Abstract

Pesatnya pertumbuhan ekonomi Indonesia saat ini dibarengi dengan semakintingginya kebutuhan masyarakat akan fasilitas kendaraan khususnya kendaraanbermotor. Saat ini, Indonesia menjadi sasaran empuk produsen motor untukmemasarkan produknya, karena indonesia merupakan salah satu negara yangkomsumtif dan konsumen kendaraan motor terbesar di dunia.. Tidak mengherankanjika lembaga pembiayaan berkembang pesat di Indonesia. Jika pada zaman dahulu,orang yang menginginkan kendaraan bermotor harus menabung dulu, maka dizaman sekarang ini, orang bisa mendapatkan kendaraan bermotor khususnya motorhanya dengan Rp. 500.000 - 1.000.000 sebagai Down Payment (DP) atau uangmuka untuk mendapat sepeda motor. Penulisan penelitian ini bertujuan untukmenkaji dan menganalisis penegakan hukum akibat keterlambatan pendaftaranjaminan fidusia berdasarkan PMK no 130/PMK.010/2012. Penelitian inimenggunakan metode penelitian kualitatif deskriptif. Terdapat pengaturan barutentang kewajiban bagi penerima fidusia atau wakilnya untuk memberitahukanpenghapusan jaminan fidusia. Tidak dikenakan biaya jika melakukan penghapusan,dengan adanya kebijakan ini maka diharapkan penerima fidusia atau wakilnyadapat melaksanakan pemberitahuan penghapusan jaminan fidusia dengan sukarela.Hal ini memudahkan Kemenkunham untuk melakukan kontroling terhadap jaminanfidusia yang sudah berakhir.Kata Kunci: Penegakan Hukum, Jaminan Fidusia.

Abstract

Background, The requirement for halal certificates for Micro, Small, and Medium Enterprises (MSMEs) is articulated in the Halal Product Guarantee Law, the Consumer Protection Law, the Job Creation Law, and Government Regulations concerning the Implementation of the Halal Product Guarantee Sector. This is facilitated by the provision of a complimentary halal certificate policy from BPJPH, aimed at enhancing consumer protection through MSME products, ensuring their health, comfort, and safety are assured. Aim, This study seeks to assess the efficacy of compulsory halal certification regulations for MSMEs in the Pekiringan and Sunyaragi subdistricts. Methods, The employed research approach is empirical juridical, focusing on the existing laws within society, particularly with the enforcement of mandatory halal certificate restrictions in the two sub-districts. Results, The MSME actors sampled in this study refrain from acquiring halal certificates due to apprehensions regarding the associated high expenses and also believe that the process of issuing halal certificates will incur a significant tax burden after the halal certificate is issued. Conclusions, The research findings on MSMEs in Pekiringan and Sunyaragi Subdistricts indicate that the enforcement of mandatory halal certification regulations is ineffective, as numerous MSME operators remain uncertified due to concerns over high costs and subsequent taxation following the issuance of the halal certificate. Implication, The effectiveness of halal certification regulations for MSME operators in consumer protection efforts is lacking, considering they are apprehensive about the costs involved during and after halal certification.

Abstract

This study examines the application of due process of law in cyberbullying cases committed by children at the investigation stage. Using a normative juridical method, the paper evaluates the legal protection framework, particularly in the absence of specific cyberbullying regulations. Key findings reveal legal uncertainty, lack of digital evidence capacity among law enforcement, and the use of cumulative charges ignoring restorative justice principles. The study contributes to legal scholarship by emphasizing the need for regulatory harmonization and increased competence in handling digital crimes, advocating for a child-centered approach to justice in the digital era.

Abstract

A franchise agreement is one aspect of legal protection for the parties from acts that harm other parties. An exclusive agreement is an agreement to enter into an exclusive agreement that can result in hindering or hindering other business actors from entering into the same agreement. The purpose of writing this scientific paper is to find out how the implementation of Mixue franchise agreements according to Government Regulation No. 42 of 2007 concerning Franchising and Law No. 5 of 1999 concerning the Prohibition of Monopoly Practices and Unfair Business Competition. The research method used in this scientific paper uses empirical juridical abbreviations, using primary and secondary data, which are then analyzed using descriptive qualitative analysis. This study's results show that the Mixue franchise agreement implementation in Cirebon Regency is guided by Chapter 5 of Government Regulation No. 42 of 2007 concerning Franchise. However, suppose you look at Chapter 15 of Law No. 5 of 1999 concerning the Prohibition of Monopoly Practices and Unfair Business Competition in the Mixue franchise agreement. In that case, some practices cause monopolies and unfair business competition.
