Abstract

Implementation of restorative justice in the juvenile justice system in many countries has undergone its dynamics in the past few decades, including in Indonesia. The enactment of Indonesia Juvenile Justice System Law in mid-2014, which invalidates the 1997 Juvenile Court Law, became a significant point of juvenile justice reformation in Indonesia. The new Law began to shift the retributive paradigm in the Juvenile Court Law, as the previous statutory basis for juvenile justice in Indonesia, to restorative justice paradigm. The new Law introduces the Diversion mechanism as a means to implement the restorative justice approach. This article seeks to discuss how restorative justice can be contextualized through diversion mechanism, as well as to consider whether the new Indonesia Juvenile Justice System utilises restorative justice in a marginalized, boutique, or tokenistic way. Furthermore, this article uses statutory and theoretical approaches to examine the contextualization of restorative justice through the diversion mechanism introduced in the new Juvenile Justice System Law.

Abstract

The existence of conditional decisions becomes dynamic in constitutional review, including their use in procedural constitutional reviews. Constitutional Court Decision No. 91/PUU-XVIII/2020 is the first decision to grant the petition and use a conditional decision model. Unfortunately, as mentioned earlier, using the conditional decision model in the decision results in discourse among various parties, including government institutions, law enforcers, academics, and the general public. With the growing discourse, this research aims to analyze the compatibility of the conditional decision model in formal constitutional reviews by examining various formal constitutional review decisions and the conditional decisions handed down by the Constitutional Court. This research indicates that the conditional decision is incompatible with formal constitutional review. This can be observed from the incompatibility of conditional decisions with the regulatory design of formal constitutional reviews and their legal consequences.

Abstract

This article explores the paradoxical affirmation of the death penalty by the Constitutional Courts in Indonesia and South Korea, despite constitutional guarantees for the right to life and the fundamental right of human dignity. Through historical and content analyses, it explores how these courts interpret these rights in relation to the death penalty and why they affirm it constitutional. Both countries recognise the nonderogable nature of these rights, yet their Constitutional Courts allow for legal restrictions. Constitutional Court’s decision to impose limitations on nonderogable rights demonstrates their preference for maintaining a cautious and conservative approach. The examination of Constitutional Courts’ decisions reveals that the debate over the death penalty’s constitutionality extends beyond legal considerations, involving political dynamics and historical factors. This article underscores the complex interplay between constitutional guarantees, judicial interpretation, and sociopolitical contexts in shaping the countries’ human rights protection trajectories, especially in the context of nonderogable rights. It also highlights the crucial role of Constitutional Courts in safeguarding the right to life, as their decisions can significantly impact human rights protection in these countries.

Abstract

Indonesia’s Constitutional Court introduced the concept of meaningful participation in the lawmaking process, emphasizing the right to be heard, considered, and explained. This concept was institutionalized through amendments to the Law on Lawmaking Procedures (Law Number 13 of 2022). However, meaningful participation remains poorly implemented, as demonstrated by the lack of public involvement in the issuance of the Government Regulation in Lieu of Law legalizing the Omnibus Law on Job Creation and the Constitutional Court's ruling on Law Number 6 of 2023 (Job Creation Law 2.0), which deemed public participation irrelevant for emergency laws. These developments highlight inconsistencies in applying the principle of meaningful participation in Indonesia’s legislative practices. This research evaluates the institutionalization of meaningful participation in Law Number 13 of 2022 and its practical application in Indonesia’s lawmaking process. This research uses doctrinal legal research methods by examining library materials and secondary data to analyze the legal framework and its implementation. The findings reveal a significant gap between the theoretical framework of meaningful participation and its application in practice, particularly in emergency lawmaking. In conclusion, while the institutionalization of meaningful participation reflects a positive step, inconsistent application undermines its potential to enhance democratic governance in Indonesia.

Abstract

Dalam kontestasi pemilihan umum, pemilihan metode konversi suara menjadi kursi kerap kali kurang mendapatkan perhatian dalam pengaturan pemilu. Padahal, perbedaan jenis metode konversi suara yang digunakan akan berpengaruh pula pada perbedaan jumlah kursi yang bisa didapatkan oleh suatu partai politik di parlemen. Dalam sejarah kepemiluan di Indonesia, setidaknya terdapat dua jenis metode konversi suara yang telah digunakan, yakni metode Kuota Hare dan metode Divisor Sainte-Lague. Perubahan metode tersebut tentu secara praktis berpengaruh pada strategi dan pola pergerakan partai politik dalam kontestasi pemilu guna memperoleh kursi di parlemen, apalagi mengingat Indonesia yang juga menerapkan sistem multipartai. Mendasarkan pada hal tersebut, Penulis berusaha memahami apakah perubahan metode konversi suara memiliki pengaruh besar dalam menyederhanakan partai politik di Indonesia. Untuk itu, Penulis juga melakukan simulasi penghitungan suara dengan menggunakan berbagai metode konversi suara. Adapun hasil dari penelitian ini menunjukkan bahwa perbedaan metode konversi suara berimplikasi terhadap penentuan jumlah kursi yang didapatkan partai politik di parlemen. Lebih lanjut, dari berbagai metode yang digunakan, metode divisor d’Hondt merupakan metode yang berimplikasi cukup signifikan dalam upaya menyederhanakan jumlah partai politik di parlemen.

Abstract

Perlindungan data pribadi menjadi salah satu aspek penting yang perlu diterapkan dalam penyelenggaraan Sistem Pemerintahan Berbasis Elektronik (SPBE). Hal ini salah satunya dilihat dari rencana pemerintah dalam menggunakan dan mengelola data masyarakat, termasuk data pribadi, melalui pemanfaatan berbagai teknologi baru seperti big data, Internet of Things, Artificial Intelligence, dan lain sebagainya; serta beberapa kasus pelanggaran atau penyalahgunaan data pribadi yang terjadi beberapa waktu silam. Oleh karena itu, penelitian ini dimaksudkan untuk mengkaji persinggungan kepentingan antara individu dengan negara dalam penggunaan data pribadi, serta memahami dinamika pengaturan perlindungan data pribadi, khususnya yang terkait dengan SPBE. Hasil penelitian ini menunjukkan bahwa: Pertama, kepentingan individu atas perlindungan privasi dan keamanan informasi, serta kepentingan Negara dalam mengembankan pelayanan kepada masyarakat melalui pemanfaatan data pribadi masyarakat menjadi penting untuk diakomodasi dalam kerangka hukum perlindungan data pribadi; dan Kedua, pengaturan mengenai data pribadi pada level UU masih diatur secara sporadis dengan tingkat pengaturan yang berbeda-beda. Untuk mengatasi potensi inkonsistensi pengaturan, setidaknya terdapat beberapa hal yang perlu dilakukan seperti segera mengesahkan RUU Data Pribadi, termasuk di dalamnya membahas terkait dengan definisi dan klasifikasi data, mengakomodasi prinsip-prinsip perlindungan data pribadi, pembatasan akses terhadap data pribadi jenis tertentu, serta meningkatkan standar keamanan informasi yang dipegang.
