Abstract

Narkotika adalah zat atau obat yang berasal dari tanaman atau bukan tanaman, baik sintesis maupun semisintetis, yang dapat menyebabkan penurunan atau perubahan kedasaran, hilangnya rasa, mengurangi sampai menghilangkan rasa nyeri dan dapat menimbulkan ketergantungan.  penyalahguna adalah mereka yang menggunakan narkotika tanpa hak atau melawan hukum. Dari sudut usia, narkotika sudah tidak dinikmati golongan setengah baya maupun golongan usia tua tetapi golongan anak dibawah umur. Hal ini tentu saja menimbulkan kekhawatiran berbagai kalangan baik pemerintah maupun masyarakat, khususnya para orang tua. Anak palaku penyalahguna narkotika tidak hanya dapat dipandang ia sebagai pelaku namun juga dikategorikan sebagai korban. Anak seringkali dijadikan alat  dan dimanfaatkan oleh pengedar atau bandar untuk melancarkan perdaran narkotika.Dalam Pasal 1 angka 7 Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak khusus untuk perkara Anak dikenal mekanisme untuk mengalihkan penyelesaian perkara dari proses peradilan pidana ke proses di luar peradilan pidana, yang dinamakan dengan Diversi. Dalam pasal 7 ayat (1) UU SPPA dengan jelas menyatakan bahwa pada tingkat penyidikan, penuntutan dan pemeriksaan perkara anak di pengadilan negeri wajib diupayakan diversi. Namun dalam praktiknya, khususnya di Kota Pontianak penyidik belum pernah melaksanakan upaya diversi terhadap perkara penyalahguna narkotika oleh anak.Berdasarkan hasil penelitian penulis, faktor penyebab penyidik tidak melaksanakan diversi terhadap anak pelaku penyalahguna narkotika pada tahap penyidikan di kota Pontianak adalah adalah (1) Narkotika merupakan kejahatan luar biasa (Extraordinary Crime), 2) Ancaman pidana diatas 7 tahun, 3) Pelaku sudah cukup lama menjadi penyalahguna narkotika, 4) Kurangnya tenaga ahli penyidik anak, 5) Sarana dan Prasarana yang kurang memadai dalam menunjang penegakkan hukum..Pada dasarnya, prinsip kepentingan terbaik bagi anak harus dipandang sebagai of Paramout importence (memperoleh prioritas tinggi) dalam setiap keputusan yang menyangkut anak. Tanpa prinsip ini perjuangan untuk melindungi anak akan mengalami banyak batu sandungan. Prinsip the best of the child digunakan karenakan dalam banyak hal anak menjadi “korban” disebakan ketidaktahuannya karena usia perkembangannya terutama dalam hal penyalahgunaan narkotika. jika hal ini diabaikan maka penjatuhan pidana penjara terhadap anak akan menimbulkan stigmasi negative bagi anak dan tentunya akan menimbulkan beban moral bagi anak itu sendiri.  Kata Kunci: Diversi, Anak, Penyalahguna Narkotika, Perlindungan Hukum, Penyidikan

Abstract

Seiring dengan adanya perubahan yang cukup mendasar di dalam sistem ketatanegaraan pasca reformasi 1998, kedudukan Gubernur mengalami perubahan yang cukup signifikan di dalam sistem ketatanegaraan di Indonesia. Dalam posisinya Gubernur bertindak selaku Kepala Daerah otonom karna ia di pilih langsung oleh rakyat di dalam sebuah proses politik di wilayah yang Ia pimpin, namun disisi lain Gubernur juga bertindak selaku wakil dari Pemerintah Pusat sebagaimana yang tertuang dalam Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah. Hal ini membuat posisi Gubernur menjadi dilematis dan berakibat persinggungan hubungan pusat dan daerah pun kerapkali terjadi. Dengan menggunakan penelitian hukum yuridis normatif, artikel ini akan mengkaji bagaimana dualisme kewenangan Gubernur dalam sistem hukum di Indonesia, apa saja persinggungan yang terjadi antara Pemerintah Pusat dan Pemerintah Daerah dalam 10 (sepuluh) tahun terakhir juga mencari solusi terkait problem tersebut dengan manawarkan sebuah konsep kenegaraan baru dengan dibentuknya sebuah lembaga baru yang mewadahi kepentingan pusat dan kepentingan daerah. Posisi Gubernur yang problematik kerapkali menimbulkan friksi diantara Pemerintah Pusat dan Daerah dan didalam konsep negara kesatuan praktik semacam ini tidaklah ideal dimana seharusnya pusat dan daerah harus satu suara didalam pengambilan kebijakan maka penelitian ini mendorong untuk dibentuk sebuah lembaga non structural bernama Komisi Hukum Indonesia yang berfungsi sebagai pusat koordinasi informasi hukum, pusat koordinasi rancangan hukum dan pusat koordinasi pemasyarakataan hukum agar koordinasi antara pusat dan daerah dapat berjalan lebih baik dan sebagaimana mestinya.

