Abstract

In the law enforcement against perpetrators of criminal acts of terrorism, protection of human rights must be prioritized even though the act constitutes an extraordinary crime which must be condemned regardless of the reasons and motives. The principle of presumption of innocence must also be upheld because the principle of presumption of innocence is a norm or rule that contains provisions that must be implementedby law enforcement officials to treat a suspect or defendant like an innocent person even though the evidence indicates the fault of a suspect or defendant. In the application of the presumption of innocence principle, law enforcers must really be able to implement it even though sometimes in the field implementation there are pro and contra when making decisions to take action against terrorists. Therefore, it is necessary to optimize law enforcement based on the presumption of innocence, both as stated in the Criminal Procedure Code (KUHAP) and the terrorism law so that law enforcement can prioritize the presumption of innocence and can avoid abuse of authority by law enforcement.

Abstract

Data  dari konselor Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A) Jawa Barat, menunjukan  angka kekerasan dalam rumah tangga (KDRT) di Jawa Barat masih tinggi.  Dalam satu tahun P2TP2A bisa menangani lebih dari 100 kasus. jumlah tersebut bisa lebih banyak, disebabkan sampai saat ini masih banyak korban KDRT yang tidak berani melapor. Hal ini menjadi keprihatinan masyarakat dan pemerintah daerah Jawa Barat, karenanya yang menjadi permasalahan adalah bagaimana pemberian perlindungan kepada korban KDRT di wilayah kajian yaitu Bandung, Sukabumi, Indramayu, Cimahi dan Garut. Dengan menggunakan data sekunder dan ditunjang data primer serta menggunakan teori mengenai pelayanan korban, dimana pelayanan korban dengan cara melakukan aktifitas-aktifitas yang dilakukan dalam rangka respon terhadap viktimisasi dengan maksud untuk mengurangi penderitaan dan memfasilitasi pemulihan korban.  Termasuk dalam aktifitas pelayanan korban adalah memberikan informasi, melakukan tindakan/ pemeriksaan, melakukan intervensi individual, terlibat dalam advokasi sosial, mengajukan kebijakan publik dan bekerja di dalam program-program pengembangan perlindungan untuk korban. Dengan model serivice model, yang telah dilakukan oleh Pemerintah daerah Jawa Barat, antara lain adalah: 1).layanan kesehatan; 2).layanan rehabilitasi sosial (pendampingan korban dilingkungan keluarga dan masyarakat, pemulihan kejiwaan korban;  3). Psikologis; 4). layanan rehabilitasi dan reintegrasi terhadap korban kekerasan; 5).pendampingan hukum.Pelaksanaan service model tersebut dilaksanakan dengan memberdayakan P2TP2A bekerja sama dengan unsur Pemerintah Daerah; akademisi; ahli hukum; psikolog; psikiater; tokoh agama; dan unsur masyarakat dimasing-masing daerah kajian.Kata kunci: Pemberian Perlindungan Hukum Terhadap Korban KDRT Di daerah Jawa Barat (Kajian daerah:   Bandung, Sukabumi, Cimahi, Indramayu dan Garut).

Abstract

ABSTRAKPerbuatan menggunakan jasas pekerja sek komersial adalah suatu pelanggaran dan dapat dikenakan sanksi. Tema Pengabdian kepada masyarakat ini, menjadi kompleks apabila dilakukan melalui online. Dengan cara memesan orang yang menjajakan diri. Dengan melakukan penyuluhan dan posbakum, dapat diketahui tingkat kesadaran masyarakat terhadap perbuatan yang terjadi disekitarbnya. Metode penyuluhan dan posbakum dilakukan, serta menyebarkan angket untuk mendapatkan masukan tentang peserta, yang merupakan masyarakat. Di daerah-daerah Indonesia, banyak terdapat peraturan daerah yang melarang melakukan perbuatan memakai jasa PSK. Ancamannya merupakan penjatuhan sanksi pidana kurungan dan denda.Peserta merespon dan menyadari perbuatan yang dilarang dengan sanksi yang berupa kurungan atau denda. Kata kunci:  Sanksi, Pemakai jasa prostitusi online.

