Abstract

Seiring dengan adanya perubahan yang cukup mendasar di dalam sistem ketatanegaraan pasca reformasi 1998, kedudukan Gubernur mengalami perubahan yang cukup signifikan di dalam sistem ketatanegaraan di Indonesia. Dalam posisinya Gubernur bertindak selaku Kepala Daerah otonom karna ia di pilih langsung oleh rakyat di dalam sebuah proses politik di wilayah yang Ia pimpin, namun disisi lain Gubernur juga bertindak selaku wakil dari Pemerintah Pusat sebagaimana yang tertuang dalam Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah. Hal ini membuat posisi Gubernur menjadi dilematis dan berakibat persinggungan hubungan pusat dan daerah pun kerapkali terjadi. Dengan menggunakan penelitian hukum yuridis normatif, artikel ini akan mengkaji bagaimana dualisme kewenangan Gubernur dalam sistem hukum di Indonesia, apa saja persinggungan yang terjadi antara Pemerintah Pusat dan Pemerintah Daerah dalam 10 (sepuluh) tahun terakhir juga mencari solusi terkait problem tersebut dengan manawarkan sebuah konsep kenegaraan baru dengan dibentuknya sebuah lembaga baru yang mewadahi kepentingan pusat dan kepentingan daerah. Posisi Gubernur yang problematik kerapkali menimbulkan friksi diantara Pemerintah Pusat dan Daerah dan didalam konsep negara kesatuan praktik semacam ini tidaklah ideal dimana seharusnya pusat dan daerah harus satu suara didalam pengambilan kebijakan maka penelitian ini mendorong untuk dibentuk sebuah lembaga non structural bernama Komisi Hukum Indonesia yang berfungsi sebagai pusat koordinasi informasi hukum, pusat koordinasi rancangan hukum dan pusat koordinasi pemasyarakataan hukum agar koordinasi antara pusat dan daerah dapat berjalan lebih baik dan sebagaimana mestinya.

Abstract

Cases of sexual violence against women and children with disabilities in West Kalimantan fluctuate annually, with a higher level of vulnerability compared to non-disabled groups. This situation emphasizes the need for more specific and equitable legal protection for disabled groups. This study aims to analyze the forms of legal protection for women and children with disabilities who are victims of sexual violence in West Kalimantan and to propose an ideal concept of legal protection that is inclusive and victim-centered. The method used is a normative-empirical approach through literature review and field research through interviews with several relevant parties. The results of the study indicate that although legal instruments are available, such as Law Number 8 of 2016 concerning Persons with Disabilities, Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, and Government Regulation Number 39 of 2020, their implementation is still suboptimal. Obstacles faced include limited access to information, communication barriers, social stigma, a lack of understanding among law enforcement officers regarding the special needs of persons with disabilities, and the absence of internal regulations at the police level regarding mechanisms for handling victims of disabilities. The ideal concept of legal protection encompasses three aspects: first, the provision of inclusive and accessible sexual education for women and children with disabilities; second, strengthening the capacity of law enforcement officers from a disability perspective; and third, the establishment of internal regulations or Standard Operating Procedures for handling victims of disabilities at the police level to ensure that examination standards for persons with disabilities are tailored to their needs.

Abstract

Judicial integrity constitutes a fundamental pillar of the rule of law and democratic governance. In Indonesia’s post-1998 reform era, the establishment of the Judicial Commission (Komisi Yudisial) was intended to strengthen external oversight of judicial conduct and enhance public trust in the judiciary. However, the effectiveness of this institution has been significantly constrained by Constitutional Court Decision No. 005/PUU-IV/2006, which limited the Commission’s authority in supervising judges, particularly those within the Supreme Court. This article examines how these constitutional limitations affect the effectiveness of judicial oversight and the broader framework of judicial accountability in Indonesia. The study employs a normative juridical method, focusing on the analysis of constitutional provisions, statutory regulations, and judicial decisions governing the authority of the Judicial Commission. Legal doctrines on the hierarchy of norms and the theory of separation of powers are used to evaluate the consistency of existing regulations with the constitutional mandate under Article 24B of the 1945 Constitution. The findings indicate that the Constitutional Court’s interpretation has fragmented the judicial oversight system, weakened external accountability, and created structural imbalances within the system of checks and balances. To address these challenges, the article proposes constitutional and institutional reforms aimed at strengthening the Judicial Commission’s authority, enhancing transparency, and restoring public confidence in the judiciary. Such reforms are essential to ensure that judicial independence is accompanied by effective mechanisms of accountability.
