Abstract

Background, The requirement for halal certificates for Micro, Small, and Medium Enterprises (MSMEs) is articulated in the Halal Product Guarantee Law, the Consumer Protection Law, the Job Creation Law, and Government Regulations concerning the Implementation of the Halal Product Guarantee Sector. This is facilitated by the provision of a complimentary halal certificate policy from BPJPH, aimed at enhancing consumer protection through MSME products, ensuring their health, comfort, and safety are assured. Aim, This study seeks to assess the efficacy of compulsory halal certification regulations for MSMEs in the Pekiringan and Sunyaragi subdistricts. Methods, The employed research approach is empirical juridical, focusing on the existing laws within society, particularly with the enforcement of mandatory halal certificate restrictions in the two sub-districts. Results, The MSME actors sampled in this study refrain from acquiring halal certificates due to apprehensions regarding the associated high expenses and also believe that the process of issuing halal certificates will incur a significant tax burden after the halal certificate is issued. Conclusions, The research findings on MSMEs in Pekiringan and Sunyaragi Subdistricts indicate that the enforcement of mandatory halal certification regulations is ineffective, as numerous MSME operators remain uncertified due to concerns over high costs and subsequent taxation following the issuance of the halal certificate. Implication, The effectiveness of halal certification regulations for MSME operators in consumer protection efforts is lacking, considering they are apprehensive about the costs involved during and after halal certification.

Abstract

Abstract: Background. The Sale and Purchase Binding Agreement (PPJB) serves as a binding preliminary agreement between the seller and the buyer before the Sale and Purchase Act (AJB) is drafted by the Land Deed Making Office (PPAT). Aims. Transferring land rights requires registration at the National Land Agency (BPN) to ensure legal certainty. Problems can arise if the fulfillment of rights and obligations does not accompany fulfilling the rights contained in the PPJB. This can result in the inability to make an AJB by PPAT to change the certificate's name to the land office where the object is located. Methods. The juridical normative method used requires both primary and secondary data. Primary data is obtained from the study location, the Notary Office & PPAT Budi Aripin, S.Sos, S.H, M.Kn. In contrast, secondary data is obtained from literature. Result. The results of his research show that the function of the deed made by the Notary is to provide legal certainty and guarantee the right to land ownership, as well as evidence that legal acts have been carried out, and the factors that hinder the transfer of land rights through sale and purchase. Conclusion. A binding sale and purchase agreement is a form of preliminary agreement. Therefore, it can be used as a basis for making an AJB and serves as a document or evidence to complete the registration requirements for the transfer of land rights due to the sale and purchase transaction. Implementation. However, implementing all the conditions agreed to in this agreement can take quite a long time. This can prevent potential sellers from signing the AJB.

Abstract

Tujuan penelitian ini untuk menganalisis salah satu faktor penyebab perceraian di Indonesia. Akibat dari hubungan perkawinan tidak didasari perasaan cinta mencintai, dimungkinkan terjadinya permasalahan sebagaimana adanya pihak ketiga maupun konflik rumah tangga yang sulit diselesaikan yang akan menimbulkan masalah putusnya perkawinan dengan cerai. Jika terdapat hal-hal tertentu dalam hubungan perkawinan yang tidak bisa didamaikan oleh kedua belah pihak dan menimbulkan suatu kemudharatan, maka perceraian merupakan solusi untuk menghindari hal tersebut. Penelitian ini merupakan penelitian normatif yuridis, data diperoleh dari studi pustaka terdiri dari bahan primer dan sekunder sebagai bahan hukum utama. Hasil penelitian bahwa kewajiban cinta mencintai yang diatur didalam Undang-Undang Perkawinan (UUP) merupakan aspek yang penting dalam perkawinan, cinta merupakan pondasi utama untuk membentuk rumah tangga yang abadi dan kekal sebagaimana tujuan dari UUP. Namun, cinta mencintai tidak dapat dijadikan salah satu syarat alasan utama pengajukan perceraian. Beberapa putusan pengadilan juga tidak menjadikan Pasal 33 sebagai dasar pertimbangan putusan hakim dalam suatu gugatan perceraian, karena Pasal 33 merupakan dasar tujuan perkawinan yang harus dijalankan suami isteri. Sedangkan, apabila suami isteri mengajukan gugatan ke Pengadilan, harus terdapat alasan kuat sebagai dasar dari akibat tidak saling mencintai yang mengakibatkan perselisihan dan tidak akan hidup rukun Kembali sebagaimana dijelaskan syaratnya dalam UUP.