Abstract

Political corruption is a form of violation of people's human rights and is a worrying phenomenon because it is dominated by state officials who have superior positions. This article aims to find out how the reality of law enforcement against corruption is carried out by state officials and how the criminal responsibility of state officials who commit political corruption in Indonesia. This article uses a normative juridical method. The results shows that law enforcement against state officials who commit political corruption has not been carried out optimally. The low demands of prosecutors followed by judges' verdicts against state officials who commit corruption are the cause of the difficulty of eradicating this crime. The imposition of a maximum criminal threat or life imprisonment for perpetrators of political corruption is something that should be done to create a deterrent effect for the perpetrators or the public who see it. In this case, law enforcement officers must have the courage, integrity, and high morale to be indiscriminate in eradicating political crimes in Indonesia.

Abstract

This study critically analyzes the implementation of constitutional principles within the framework of structural safety regulations for building constructions in Indonesia. The intersection between constitutional law and civil engineering becomes urgent to analyze considering the significant transformation of building construction regulations following the enactment of the Job Creation Law (Law No. 11 of 2020) and Government Regulation No. 16 of 2021. The study employs a normative juridical approach integrated with technical analysis through doctrinal legal research methods while still considering empirical aspects of structural safety standards. Through legislative, conceptual, and comparative approaches, this study identifies significant implementation gaps between constitutional principles and structural safety technical standards. The results indicate that: (1) there is disharmony between constitutional principles and the implementation of technical regulations, especially in the aspect of protecting citizens' human rights; (2) the paradigm shift from Building Permit (IMB) to Building Approval (PBG) has not fully accommodated the fulfillment of constitutional rights of building users; and (3) the state's constitutional accountability mechanism in building failures remains weak. The study recommends reformulating structural safety regulations that integrate constitutional principles with technical standards by strengthening the state's responsibility dimension in ensuring building safety, as well as improving the Building Feasibility Certificate (SLF) mechanism as a constitutional protection instrument. Abstract

This study aims to determine the deviation of criminal law principles in the embezzlement of joint assets committed by a husband or wife in marriage. Therefore, criminalization is an ideal policy formulation to overcome this deviation. This study uses normative legal research with a legislative approach that examines the Criminal Code, especially the crime of family embezzlement. In addition, a conceptual approach is also used to determine the deviation of criminal law principles so that efforts are obtained to overcome deviations from criminal law principles. This study concludes that there is a deviation of criminal law principles in the crime of embezzlement of joint assets committed by a husband or wife during marriage. This deviation is based on the inconsistency between the formulation of the crime which states that it cannot be prosecuted with the principle of criminal responsibility which regulates the reasons for eliminating the crime, namely the reason for forgiveness and the reason for justification. Furthermore, moral norms cannot prevent the prosecution of a criminal act, as long as there is a complaint from the victim as the concept of the complaint crime. Therefore, as a repressive effort in providing legal protection for victims, a formulation policy is needed by criminalizing embezzlement of joint assets committed by a husband or wife during marriage by eliminating the phrase " "it is impossible to hold criminal charges".

