Abstract

Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 mengamanatkan penerapan meaningful participation dalam proses pembentukan undang-undang. Sejalan dengan revisi UU P3, partisipasi publik secara daring atau e-participation mulai diakomodasi bersamaan dengan substansi meaningful participation. Artikel ini mengkaji penerapan e-participation dalam proses legislasi di Indonesia untuk mengoptimalkan partisipasi publik melalui pemanfaatan teknologi informasi dan komunikasi. Tiga rumusan permasalahan yang dibahas dalam artikel ini adalah: (1) bagaimana evaluasi pengaturan dan pelaksanaan e-participation dalam proses legislasi saat ini? (2) bagaimana perbandingan e-participation dalam pembentukan undang-undang di berbagai negara? (3) bagaimana reformulasi e-participation guna mengoptimalkan pemenuhan partisipasi bermakna? Penelitian ini menggunakan metode yuridis normatif dan menemukan empat isu krusial dalam reformulasi e-participation di Indonesia, yaitu: (1) penguatan infrastruktur Sistem Pemerintahan Berbasis Elektronik; (2) unifikasi pengaturan lembaga pembentuk undang-undang yang menyelenggarakan e-participation; (3) akomodasi model citizen initiative dan crowdsourcing; serta (4) pengaturan waktu pelaksanaan e-participation.

Abstract

Indonesia’s Constitutional Court introduced the concept of meaningful participation in the lawmaking process, emphasizing the right to be heard, considered, and explained. This concept was institutionalized through amendments to the Law on Lawmaking Procedures (Law Number 13 of 2022). However, meaningful participation remains poorly implemented, as demonstrated by the lack of public involvement in the issuance of the Government Regulation in Lieu of Law legalizing the Omnibus Law on Job Creation and the Constitutional Court's ruling on Law Number 6 of 2023 (Job Creation Law 2.0), which deemed public participation irrelevant for emergency laws. These developments highlight inconsistencies in applying the principle of meaningful participation in Indonesia’s legislative practices. This research evaluates the institutionalization of meaningful participation in Law Number 13 of 2022 and its practical application in Indonesia’s lawmaking process. This research uses doctrinal legal research methods by examining library materials and secondary data to analyze the legal framework and its implementation. The findings reveal a significant gap between the theoretical framework of meaningful participation and its application in practice, particularly in emergency lawmaking. In conclusion, while the institutionalization of meaningful participation reflects a positive step, inconsistent application undermines its potential to enhance democratic governance in Indonesia.

Abstract

Court involvement in determining the direction of climate policy becomes a hope when state and non-state institutions fails to take action to address the climate crisis. The state’s agenda in the climate action plan is merely utopia when Environmental Impact Assessment (EIA) regulations do not even stipulate the obligation to estimate the impacts of climate change. This article aims to trace the patterns of court decisions on EIA-based climate litigation to assess the impacts of climate change and factors beyond. This is crucial to understand the extent to which the courts play a role in environmental protection due to climate change. Therefore, this article focuses on mapping the dynamics of administrative climate change litigation decisions in Indonesia between 2009 and 2022. The results show a dynamically evolving court development dominated by interpretations based on existing regulations, the procedural aspects of administrative court, and the judicial interest. In other words, the mainstreaming of climate change impact studies into EIAs tends not to be a consideration for judges when delivering verdicts. The Tanjung Jati A case stands as the only climate change litigation in Indonesia within that time period that was granted, considering the importance of climate change impact studies into EIAs. Abstrak Keterlibatan pengadilan dalam menentukan arah kebijakan perubahan iklim menjadi harapan saat institusi negara maupun non-negara gagal mengambil tindakan untuk mengatasi krisis iklim. Agenda negara dalam rencana aksi iklim sebatas utopia ketika pengaturan Analisis Mengenai Dampak Lingkungan (AMDAL) bahkan tidak mengatur kewajiban perkiraan dampak perubahan iklim. Artikel ini bermaksud melacak pola putusan pengadilan pada gugatan terkait kegagalan AMDAL dalam mengkaji dampak perubahan iklim dan faktor-faktor di antaranya. Hal ini penting guna mengetahui sejauh mana pengadilan mengambil peran dalam perlindungan lingkungan akibat perubahan iklim. Untuk itu, artikel ini terlebih dahulu melakukan pemetaan terhadap dinamika putusan administrasi litigasi perubahan iklim di Indonesia dalam kurun waktu 2009-2022. Hasilnya, pengadilan menunjukkan perkembangan yang secara dinamis didominasi oleh penafsiran berdasarkan regulasi yang berlaku, aspek prosedural pengadilan administrasi, dan kepentingan hakim. Artinya, dalil penggugat terkait pengarusutamaan kajian perubahan iklim dalam AMDAL cenderung tidak menjadi pertimbangan hakim dalam menjatuhkan putusan. Kasus Tanjung Jati A menjadi satu-satunya gugatan perubahan iklim di Indonesia dalam kurun waktu tersebut yang dikabulkan dengan mempertimbangkan pentingnya kajian perubahan iklim dalam AMDAL.

Abstract

The development of financial technology (fintech) has brought many benefits to the entrepreneurial world. However, access to fintech is not friendly to social entrepreneurs. In this respect, the growth of social entrepreneurship in Indonesia has challenges related to financing. Based on these problems, the author tries to find a solution. The acquisition of this research data is based on the results of regulations of laws or other written legal sources using methods of normative jurisprudence research. The author also uses a conceptual approach by deepening the theories in related discussions.Subsequently, the results of this research were compiled using qualitative descriptive methods, namely analysis to classify, compare, and link the obstacles to the development of social entrepreneurship in Indonesia with financial technology as a source of funding. Based on the method, the author found that the main challenge of social enterprise lies on the side of financing, and the survey results showed that crowdfunding, which is reward-based, became a medium to accommodate the needs of social businessmen so that inclusive economic justice can be achieved in Indonesia.