Abstract

Seringkali perempuan menjadi korban kekerasan dalam rumah tangga. Kekerasan Dalam Rumah Tangga yang kerap dialami oleh perempuan baik istri maupun anak perempuan bahkan pula dialami oleh asisten rumah tangga dari tahun ke tahun mengalami peningkatan presentasinya. Menurut UU No 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga Pasal 1 (1) dalam Bab Ketentuan Umum, Kekerasan dalam Rumah Tangga didefinisikan sebagai setiap perbuatan terhadap seseorang terutama perempuan, yang berakibat timbulnya kesengsaraan atau penderitaan secara fisik, seksual, psikologis, dan/atau penelantaran rumah tangga termasuk ancaman untuk melakukan perbuatan, pemaksaan, atau perampasan kemerdekaan secara melawan hukum dalam lingkup rumah tangga. Dari definisi tersebut Adanya peningkatan presentasi kejadian kekerasan dalam rumhan tangga terhadap perempuan tentunya memerlukan upaya penanganan yang tepat dalam rangka pemberian perlindungan terhadap perempuan korban kekerasan dalam rumah tangga. Penelitian ini bertujuan mengetahui gambaran tindakan yang diambil oleh pihak-pihak yang terkait dalam penanganan korban perempuan kekerasan dalam rumah tangga dalam rangka pemberian perlindungan terhadap perempuan korban kekerasan dalam rumah tangga. Hasil dari pada penelitian pemberian perlindungan terhadap perempuan korban kekerasan dalam rumah tangga menunjukkan bahwa Penanganan korban kekerasan terhadap perempuan melalui lembaga layanan rujukan berupa Rumah Aman telah sesuai dengan Standar Operasional Prosedur (SOP) yang ada tetapi masih belum optimal. Upaya untuk meningkatkan kualitas layanan Rumah Aman oleh Pemerintah Daerah di antaranya dengan memberikan tenaga konselor serta mulai menggerakkan ruang pemberdayaan bagi penghuni Rumah Aman di Kota Semarang sehingga kualitas layanan Rumah Aman dapat meningkat dan mampu memenuhi kebutuhan korban kekerasan perempuan di dalamnya. Abstract

One of the problems that sometimes arises in the law enforcement process in the eradication of corruption crimes is the problem related to determining the status as a witness for cooperating perpetrators or justice collaborators in solving a corruption case. The existence of several problems stemming from the inequality of understanding or not having unification of policies in determining the status of the perpetrator as a cooperating perpetrator witness or justice collaborator along with the benefits arising from the determination of the cooperating perpetrator witness or justice collaborator certainly creates legal uncertainty and also does not provide benefits or utility for the party who is determined as a cooperating perpetrator witness or justice collaborator. The reconstruction of the policy of establishing appropriate legal norms aims to regulate the recognition or recognition and understanding or perception of the same legally regarding the determination of the status of cooperating perpetrator witnesses or justice collaborators that apply from the examination stage at the investigation level to the examination stage at the court level even up to the implementation of its execution in order to create the principle of legal certainty for the Defendant who is designated as cooperating perpetrator witnesses or justice collaborators.

Abstract

The Central Government's policy for Papua has been periodically carried out since the integration of Papua until the enactment of Law No. 21 of 2001 concerning Special Autonomy for the Papua Province. However, since the 20th anniversary of the implementation of Law Number 2 of 2021, the second amendment to Law Number 21 of 2001 concerning Special Autonomy for the Papua Province, has so far not had a significant impact on development in Papua. The purpose of the research in this paper is to find out and analyze how legal political policies are to resolve conflicts. The research method that will be used in this study is a qualitative method, namely describing the facts with primary secondary and tertiary legal materials. This is caused by the various roots of the Papuan conflict that have not been resolved until now. Various policies under the Papua Special Autonomy Law and regulations in the form of Presidential Instructions, Presidential Regulations, Perdasi, Perdasus and sectoral regulations were issued using the Welfare Approach and the Security Approach model. However, it still does not have an impact, especially for the Indigenous Papuans (OAP) and does not reduce violent conflicts in the Land of Papua. The purpose of this study is to find out and analyze how legal political policies are in resolving the Papuan conflict. The research method that will be used in this study is a qualitative method with a normative type of research. The theory used in this study is the Theory of the Rule of Law, Theory of L.M. Friedman and the Theory of Justice. The result of the research is that the various policies of the Central Government for Papua in resolving the Papuan conflict have not been able to resolve the conflict in Papua. So one of the legal political policies that must be carried out is Peaceful Dialogue through negotiations. The product of the negotiations between the parties is a Memorandum of Understanding (MoU) as an agreement to end the conflict completely in the Land of Papua.

