Abstract

Realita banyaknya undang-undang produksi DPR dan Presiden yang dibatalkan oleh Mahkamah Konstitusi, terjadi sebagai akibat materi muatan undang-undang tersebut yang jamak mencermikan ketidakadilan dan ketidakpastian hukum. Tingginya angka judicial review menjadi sinyal kurang terakomodasinya kepentingan dan hak-hak warga negara dalam sebuah produk perundang-undangan. Tidak adanya keharmonisan pengaturan yang dilakukan DPR itulah yang memberi dampak pada jamaknya undang-undang yang digugat. Tulisan ini mencoba mendeskripsikan beberapa perdebatan antinomi yang mewarnai eksistensi perundang-undangan di Indonesia. Hasil analisis menunjukkan, antinomi— pertentangan—norma dalam peraturan perundang-undangan adalah satu hal yang sulit terhindarkan, apalagi mengingat buruknya proses legislasi di DPR saat ini. Dalam setiap pembentukan peraturan perundang-undangan, sinkronisasi dan harmonisasi norma bukanlah satu titik tekan yang utama, melainkan terkalahkan oleh politik transaksional antarfraksi di DPR yang justru tampak lebih dominan. Namun bilamana pertentangan norma tersebut justru membentuk satu aturan hukum yang simultan, dinamis, dan memenuhi cita hukum, tentu tidak menjadi persoalan. Selama tidak menimbulkan kerugian bagi pemenuhan hakhak konstitusional (constitutional rights) warga negara.

Abstract

This research questions the standard operational procedures applied in Samsat and BPN Yogyakarta. Result shows how the integrity level of these institutions is potential to be enhanced by opening wide access of information and by eradicating tipping and illegal payment. Improvement of reward and punishment system must also be done.  Fokus penelitian ini adalah prosedur operasional standar yang digunakan oleh Samsat dan BPN Yogyakarta. Hasil penelitian menunjukkan bahwa tingkat integritas kedua institusi ini berpotensi untuk dikembangkan dengan cara membuka keran informasi dan mengeliminasi budaya tips dan pungutan liar serta memperbaiki sistem reward and punishment.

Abstract

Indonesia’s Constitutional Court introduced the concept of meaningful participation in the lawmaking process, emphasizing the right to be heard, considered, and explained. This concept was institutionalized through amendments to the Law on Lawmaking Procedures (Law Number 13 of 2022). However, meaningful participation remains poorly implemented, as demonstrated by the lack of public involvement in the issuance of the Government Regulation in Lieu of Law legalizing the Omnibus Law on Job Creation and the Constitutional Court's ruling on Law Number 6 of 2023 (Job Creation Law 2.0), which deemed public participation irrelevant for emergency laws. These developments highlight inconsistencies in applying the principle of meaningful participation in Indonesia’s legislative practices. This research evaluates the institutionalization of meaningful participation in Law Number 13 of 2022 and its practical application in Indonesia’s lawmaking process. This research uses doctrinal legal research methods by examining library materials and secondary data to analyze the legal framework and its implementation. The findings reveal a significant gap between the theoretical framework of meaningful participation and its application in practice, particularly in emergency lawmaking. In conclusion, while the institutionalization of meaningful participation reflects a positive step, inconsistent application undermines its potential to enhance democratic governance in Indonesia.

Abstract

After the Constitutional Court Decision Number 91/PUU-XVIII 2020, public participation must be present in every legislative formation. As one of the regulations in Indonesia, PERPU has the same hierarchy and content material as the Law. Therefore, it is also important to question the opportunity for public participation in the PERPU formation process. In order to obtain answers to this study, this research uses normative legal research with a statute approach and conceptual approach. This research shows that in the formation of PERPU there are two processes that must be passed, namely first the process of formulating and determining PERPU by the President and second the process of submitting to the DPR for approval or not. Public participation can be present in both processes but has different doses. In the first process, public participation is only in the form of information provided to the public regarding the reasons for the ‘compelling urgency’ of the PERPU stipulation by the President. Meanwhile, in the second process, public participation is presented when the PERPU is submitted and the discussion stage is carried out by the DPR level I and II. As for the implementation of public participation in the formation of PERPU in both processes, it can utilise technology, because PERPU is an emergency regulation and races with time constraints in its formation, technology can be an option used.

