Abstract

The problem of teenagers' involvement in online gambling practices is a crucial issue that requires educative and preventive handling. This fact has caused concern among teachers and principals of private high schools in Kapuas Pontianak. Private SMAs in Pontianak City have never received education on online gambling practices so they need it as an effort to prevent their students from participating in online gambling practices. This Community Service activity aims to provide preventive legal education and digital literacy to students of SMA Swasta Kapuas Pontianak City as an initial step to prevent online gambling practices. The methods used included interactive lectures and dissemination of educational materials. The evaluation of the activity was attended by 35 participants by providing descriptive impressions and messages and the results of the evaluation indicated an increased awareness of the risks and legal impacts of online gambling. This finding proves that an integrative approach between legal aspects and digital literacy is effective in building students' understanding and critical attitude towards digital threats. This activity is important as an educational intervention model that can be replicated in other schools, as well as developed in the form of a long-term school-based education programme on the dangers of online gambling practices.Edukasi Hukum Preventif dan Literasi Digital Tentang Bahaya Judi Online Bagi Siswa SMA Swasta Kapuas PontianakABSTRAKPermasalahan maraknya keterlibatan remaja dalam praktik judi online menjadi isu krusial yang memerlukan penanganan edukatif dan preventif. Fakta yang terjadi ini membuat kekhawatiran para guru dan kepala sekolah SMA Swasta Kapuas Pontianak. SMA Swasta Kota Pontianak belum pernah mendapatkan edukasi terhadap praktek judi online sehingga mereka memerlukan hal tersebut sebagai upaya untuk mencegah siswa dan siswi mereka ikut dalam praktek judi online. Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk memberikan edukasi hukum preventif dan literasi digital kepada siswa SMA Swasta Kapuas Kota Pontianak sebagai langkah awal pencegahan terhadap praktik judi online. Metode yang digunakan meliputi ceramah interaktif serta penyebaran materi edukatif. Evaluasi egiatan diikuti oleh 35 peserta dengan meberikan kesan dan pesan secara deskriptif dan hasil dari evaluasi tersebutpeserta mengindikasikan peningkatan kesadaran terhadap risiko dan dampak hukum dari judi online. Temuan ini membuktikan bahwa pendekatan integratif antara aspek hukum dan literasi digital efektif dalam membangun pemahaman dan sikap kritis siswa terhadap ancaman digital. Kegiatan ini penting sebagai model intervensi edukatif yang dapat direplikasi di sekolah lain, serta dikembangkan dalam bentuk program edukasi jangka panjang berbasis sekolah tentang bahaya praktek judi online.Kata Kunci :Judi online; Edukasi hukum; Literasi digitalĀ

Abstract

This study critically analyzes the implementation of constitutional principles within the framework of structural safety regulations for building constructions in Indonesia. The intersection between constitutional law and civil engineering becomes urgent to analyze considering the significant transformation of building construction regulations following the enactment of the Job Creation Law (Law No. 11 of 2020) and Government Regulation No. 16 of 2021. The study employs a normative juridical approach integrated with technical analysis through doctrinal legal research methods while still considering empirical aspects of structural safety standards. Through legislative, conceptual, and comparative approaches, this study identifies significant implementation gaps between constitutional principles and structural safety technical standards. The results indicate that: (1) there is disharmony between constitutional principles and the implementation of technical regulations, especially in the aspect of protecting citizens' human rights; (2) the paradigm shift from Building Permit (IMB) to Building Approval (PBG) has not fully accommodated the fulfillment of constitutional rights of building users; and (3) the state's constitutional accountability mechanism in building failures remains weak. The study recommends reformulating structural safety regulations that integrate constitutional principles with technical standards by strengthening the state's responsibility dimension in ensuring building safety, as well as improving the Building Feasibility Certificate (SLF) mechanism as a constitutional protection instrument. Abstract