Abstract

The development of Papua must also be considered in developing Indonesia because it is a unity in the Bhineka Tunggal Ika series. So equality and justice in striving for the welfare of the people are also important for the people of Indonesia. Pancasila is the foundation of the Indonesian nation, which explains the five principles that have strong power in developing Indonesia towards a “Gotong Royong” society. The fifth precept of justice for all Indonesian people wants to show that this idea is Soekarno's idea of how the people enjoy the justice and welfare that is felt for the community both in the formal and non-formal fields which also leads to " cooperation". Then implement it in the Jokowi era which is to build and develop marginalized areas, from Sabang to Marouke, especially in marginalized and neglected areas. Land acquisition for development is the most complicated, namely if an agreement is not reached between the landowner and the constructing party, while the construction must be carried out. One solution that the government can choose is to complete development in a way that is acceptable to society. If all means cannot be implemented and development is urgently needed and the land cannot be moved, its location can be revoked as a final way, which must be regulated in law. Another most complicated problem is that in line with population growth and increasing dynamics of community aspirations, demands for development in the public interest are increasingly becoming. However, activities to meet these demands are faced with the increasingly limited availability of land and an underdeveloped land market. This has led to an uncontrolled increase in land prices, especially in urban areas. This condition also encourages land speculators to seek profit (rent-seeking) on every land transaction. The actions of land speculators often disrupt the smooth allocation of development requiring land, making it difficult to acquire land, especially for the development of public interests and creating a high-cost economy.

Abstract

The purpose of this study is to find out the legal protection regulations for buyers, the efforts that buyers of apartment units can take in the form of PPJB if the developer is declared bankrupt and how the law should give rights to the apartment buyers. Research on the above problems was conducted using qualitative methods. The type of research used is normative empirical by using approaches with methods of legal interpretation, legal construction, legal philosophy, legal history, and comparative law, as well as a legal pluralism approach. The data used in this dissertation research are primary and secondary and tertiary data which are analyzed objectively based on existing juridical references in order to obtain answers to the problems. Based on the research results from the problems above, it is concluded that there are several arrangements regarding the protection of buyers/consumers in Indonesian positive law, both from civil law, criminal law, customary law, and Islamic law. Buyers of apartment units can also sue in accordance with Article 3 of the UUK and PKPU, although the process must take a long time. The law should provide an update by adding a clause in the PPJB that objects being traded cannot be included in the bankruptcy budget.

Abstract

The research discusses sexual violence, which is an act committed by a defendant who forces children to engage in sexual intercourse, resulting in 13 child victims, some of whom have given birth. This is based on case study Number 989/Pid.Sus/2021/PN.Bdg. The issues addressed are: 1) What are the criminal policies regarding sexual violence (intercourse) committed against more than one child? 2) How does the ruling of Judge Number 989/Pid.Sus/2021/PN.Bdg. reflect justice, legal certainty, and utility in cases of sexual violence (intercourse) against multiple children? The research employs a juridical-normative legal study method, is descriptive-analytical in nature, and utilizes both secondary and primary data. Data is collected through literature reviews and analyzed qualitatively. Conclusions are drawn using deductive logic. The answers to the problems are: 1) The criminal legal policy is an effort to combat crime and is an integral part of community protection efforts. The legal policies include: Law Number 23 of 2002 on Child Protection, Law Number 35 of 2014 amending Law Number 23 of 2002 on Child Protection, Law Number 17 of 2016 concerning the Establishment of Government Regulation in Lieu of Law Number 1 of 2016 on the Second Amendment to Law Number 23 of 2002 on Child Protection into Law, and Law Number 12 of 2022 on Sexual Violence Crimes. 2)The handling of the case in this instance does not reflect the principle of justice, as the death penalty was imposed despite the Constitutional Court Decision No. 2-3/PUU-V/2007 and the Criminal Code of 2023 stating that the death penalty can be executed with a 10-year probationary period. This period allows for the possibility of change in the Defendant, showing remorse or developing a good character, which could lead to the death penalty being commuted to a life sentence or a 20-year term, with eligibility for remission and conditional sentences.

Abstract

Sexual violence against children, particularly in the form of forced sexual intercourse, is a critical issue worldwide, as perpetrators of such crimes are often individuals close to the child victim, such as family members. The identification problem discusses the legal provisions that should be applied in cases where the child is the victim and a family member is the perpetrator, as well as the appropriate sentencing measures to address similar issues. The research employs a descriptive normative approach, using secondary data which is processed qualitatively through deductive reasoning. The result and conclusion of the study indicate that the imposition of an 8-year prison sentence does not align with the objectives of criminal punishment, as there should have been an aggravated sentence with an additional one-third of the primary sentence, considering that the perpetrator had a familial relationship with the child victim.
