Abstract

The lack of public knowledge about Legal Aid and guarantees of public understanding regarding the Procedures for Obtaining Legal Aid that can be received free of charge by underprivileged people causes losses for the community. The aim of this writing is to obtain a clear picture of the reallife system of society, explore understanding of the law and legal problems that exist in society, and help the public obtain free understanding and assistance in resolving legal problems experienced in everyday life. The method in this writing uses empirical legal research methods. So, in this writing we found important steps to increase public awareness about people's rights and how to get access to the free legal assistance they need. Legal education about free legal aid can help people who are unable to understand people's rights and how people can take advantage of free legal aid to overcome the legal problems they are experiencing.

Abstract

Although it is a highly serious human crime, people trafficking still occurs, particularly in West Kalimantan's border region. West Kalimantan's border region has seen a variety of attempts to reduce human trafficking, yet the practice persists still. There is a need for a solution or model that can lessen instances of human trafficking in the West Kalimantan border region, carried out so that the parties involved are unaware of it.This study aims to develop an appropriate model for legal protection to deal with human trafficking at the border West Kalimantan. Methods of the Research, The research will be conducted at the Polres in the Sajingan and Biawak border regions, as stated in the research title. The Sajingan Besar sector's Resort Police and Border Communities are two sources of crime prevention strategies based on legal requirements, The study's findings serve as a model for public protection from human trafficking activities from the perspective of the role of law enforcement officials, the police in the border regions of Sajingan and Biawak, in particular, to combat the crime of trafficking in persons, conduct investigations, and look into cases of human trafficking that happened in the border regions of Sambas Regency, particularly Sajin. The criminal law (penal) is used by the authorities as a model of legal protection to stop human trafficking. However, there is still human trafficking that takes place. Because there are still several barriers to sentencing that do not take into account the elements of a crime. The unlawful behavior in place does not yet constitute the TIP factor. Using criminal law policies and cultural norms to carry out criminal crimes like human trafficking, protecting the public, and implementing coordination with illegal law enforcement policies all help to enhance efforts to combat corruption

Abstract

AbstractThe purpose of this research is to explain the mechanism for imposing sanctions for dishonorable discharge and to analyze the considerations of the Notary Supervisory Board in imposing sanctions for Disrespectful Dismissal. The research method used is an empirical juridical research method. The data collection technique used in this research is secondary data. The results of the research are that the mechanism for imposing sanctions for dishonorable dismissal starts from an examination carried out by the Regional Examining Council, the results will be submitted to the Regional Supervisory Council and will be re-examined by the Regional Examining Council, and the Regional Supervisory Council proposes sanctions for Disrespectful Dismissal to the Central Supervisory Council, then it will The proposal for dismissal is re-examined by the Central Auditing Council, and after that the Central Supervisory Council submits a proposal for the sanction of Disrespectful Dismissal to the Minister of Law and Human Rights for decision. Things that are taken into consideration by the Notary Supervisory Board in imposing sanctions for Disrespectful Dismissal are violations of the notary's obligations and prohibitions as well as the presence of criminal elements in the violations committed by the notary.  Abstrak  Tujuan penelitian ini adalah untuk menjelaskan bagaimana mekanisme penjatuhan sanksi pemberhentian tidak hormat dan menganalisis pertimbangan Majelis Pengawas Notaris dalam menjatuhkan sanksi Pemberhentian Tidak Hormat. Metode penelitian yang digunakan adalah metode penelitian yuridis empiris. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah data sekunder. Hasil penelitian adalah mekanisme penjatuhan sanksi pemberhentian tidak hormat dimulai dari pemeriksaan yang dilakukan Majelis Pemeriksa Daerah, hasilnya akan disampaikan kepada Majelis Pengawas Wilayah dan akan diperiksa kembali oleh Majelis Pemeriksa Wilayah, dan Majelis Pengawas Wilayah mengusulkan sanksi Pemberhentian Tidak Hormat kepada Majelis Pengawas Pusat, selanjutnya akan diperiksa kembali usulan pemberhentian tersebut oleh Majelis Pemeriksa Pusat, dan setelah itu barulah Majelis Pengawas Pusat memberikan usulan sanksi Pemberhentian Tidak Hormat kepada Menteri Hukum dan Hak Asasi Manusia untuk diputuskan. Hal yang menjadi pertimbangan Majelis Pengawas Notaris dalam penjatuhan sanksi Pemberhentian Tidak Hormat adalah adanya pelanggaran terhadap kewajiban dan larangan notaris serta adanya unsur pidana dalam pelanggaran yang dilakukan notaris.