Abstract

Indonesia’s legal framework, grounded in civil law, predominantly utilizes statutes as its primary source of legal authority. Nonetheless, discrepancies in the definitions of legal terminology across different statutes have resulted in ambiguity, especially regarding the interpretation of the term “child.”  The varying definitions of “child” across the Criminal Code, the Civil Code, and other child protection laws contribute to legal ambiguity, particularly regarding the rights and protections available to children in conflict with the law. Law No. 11 of 2012, known as the Juvenile Criminal Justice System Law, specifies that a child is defined as an individual between the ages of 12 and 18. Additionally, it encompasses individuals aged 18 to 21 who have yet to fulfill their sentence. This inconsistency leads to uncertainty about the enforcement of legal penalties and the suitable correctional institutions for these individuals. This study seeks to examine the legal terminology related to “children in conflict with the law” within the framework of the Juvenile Criminal Justice System Law, with an emphasis on the consequences for their placement and rehabilitation in Juvenile Correctional Institutions and Youth Prisons. The study adopts an empirical-normative methodology, incorporating field interviews and document analysis as key components. The findings indicate that varying definitions of “child” create ambiguity in legal application, especially concerning rehabilitation and sanctioning processes. The research offers valuable insights by advocating for the adoption of the term “transitional age” to delineate the differences between children and adults. This would improve legal clarity, safeguard children’s rights, and guarantee rehabilitation programs that are specifically designed to meet their developmental requirements.

Abstract

Cases of sexual violence against women and children with disabilities in West Kalimantan fluctuate annually, with a higher level of vulnerability compared to non-disabled groups. This situation emphasizes the need for more specific and equitable legal protection for disabled groups. This study aims to analyze the forms of legal protection for women and children with disabilities who are victims of sexual violence in West Kalimantan and to propose an ideal concept of legal protection that is inclusive and victim-centered. The method used is a normative-empirical approach through literature review and field research through interviews with several relevant parties. The results of the study indicate that although legal instruments are available, such as Law Number 8 of 2016 concerning Persons with Disabilities, Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, and Government Regulation Number 39 of 2020, their implementation is still suboptimal. Obstacles faced include limited access to information, communication barriers, social stigma, a lack of understanding among law enforcement officers regarding the special needs of persons with disabilities, and the absence of internal regulations at the police level regarding mechanisms for handling victims of disabilities. The ideal concept of legal protection encompasses three aspects: first, the provision of inclusive and accessible sexual education for women and children with disabilities; second, strengthening the capacity of law enforcement officers from a disability perspective; and third, the establishment of internal regulations or Standard Operating Procedures for handling victims of disabilities at the police level to ensure that examination standards for persons with disabilities are tailored to their needs.

Abstract

This research examines the sanctions imposed in the customary law system of the Dayak Mualang and Jangkang communities in Sekadau Regency, focusing on their relation to the concepts of recidivism and the principle of Ne Bis in Idem. The background arises from recurring criminal acts such as theft, domestic violence, and violations of public order, which highlight the limitations of customary sanctions in deterring repeat offenses. The study aims to analyze, first, the recognition and application of recidivism within these communities and its impact on repeated offenses; and second, the factors underlying the imposition of double sanctions for a single act in the absence of Ne Bis in Idem. Using an empirical juridical method, data were collected through field research, interviews with customary leaders, and analysis of legal documents. The findings reveal that the customary law of Dayak Mualang and Jangkang does not recognize recidivism, resulting in repeated offenders receiving the same sanctions without aggravation. Moreover, in certain cases, offenders are subjected to double sanctions by different customary authorities, which is viewed socially as moral accountability rather than legal duplication. However, this practice contradicts modern criminal law principles and creates potential violations of human rights due to legal uncertainty. The research concludes that integrating the principles of recidivism and Ne Bis in Idem into customary law is essential to enhance justice, ensure proportional sanctions, and maintain social harmony in multicultural communities.

Abstract

Introduction: Over Capacity: Correctional institutions continue to be a deeply rooted issue in Indonesia's criminal justice system. This poses a challenge for officers in fulfilling basic rights, especially for vulnerable groups such as women. In addition, the mechanisms for handling women who come into conflict with the law remain susceptible to gender injustice, particularly in terms of fulfilling basic rights such as rehabilitation, facilities and infrastructure, as well as access to what is entitled to inmates.Purposes of The Devotion: This legal counseling aims to increase understanding regarding the mechanisms for handling women in conflict with the law at the Class II A Pontianak Women's Correctional Institution.Method of The Devotion: Legal counseling activities are conducted using a lecture method to deliver material, followed by a question-and-answer session between inmates and the presenter. Observations are conducted for evaluation and monitoring after the counseling session.Results Main Findings of the Devotion: The results of this study indicate that the mechanism for handling Women in Conflict with the Law in relation to legal aid is still not optimal due to the lack of socialization and limited access to obtain it. Therefore, this study is expected to contribute as an effort to increase the understanding of officers and inmates about the handling mechanism related to legal aid for inmates by offering access to legal aid through the Legal Aid Institute at the Faculty of Law, Tanjungpura University.
