Abstract

Tindak pidana pembunuhan dan penganiayaan yang menimbulkan kematian mempunyai kesamaan yang pada akhirnya berujung pada hilangnya nyawa korbannya. Dalam KUHP (selanjutnya disingkat KUHP), kedua tindak pidana tersebut diatur dalam bab yang berbeda, meskipun sama-sama tercantum dalam Buku II KUHP. Untuk dapat membedakan perbuatan-perbuatan tersebut harus didasarkan pada unsur kesengajaan atau yang dalam hukum pidana disebut dengan opzet. Pembunuhan mengharuskan hilangnya nyawa korban sejak awal, sedangkan penganiayaan hanya bertujuan untuk membuat korban merasakan sakit, akibat kematian korban tidak termasuk unsur rasa bersalah. Abstract

Guilt is one of the fundamental principles in criminal law, which states that a person cannot be punished in the absence of guilt. A person is considered guilty if their inner attitude can be regretted for committing an unlawful act. The concept of guilt is a juridical concept, not a moral or social concept. Determining sanctions for someone who does not intentionally commit a criminal act, of course, will be different from someone who does it intentionally. Therefore, in imposing sanctions must look at the inner attitude or intention of the perpetrator. The research method used is normative juridical, with a statutory approach, as well as legal doctrines to answer the problems that occur and in order to produce new arguments, theories or concepts as a basis for solving the problems at hand.

Abstract

Corruption runs rampant in Indonesia, hindering progress, yet restorative justice promises a fair and sustainable solution to address this issue. This research aims to explore the application of restorative justice in tackling corruption in Indonesia. Utilizing a normative legal research method, the study highlights the challenges faced by restorative justice, such as difficulties in identifying victims and disagreements regarding restitution. The findings suggest that strengthening the norms of state restitution as the primary penalty and establishing recovery mechanisms are essential to bolster restorative justice. The conclusion drawn from this research is that implementing restorative justice in corruption cases allows victims to receive direct compensation from perpetrators, enhances accountability, and reduces the burden on the judicial system by resolving cases outside of court. This research is expected to serve as an effective instrument in combating corruption and rebuilding public trust in the justice system.
