Abstract

The economy is based on democratic economy, prosperity for everyone! Therefore, any types of production  those  are  important  for  the  state  and mastering of many people must be controlled by the state. Otherwise, the reins of production fell into the hands of powerful parties and the people become oppressed. That is the original meaning of Article 33 of Indonesia Constitution based on formal explanation of the first Indonesia Constitution. But after the formal explanation was removed, the explanation of Article 33 no longer refers to the original meaning was set up by the framer constitution. This paper discusses the development of the interpretation   of Article 33 in ‘new space’ as seen from decisions of the Constitutional Court in examining the laws over the constitution. To show how the interpretation of Article 33 by the Constitutional Court, particularly regard to the conception of state control over natural resources, this paper discuss eleven decisions of Constitutional Court dealing to review several natural resources laws.

Abstract

The rise of transnational Islamist movements in Indonesia in the last two decades recurrences the old debate between Pancasila and Islamism. This kind of fundamental Islamic movements widespread with their conservative view and it has had detrimental effects on the Indonesian society?s social cohesion. President Joko Widodo seeks to revive Pancasila to confront this threat. This is not for the first time Pancasila is used by the Indonesian government to resolve the tension between Islamic values and nation-state principles. Both President Sukarno and Suharto also used Pancasila as a vehicle to discipline their political opponents. Adopting a non-essentialist approach to Pancasila, I argue that the return of Pancasila in recent years would be more complicated because of the narrative of Pancasila revivalism as an adversarial ideology is bounded by traditionalism and lack of progressive interpretation. Instead of locating Pancasila as the counterpart to Islamism, what is needed is re-interpretation of Pancasila as a unifying ideology.

Abstract

Sejak awal periode kemerdekaan, masyarakat adat telah diakui sebagai salah satu entitas hukum yang telah hidup mendahului eksistensi negara Republik Indonesia. Namun, hak-hak konstitusionalnya tidak pernah dikategorisasi secara spesifik. Diskusinya cenderung terbatas pada hak-hak properti seperti hak ulayat. Namun demikian, dinamika konstitusi memungkinkan munculnya kategori hak-hak baru bagi masyarakat adat, termasuk hak untuk berserikat. Pasca Orde Baru, beberapa kelompok masyarakat adat membentuk organisasi bernama Aliansi Masyarakat Adat Nusantara (AMAN). Diantara kegiatannya, AMAN beberapa kali melakukan gugatan pengujian konstitusionalitas undang-undang ke Mahkamah Konstitusi, seperti tercermin dalam Putusan MK No. 35/PUU-X/2012. Penelitian ini kemudian berusaha menggambarkan bentuk pengakuan kontemporer negara melalui Mahkamah Konstitusi terhadap hak berserikat dan hak berkumpul masyarakat adat, yang tercermin dalam Putusan MK No. 35/PUU-X/2012. Penelitian dilaksanakan dengan metode yuridis normatif, dengan pendekatan statuta dan pendekatan konseptual. Di dalam Putusan No. 35/PUU-X/2012, tercermin proses afirmasi Mahkamah Konstitusi terhadap status hukum organisasi masyarakat adat dengan mengakui legal standing AMAN. Masyarakat adat kini diakui sebagai subyek yang dapat berserikat, sebagaimana orang (natuurlijk persoon) dalam Pasal 28 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dengan demikian, MK telah melakukan suatu pembaruan terkait klausul konstitusi tentang hak berserikat. Akibatnya, posisi masyarakat adat sebagai subyek hukum semakin kuat di dalam sistem hukum Indonesia.

Abstract

This article discusses the independence of the Constitutional Court in reviewing legislation created by President Joko Widodo. There are three main questions posted: What is the character of legal policy under President Joko Widodo, how has the role of the Constitutional Court shifted in the last decade and what is the character of the Constitutional Court’s decisions in reviewing legislation enacted by President Joko Widodo. These questions are discussed using normative research on Constitutional Court decisions. Data from the results of this research are deployed quantitatively and qualitatively. Quantitative data is displayed to show legislative trends and Constitutional Court decisions. Analysis was carried out on 78 laws and 277 Constitutional Court Decisions. Meanwhile, qualitative research is to assess the character of legislation and Constitutional Court decisions through case studies of several Constitutional Court decisions related to politics, economics, law enforcement institutions and civil liberties. This article shows that the Constitutional Court has not been effective in exercising judicial review of legislation enacted under President Joko Widodo, amidst an increasingly abusive legislative process.

Abstract

Indonesia’s Constitutional Court introduced the concept of meaningful participation in the lawmaking process, emphasizing the right to be heard, considered, and explained. This concept was institutionalized through amendments to the Law on Lawmaking Procedures (Law Number 13 of 2022). However, meaningful participation remains poorly implemented, as demonstrated by the lack of public involvement in the issuance of the Government Regulation in Lieu of Law legalizing the Omnibus Law on Job Creation and the Constitutional Court's ruling on Law Number 6 of 2023 (Job Creation Law 2.0), which deemed public participation irrelevant for emergency laws. These developments highlight inconsistencies in applying the principle of meaningful participation in Indonesia’s legislative practices. This research evaluates the institutionalization of meaningful participation in Law Number 13 of 2022 and its practical application in Indonesia’s lawmaking process. This research uses doctrinal legal research methods by examining library materials and secondary data to analyze the legal framework and its implementation. The findings reveal a significant gap between the theoretical framework of meaningful participation and its application in practice, particularly in emergency lawmaking. In conclusion, while the institutionalization of meaningful participation reflects a positive step, inconsistent application undermines its potential to enhance democratic governance in Indonesia.

Abstract

The word "adat" has several different meanings in Indonesia. Adat can be used to describe informal dispute settlement procedures, a habit that keeps repeating itself, or a norm that develops into a code of behavior. Adat is perceived in this article as a narrative and a strategy employed by oppressed groups to fight against various forms of exclusion, particularly in relation to land grabbing for resource extraction and conservation carried out by the state and private sectors. This article will analyze the evolution and distinctions of Adat-based studies and movements in Indonesia during the colonial and national periods. Using existing secondary material from various studies on indigenous studies and movements, this article shows the differences in agendas, strategies and actors that use adat in legal discourse and legal mobilization over time. The connection between local, national, and international contexts will also be covered in this study, along with how rural communities dealing with agrarian issues have turned to adat as a strategy for legal mobilization.