Abstract

AbstractThe modus operandi of the gold jewelry theft perpetrator is to pretend to want to weigh the gold jewelry he carries to determine its weight, then the perpetrator conducts a transaction of buying and selling the stolen gold jewelry to the gold shop. Based on data from Pontianak City Police, the number of cases of purchasing stolen gold jewelry by the owner of gold shops in Pontianak City from 2020 to 2022 amounted to 13 cases. Surprisingly, none of the perpetrators (owners of the gold shops) in these cases were prosecuted under Article 480 of the Criminal Code, which constitutes the crime of receiving stolen goods. The research method used by the author is sociological juridical, which in other words is a type of sociological legal research and can also be called field research. Sociological juridical research is also the identification of law and the effectiveness of law in the social dynamics of society. The reasons why gold shop owners buy stolen gold jewelry in Pontianak City without facing legal action related to the crime of receiving stolen goods is due to the lack of incriminating evidence against these gold shop owners. Efforts that should be undertaken by the Police towards the gold shop owners who purchase stolen gold jewelry in Pontianak City include being more thorough and meticulous in handling cases of gold shop owners who buy stolen gold jewelry in connection with the crime of receiving stolen goods. This is to ensure that the gold shop owners can be held criminally accountable if they fulfill the elements of the crime of receiving stolen goods and to provide legal education to gold shop owners about not purchasing gold jewelry suspected to be the result of theft, as it can be classified as the crime of receiving stolen goods.  AbstrakModus yang dilakukan pelaku pencurian perhiasan emas dengan cara berpura-pura ingin menimbang perhiasan emas yang dibawanya untuk mengetahui jumlah beratnya, kemudian pelaku melakukan transaksi jual beli perhiasan emas hasil tindak pidana pencurian kepada pihak toko emas tersebut. Berdasarkan data dari Polresta Pontianak bahwa jumlah kasus pembelian perhiasan emas hasil tindak pidana pencurian yang dilakukan oleh pemilik toko emas di Kota Pontianak dari tahun 2020 sampai dengan tahun 2022 sebanyak 13 (tiga belas) kasus. Seluruh kasus tersebut yang menjadi dasar permasalahan dalam penelitian ini, ternyata tidak ada satupun pelakunya (pemilik toko emas) yang dilakukan penegakan hukum berdasarkan ketentuan Pasal 480 Kitab Undang-undang Hukum Pidana (KUHP) yang merupakan tindak pidana penadahan. Adapun metode penelitian yang digunakan penulis adalah yuridis sosiologis yang dengan kata lain adalah jenis penelitian hukum sosiologis dan dapat disebut pula dengan penelitian lapangan. Penelitian yuridis sosiologis juga merupakan identifikasi hukum dan efektivitas hukum dalam dinamika sosial kemasyarakatan. Faktor penyebab pemilik toko emas membeli perhiasan emas curian di Kota Pontianak tidak dilakukan penegakan hukum dikaitkan dengan tindak pidana penadahan dikarenakan kurangnya bukti yang memberatkan pemilik toko emas tersebut. Upaya yang seharusnya dilakukan oleh aparat Kepolisian terhadap pemilik toko emas yang membeli perhiasan emas hasil tindak pidana pencurian di Kota Pontianak adalah harus lebih teliti dan jeli dalam penanganan kasus pemilik toko emas yang membeli perhiasan emas curian dikaitkan dengan tindak pidana penadahan, agar pemilik toko emas tersebut dapat dimintakan pertanggungjawaban secara pidana apabila telah memenuhi unsur tindak pidana penadahan dan memberikan penyuluhan hukum kepada pemilik toko emas untuk tidak membeli perhiasan emas yang diduga hasil dari tindak pidana pencurian karena dapat dikualifisir sebagai tindak pidana penadahan.  op owners.Efforts that should be undertaken by the Police towards the gold shop owners who purchase stolen gold jewelry in Pontianak City include being more thorough and meticulous in handling cases of gold shop owners who buy stolen gold jewelry in connection with the crime of receiving stolen goods.