Cases of sexual violence against women and children with disabilities in West Kalimantan fluctuate annually, with a higher level of vulnerability compared to non-disabled groups. This situation emphasizes the need for more specific and equitable legal protection for disabled groups. This study aims to analyze the forms of legal protection for women and children with disabilities who are victims of sexual violence in West Kalimantan and to propose an ideal concept of legal protection that is inclusive and victim-centered. The method used is a normative-empirical approach through literature review and field research through interviews with several relevant parties. The results of the study indicate that although legal instruments are available, such as Law Number 8 of 2016 concerning Persons with Disabilities, Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, and Government Regulation Number 39 of 2020, their implementation is still suboptimal. Obstacles faced include limited access to information, communication barriers, social stigma, a lack of understanding among law enforcement officers regarding the special needs of persons with disabilities, and the absence of internal regulations at the police level regarding mechanisms for handling victims of disabilities. The ideal concept of legal protection encompasses three aspects: first, the provision of inclusive and accessible sexual education for women and children with disabilities; second, strengthening the capacity of law enforcement officers from a disability perspective; and third, the establishment of internal regulations or Standard Operating Procedures for handling victims of disabilities at the police level to ensure that examination standards for persons with disabilities are tailored to their needs.

Abstract

This research examines the sanctions imposed in the customary law system of the Dayak Mualang and Jangkang communities in Sekadau Regency, focusing on their relation to the concepts of recidivism and the principle of Ne Bis in Idem. The background arises from recurring criminal acts such as theft, domestic violence, and violations of public order, which highlight the limitations of customary sanctions in deterring repeat offenses. The study aims to analyze, first, the recognition and application of recidivism within these communities and its impact on repeated offenses; and second, the factors underlying the imposition of double sanctions for a single act in the absence of Ne Bis in Idem. Using an empirical juridical method, data were collected through field research, interviews with customary leaders, and analysis of legal documents. The findings reveal that the customary law of Dayak Mualang and Jangkang does not recognize recidivism, resulting in repeated offenders receiving the same sanctions without aggravation. Moreover, in certain cases, offenders are subjected to double sanctions by different customary authorities, which is viewed socially as moral accountability rather than legal duplication. However, this practice contradicts modern criminal law principles and creates potential violations of human rights due to legal uncertainty. The research concludes that integrating the principles of recidivism and Ne Bis in Idem into customary law is essential to enhance justice, ensure proportional sanctions, and maintain social harmony in multicultural communities.

Abstract

Community Service (PKM) which is the main focus is about the awareness of inmates on their obligations as stated in Law Number 22 of 2022 concerning Corrections at the Class IIA Pontianak Women's Prison. This activity has a goal to enhance the understanding among inmates about their duties regarding compliance with laws, maintaining security and cleanliness, participating in development programs, and respecting other people's rights during the correction process. Based on observations, interviews, and legal counseling, it was discovered that some inmates do not yet fully understand their obligations. Counseling has provided a better understanding of the reciprocal relationship between obligations and rights, including remission and parole. The results also indicate that there is room for improvement through continuous mentoring and more transparent oversight mechanisms so that the correctional system can function effectively, fairly, and with an orientation toward social reintegration.to realize a humanistic, equitable, and gender-sensitive development system.

Abstract

Sextortion (sexual extortion) is a crime that exploits the vulnerability of the victim through the threat of distributing material containing pornography, for certain purposes such as financial gain, sexual gratification, or even psychological domination. However, sometimes what was originally intended as a proof of trust often turns into a tool of blackmail when the relationship is in conflict. So that victims are usually forced to do things that the victim does not want, but the perpetrator wants. Along with the development of ITE and the increasing use of digital applications, the crime of Sextortion is increasingly massive in video call sex (VCS), where men who are educated, intellectual, and have prominent positions become objects of sexual extortion. This article critically examines the root causes of various factors behind the occurrence of sextortion crimes on social media platforms?; and what is a holistic approach to address the driving factors for the crime of sextortion? This type of research is empirical juridical, by examining the applicable positive legal norms and their implementation in community practice. Data is collected through document studies and in-depth interviews as the primary information collection techniques. This article emphasizes the importance of comprehensive victim protection through trauma recovery services, legal assistance, and public education about digital security. A multidisciplinary approach that is on the side of victims is a crucial step in building a criminal justice system that is responsive to sexual crimes in the digital age
