Abstract

Financial technology (TF) cannot be released by the community both in rural areas or urban areas. TF provides a paradigm shift for the community. TF makes it easy for humans to make financial transactions simply by using a smart phone (HP) that humans can make payment transactions, borrow money. People will certainly choose TF that is safe and reliable and profitable, but sometimes people rarely know that a good and correct TF is a TF that has passed the Regulatory Sandbox (RS) test or a limited trial room. Two Government institutions that are authorized to carry out hospitals are Bank Indonesia (BI) through Bank Indonesia Regulation No: 19/12 / PBI / 2017 concerning Financial Services and Financial Services Authority (OJK) Implementation through “Financial Services Authority Regulation NUMBER 13 /POJK.02/2018 about Digital Financial Innovation in the Financial Services Sector”. The formulation of the problem raised is how is the TF supervision mechanism through the hospital implemented by BI or OJK? The method used in this scientific paper is a normative juridical method, using secondary data in the form of primary legal material consisting of laws and regulations relating to TF, secondary legal material in the form of scientific articles, journals and tertiary legal materials in the form of dictionaries. The research results obtained are that TF must pass the trial in the Regulatory Sandbox applied by BI or OJK. BI and OJK have the authority to determine whether the proposed TF is feasible or not feasible. RS is a significant method, according to the laws and regulations to get a TF that is suitable and safe for consumers and contains dignified justice, justice for business people and consumers.

Abstract

Indonesia as a state based on the rule of law like any other developing countries, its society is based on patterns and economic classes, overall obedience to the law is not easy. In heterogeneous society formed of groups based on religion, race, language, and wealth, it is one of the most difficult unifying factors in terms of compliance with the law. Law deals with complex social, and conflicting societies apply law as a powerful instrument of regulation and control. Although law acts as an independent agent to facilitate their complexity, with economic approach, efficiency is an ideal model that guides legal practice. It is because most people as homo economicus (except children and the profoundly retarded) in all of their activities has one thing in common, that is the need for efficiency, perhaps efficiency is the nearest we are likely to approach to a universal secular “religion”. Efficiency in law simplifies how law works in different society, especially in heterogeneous communities. This approach does not reduce law to economics (or vice versa, for that matter), it claims simply that law and economics have a lot to learn from one another. The primacy of efficiency helps to harmonize the practice of law with social practices. When such law exists, it does function as a social tool aiming at the promotion of economic efficiency that goes well with other social practices.

Abstract

This study examines the policy on restricting children’s internet access following the enactment of Government Regulation No. 17 of 2025 through the lens of Administrative Law and international children’s rights. The growing use of digital platforms by children offers educational benefits but simultaneously exposes them to harmful content, digital exploitation, privacy risks, and potential technology addiction. The study addresses the need for a regulatory framework that ensures child protection while upholding proportionality, justice, and Indonesia’s obligations under the CRC and ICCPR. Using a normative juridical method with statutory and comparative approaches, this research analyses national regulations and compares them with international practices, particularly in Singapore. The novelty of this study lies in its focus on children as a vulnerable group often overlooked in internet restriction debates and its integrative analysis linking national administrative law with international child rights standards. The findings indicate that Government Regulation No. 17 of 2025 constitutes a progressive step toward strengthening child protection in the digital sphere. However, several challenges remain, including unclear age-verification standards, risks of data leakage, and potential limitations on children’s rights to access information and participate in digital environments. This study concludes that clear technical guidelines, robust accountability mechanisms for Electronic System Providers, and enhanced parental digital literacy are essential to ensure effective, proportional, and equitable implementation of the policy.   Penelitian ini menganalisis kebijakan pembatasan akses internet bagi anak setelah diterbitkannya PP No. 17 Tahun 2025 dari perspektif Hukum Administrasi Negara (HAN) dan hak anak internasional. Peningkatan penggunaan platform digital oleh anak memberikan manfaat pendidikan, tetapi juga menimbulkan risiko konten berbahaya, eksploitasi digital, pelanggaran privasi, serta potensi kecanduan teknologi. Penelitian ini menekankan pentingnya regulasi yang tidak hanya berorientasi pada perlindungan anak, tetapi juga selaras dengan prinsip keadilan, proporsionalitas, serta kewajiban Indonesia berdasarkan CRC dan ICCPR. Metode yang digunakan adalah yuridis normatif dengan pendekatan peraturan dan perbandingan, termasuk meninjau praktik negara lain seperti Singapura. Kebaruan penelitian terletak pada fokus terhadap anak sebagai kelompok rentan yang kerap terabaikan dalam diskursus pembatasan internet serta analisis integratif yang menghubungkan HAN dengan standar hak anak internasional. Hasil penelitian menunjukkan bahwa PP No. 17 Tahun 2025 merupakan langkah progresif dalam penguatan perlindungan anak di ruang digital, namun implementasinya masih menghadapi tantangan terkait standar verifikasi usia, risiko kebocoran data, serta potensi pembatasan hak anak atas informasi dan partisipasi. Penelitian ini menyimpulkan perlunya pedoman teknis yang jelas, mekanisme akuntabilitas yang kuat bagi PSE, serta peningkatan literasi digital orang tua untuk memastikan implementasi kebijakan yang efektif, proporsional, dan berkeadilan.