Abstract

Setelah Mahfud menyelesaikan disertasinya pada tahun 1993, studi politik hukum berkembang cukup pesat pada kurikulum pendidikan tinggi hukum. Pada jenjang magister dan doktor studi Mahfud mampu memberikan kontribusi yang signifikan dalam memahami relasi hukum dan politik. Studi ini bertujuan memperolah dua hal. Pertama, melihat batasan dan ruang lingkup studi politik hukum Mahfud. Kedua, menelaah relevansi studi politik hukum Mahfud MD pada pasca demokratisasi politik. Studi ini menggunakan jenis penelitian sosio legal dengan data sekunder dan dianalisis secara kualitatif. Hasil studi menunjukan (1) temuan studi ini menegaskan kembali bahwa secara metodologis studi Mahfud MD memiliki keterbatasan ruang lingkup pada wilayah hukum publik, terutama yang mengatur kepentingan pemerintah. Bahwa temuan konfigurasi politik akan berpengaruh pada karakter produk hukum, terbukti tidak berpengaruh pada wilayah hukum privat. (2) mengingat studi Mahfud diselesaikan pada tahun 1993, tentu akan berdampak pada kemampuan teori ini beradaptasi dengan kondisi sosio, hukum dan politik yang jauh berbeda pasca reformasi. Hasil temuan studi ini juga menunjukkan bahwa studi politik hukum Mahfud MD tentu masih relevan dalam konteks pedagogik. Meskipun, dalam konteks politik praktis dan bekerjanya hukum di masyarakat, studi politik hukum Mahfud MD akan nampak keterbatasannya.

Abstract

Corruption, as a criminal act, causes victims. Identifying victims of corruption is not straightforward, as they can be direct or indirect. Victims of corruption include the state, groups, and individuals in society. This distinction characterizes corruption victims differently from victims of other crimes. Law enforcement efforts against corruption mainly focus on punishing perpetrators. The recovery of state losses is usually limited to compensation payments, which cover the proceeds of crime received by the perpetrator, rather than the full amount of the loss suffered by the state. Meanwhile, victims who are groups and individuals within society are often overlooked in the legal system. To date, Indonesia has not implemented a practice of compensating communities—both groups and individuals—who are victims of corruption. This research is a juridical-normative study. It uses both a statutory approach and a conceptual approach. The statutory approach examines the mechanism for compensating corruption victims in the Civil Code (KUHPerdata), Criminal Procedure Code (KUHAP), and other relevant laws and regulations. The conceptual approach explores the idea of victim recovery in corruption cases. The study finds that Indonesian law currently offers three ways for victims of corruption to seek compensation: civil lawsuits, joining civil suits with criminal cases, and restitution. However, existing regulations lack a clear and specific mechanism to ensure victims' rights are fully met. A dedicated compensation mechanism, aligned with the nature of corruption victims and their losses, is necessary in the Draft Law on Corruption (RUU Tipikor).

Abstract

The IKN law has faced criticism due to its legislative process being deemed formally flawed, particularly in terms of transparency, public participation, and accountability. These shortcomings raise constitutional concerns and question the legitimacy of the legislative process behind a law that will significantly shape Indonesia’s future governance. This study aims to analyze the objective parameters in the formal-constitutionality review of laws in the Constitutional Court, explicitly focusing on Law Number 3 of 2022 concerning the Nusantara capital city. The research employs a normative-analytical method using a statutory and analytical approach based on secondary data, such as relevant legislation, legislative deliberation records, and expert opinions. The findings reveal that the legislative process of the IKN law did not fully comply with the principles of good regulatory practice, particularly in terms of openness and public involvement. The accelerated process created gaps in transparency and accountability, potentially resulting in constitutional harm to society. Additionally, the IKN law includes several delegations of regulatory authority to implementing rules, increasing the risk of abuse in the legislative process. This study concludes by emphasizing the significance of formal review in upholding the rule of law and ensuring that enacted laws reflect constitutional values and serve the public interest. It also contributes to developing a more objective and accountable legislative evaluation framework in Indonesia

Abstract

The role of the insurance sector in national economic growth has a very strong correlation and can be utilised for financing schemes for natural disaster management. This study aims to investigate whether insurance, national economic growth, and the utilisation of insurance for natural disaster management have a constitutional correlation with a constitutional law approach. This research is conducted using the doctrinal research method. The doctrinal research method is an analysis of positive law, related cases, and other relevant references in studying a legal issue. This study found that in the constitutional law system, the correlation between catastrophe insurance and national economic growth is closely related to the mandate of Article 33 of the 1945 Constitution, which states that the insurance service sector can be classified as an essential for the lives of many people, so that it must be structured based on the principle of kinship. Therefore, the legal policy of the insurance system in Indonesia must be structured based on the principles of economic democracy, togetherness, equitable efficiency, sustainability, environmental insight, independence, and maintaining a balance of progress and national economic unity. In more specific, the correlation between the utilization of insurance in natural disaster management can be linked to the Articles of Human Rights contained in the 1945 Constitution. So the legal policy of the insurance system, especially catastrophe insurance, should not only provide (economic) benefit for business actors but also involve a public service dimension for society.
