Abstract

This research is entitled the impact of family counseling by Islamic Religious Counselors on the recovery process of prisoners in Langkat Narcotics Prison, The problem of drug abuse, both use and illicit trafficking of narcotics at this time is a problem that is difficult to overcome and is constantly discussed. The research problem is to find out and understand the impact of family counseling by Islamic Religious Counselors on the recovery process of prisoners in Langkat Narcotics Prison, the problem of drug abuse. The research method used in this study is a quantitative method, namely one that focuses on the influence between variables that is objective and relatively short. In addition, as a complement, interviews and sampling were also conducted with several prisoners and prison managers. Based on the results of research conducted by the author, the calculated rxy value of 0.597 shows that the value is in the 0.41 - 0.70 group, which means that between variable X and variable Y there is a moderate or sufficient correlation, so it was found that in the research hypothesis, the author stated that There is a relationship between sakinah family counseling by Islamic Religious Counselors and the recovery process for prisoners in the Langkat Narcotics Prison, which was tested by looking for the correlation index value and was found to be acceptable. So it can be concluded that there is a positive and significant relationship between sakinah family counseling by Islamic Religious Counselors and the recovery process of prisoners in Langkat Narcotics Prison

Abstract

Penelitian ini bertujuan untuk menganalisis praktik hibah orang tua kepada anak di Desa SerapuhAsli, Kecamatan Tanjung Pura, Kabupaten Langkat, serta pandangan Majelis Ulama Indonesia (MUI)mengenai hal tersebut. Metode penelitian yang digunakan adalah penelitian kualitatif denganpendekatan empiris (field research), yang mengumpulkan data melalui observasi, wawancara, dandokumentasi. Subjek penelitian melibatkan ulama MUI Kabupaten Langkat dan masyarakat setempat.Hasil penelitian menunjukkan bahwa: 1) Praktik hibah di desa tersebut bertujuan untuk menjagakeharmonisan keluarga dan menghindari potensi konflik terkait pembagian warisan. Hibah dilakukansaat orang tua masih hidup untuk memastikan kesejahteraan anak-anak serta keadilan dalampembagian harta, sehingga dapat diselesaikan dengan transparansi. 2) Hibah di Desa Serapuh Aslitelah menjadi tradisi sebagai alternatif pembagian warisan, dengan penekanan pada perlakuan adilantara anak laki-laki dan perempuan, serta pemberian aset seperti tanah dan rumah untuk manfaatjangka panjang. 3) Pandangan MUI Kabupaten Langkat menyatakan bahwa praktik hibah sesuaidengan ajaran Islam selama dilakukan dengan prinsip keadilan. Keadilan tidak selalu berartipembagian yang sama rata, namun lebih kepada pemenuhan hak dan kebutuhan setiap anak secaraproporsional. Ketidakadilan dalam hibah dapat menyebabkan konflik, sehingga penting untukmelaksanakannya dengan bijaksana. Penelitian ini memberikan kontribusi dalam memahamipentingnya prinsip keadilan dalam pemberian hibah dalam konteks sosial dan agama, sertadampaknya terhadap keharmonisan keluarga

Abstract

This study is entitled The Application of the In Flagrante Delicto Principle in Divorce Cases Based on Adultery at the Stabat Religious Court. This research employs a qualitative method with a descriptive approach. Data were collected through observation, interviews, and documentation. The findings indicate that the in flagrante delicto principle is not positioned as a normative legal basis in divorce cases but is understood as a legal fact assessed within the framework of civil procedural evidence. Judges do not require proof of being caught in the act to establish adultery, as such a requirement is not explicitly regulated in Law Number 1 of 1974, Government Regulation Number 9 of 1975, or the Compilation of Islamic Law. Proof of adultery is conducted based on Article 164 of the HIR and Article 284 of the RBg through a cumulative and comprehensive evaluation of evidence. The perspective of judges at the Stabat Religious Court shows that proving adultery in divorce cases is not intended to establish a criminal offense, but rather to assess whether the marital relationship can still be maintained or has lost its harmonious foundation. Judicial considerations emphasize the impact of the act on the integrity of the household rather than direct proof of adultery, while upholding the principles of prudence, substantive justice, and protection of the parties’ dignity. This approach reflects the objectives of law as proposed by Gustav Radbruch in balancing legal certainty and justice, aligns with Satjipto Rahardjo’s progressive legal thought, and corresponds to the principles of maqāṣid al-sharī‘ah in safeguarding honor and lineage. Juridical obstacles arise due to the absence of explicit regulations governing this principle in civil procedural law and religious court regulations. Practical obstacles include the difficulty of proving adultery, the dominance of indirect and electronic evidence, and ethical and moral dilemmas related to the dignity of the parties. To address these challenges, judges apply principles of prudence, careful assessment, and moral courage to avoid imposi
