalam UU MK,dengan meletakkannya sebagai bagian dari kewenangan Mahkamah Konstitusi dalam menguji undang-undang terhadap UUD sebagaimana dimaksud oleh pasal 24C Ayat (1) UUD 1945.

Abstract

The national land law structure in force in Indonesia does not mention and does not prohibit the sale and purchase of customary land rights. The fact in customary law has conditions that must be met regarding the transfer of the sale of customary land rights. If it does not meet the requirements, then buying and selling rights to customary land is said to be a deviation regarding the objectives contained in the customary order. Formulation of the first problem, why the legality of buying and selling rights over customary land of the Malay tribe in Dharmasraya Regency, West Sumatra Province. Second, what is the form of transfer of customary land rights according to customary law and national land law in Dharmasraya Regency and what kind of government legal policy is capable of providing protection to customary community rights relating to customary land rights? This paper is the result of research using the Socio Legal Research method that uses primary data and secondary data is a source of questions with the collection techniques carried out by observation and interviews equipped with literature studies and analyzed descriptively prescriptive. The results of the study found a deviation regarding the substance of the transfer of title to the Malay customary land. One of the factors is the undeniable development of the age related to economic survival without thinking about the common rights inherent in customary land. The conclusion is that the customary land is a common right of the customary law community. The meaning of collective rights here is not owned by individuals, ?ninik mamak? or customary leaders only. Therefore, the sale and purchase of customary land rights must be returned in accordance with customary law norms attached to the customary law community itself. So that the existence of customary land is maintained in the days to come and is not eroded by time. The future legal politics of the government pays attention to the existence of customary land and recognizes the customary community's customary land to be poured in the form of an authentic deed and poured in the form of a Regency / City Regional Regulation in terms of the transfer of customary rights to other parties, especially investors.

Abstract

Abstract Since the prevailing of Act No. 32 of 2004 there has been a change in filling the position of head of region, which was originally made ​​by Parliament to be a direct election by the people. In a direct local elections, there are several systems in use, the system of one round (first past the post system), system of two rounds (two round system), and mixed systems (preferential vote). Where each system has its advantages and disadvantages, because there is no one perfect system. However if desired the local elections are  more effective and efficient, then the mixed system (preferential vote) is considered more appropriate, because with only one round is to ensure the legitimacy of the people, saving cost, implementation time is not long, post-election political climate quickly subsided, and the local people can quickly find out who the head region is, so that the immediate implementation of the government and the wheels of government running normally again. Keywords : effective, efiesien, and democratic election system.   Abstrak   Sejak berlakunya UU Nomor 32 Tahun 2004 telah terjadi perubahan dalam pengisian jabatan kepala daerah, yang semula dilakukan oleh DPRD menjadi pemilihan langsung oleh rakyat.Pada pemilihan kepala daerah langsung terdapat beberapa sistem yang digunakan, yaitu sistem satu putaran (first past the post system); sistem dua putaran (two round system), dan sistem campuran (preferential vote). Masing-masing sistem memiliki kelebihan dan kelemahan, karena tidak ada satu system pun yang dapat berlaku sempurna. Namun demikian apabila dikehendaki adanya pemilihan kepala daerah yang lebih efektif dan efisien, maka sistem campuran (preferential vote) dinilai lebih sesuai, karena dengan satu putaran saja sudah menjamin legitimasi rakyat, penghematan biaya, waktu pelaksanaan tidak lama, suhu politik pasca pemilukada cepat mereda, dan rakyat daerah secara cepat dapat mengetahui siapa kepala daerahnya, sehingga pelaksanaan pemerintahan segera berjalan dan roda pemerintahan normal kembali. Kata kunci : sistem pemilukada yang efektif, efiesien dan demokratis.

Abstract

Rights to Citizenship must be protected because it is the basis to be able to access the other rights. Rights to citizenship of migrant workers in Nunukan District is potentially expired and lost if they do not renew their passports. The same case may occur with illegal migrant workers who stay for 5 years abroad. This article aims to analyze the potential of stateless person in Nunukan District, the effort made by the government to handle the issue, and the ideal construction of legal protection for stateless person. This study applied socio legal approach using primary and secondary data which were collected through interview, observation, and in depth interview. Those data then were analyzed qualitatively. Based on the analysis, it is concluded that: (1) the potential of being stateless person in Nunukan District occurred in migrant workers whose passports were expired for more than 5 years, irregular migrant workers who stayed abroad for more than five years, the descendants or children of migrant workers who were born and were raised in Malaysia; (2) the government prevents the occurrence of stateless person: (a) integrated management of handling migrant workers; (b) sweeping in order to prevent irregular migrant workers; (c) simplifying the issuance of Letter of Arrival of Indonesian Citizen (SKDWNI) and Letter of Overseas Arrival (SKDLN); (3)ideal construction of the protection of right to citizenship  for migrant workers is the extension of the scope of migrant workers protection agreement, and the placement of Citizenship and Civil Record Agency officers in order to make the paperwork handling of citizenship document easier.

Abstract

This study provides a comparative analysis of the mechanisms for settling election disputes in Indonesia and South Africa, focusing on transparency, accountability, effectiveness, and efficiency. Despite notable democratic advancements, both nations continue to grapple with challenges that could undermine the legitimacy of electoral outcomes and democratic stability. The research investigates how transparent and inclusive these mechanisms are, the extent of public scrutiny, and the accountability measures in place for responsible parties. It also assesses the timeliness of dispute resolution, enforceability of decisions, and their overall impact on electoral integrity and legitimacy. Key findings highlight the roles of Indonesia's Bawaslu and South Africa's IEC in ensuring openness and public participation while identifying political interference, resource constraints, and procedural complexities as significant challenges. The study further explores best practices such as engaging civil society, simplifying procedures, and adopting technology to enhance dispute resolution mechanisms. Through this analysis, the research contributes to the understanding of electoral governance and offers policy recommendations to strengthen democratic institutions in Indonesia and South Africa.

Abstract

The Constitutional Court often uses a positive legal approach, and some of the decisions it produces do not contain substantive justice. In its development, the Constitutional Court began to face a new paradigm as an institution for interpreting the constitution and began to use a progressive legal approach. This study aims to examine the application of a positivist legal approach and the urgency of using the progressive legal approach in the law review process. This research is normative legal research. Based on the results of this research, the Indonesian legal system is designed to accommodate human interests and needs through progressive legislation. The Constitutional Court, through a progressive legal approach, can issue decisions that fulfill substantive justice. This research is used in several cases, such as the heart article decision, ultra petite, and open legal policy. It can be concluded that through a progressive legal approach, it is a challenge for judges to guard the constitution through judicial review and an opportunity to prove that the Constitutional Court is an institution that prioritizes the constitutional rights of the people. In addition, the Constitutional Court can restore its spirit as the guardian of the constitution and democracy.
