Abstract

The study of trading will not be separated from the study of industry and investment, they have the close relationship of these three things in determining the competitiveness of a country, especially in the current pattern of global value chain (GVC) trading. The aims of this study are: (a) to analyze the urgency of increasing the competitiveness of national industry in the era of world free trade, and (b) to reconstruct taxation policies to promote industrial competitiveness in the global era. Tax reform should be able to improve competitiveness, and enthusiasm to invest for the investors. Due to growing business will increase tax revenue. The tax policy is very influential on industry, trade, and investment, because according to business people, tax is the biggest investment constraint, besides security, law, labor, regional autonomy, and smuggling issue. The reconstruction of taxation policies through the updating of tax laws includes: simplifying administrative procedures, raising taxpayer awareness, implementing a credible, accountable and consistent self-assessment system, tariffing adjustments to improve competitiveness, and expanding tax bases to increase state revenues. In order to improve competitiveness with other countries, it is necessary to put forward the principles of fairness and neutrality in tariff setting, and provide incentives for small business development. The structure of the prevailing tax rate is simplified in stages, planned, differentiated tariffs, and simplified layers intended to provide a more proportional tax burden for each taxpayer class.

Abstract

In this research author wants make scientific work on fiduciary crimes, If the debitor which transfers goods or mortgaging goods which is a fiduciary guarantee without permission kreditor then the debitor may be subject to fiduciary crime, this research aims to determine: 1).How the role of investigator at the Demak Police station in cracking down on fiduciary crimes in the jurisdiction of demak2).what are the obstacles of an investigator at the Demak Police station in the investigation of fiduciary crime 3).overcoming obstacles in the investigation of fiduciary crime conducted by the investigator at the Demak Police station in the conduct of fiduciary investigation. Research methodology in scientific writing is with approach sosial legal research and the specifications in the study used are deskriftif research. Abstract

Solving problems or conflicts in criminal cases, not necessarily solved through legal channels or through courts. So far, in the process of lawsuit as stipulated in the Criminal Procedure Code, the interest of the victim does not get attention, so that what the victim and the family want can not be fulfilled. The imposition of criminal judgment, not effective because it has not been able to provide deterrent effect for the perpetrator. In addition, the victim's losses are not compensated. Therefore, the settlement of criminal cases by applying restorative justice will be able to provide solutions for the handling of conflicts in the community, involving the perpetrators, victims, communities, and law enfor-cement.Keywords : Restorative Justice, Conflict, and Society

Abstract

Penyuluhan Hukum dan Pendampingan tentang Pendaftaran Izin Usaha Mikro Kecil (IUMK) di Kota Semarang melalui Sistem Online Single Submission (OSS) berdasarkan Peraturan Pemerintah Nomor 24 Tahun 2018 ini, berangkat dari hasil penelitian yang menunjukkan bahwa problematika pelaksanaan pendaftaran legalitas usaha UMKM melalui Sistem OSS di Kota Semarang, terutama karena kurangnya sosialisasi dan edukasi kepada pelaku UMKM. Pelaksanaan pengabdian masyarakat dalam bentuk penyuluhan hukum dan pendampingan kepada sejumlah 35 pelaku UMKM di Kecamatan Semarang Selatan. Tingkat antusiasme peserta cukup tinggi dimana peserta banyak mengajukan pertanyaan seputar legalitas usaha dan berminat untuk mengurus legalitas usahanya. Ada salah satu peserta yang membagikan pengalamannya mengurus legalitas usahanya dan manfaat yang telah dirasakan dalam meningkatkan pertumbuhan usaha. Pengabdian masyarakat ini bertujuan untuk meningkatkan kesadaran hukum pelaku UMKM untuk mengurus legalitas usahanya. Metode peningkatan kesadaran hukum dengan memberikan penyuluhan dan pendampingan. Adapun materi sosialisai meliputi UU No. 20 Tahun 2008 tentang UMKM dan Perda No. 13 Tahun 2013 tentang Pemberdayaan UMKM; Peraturan Pemerintah Nomor 24 Tahun 2018 tentang Pelayanan Perizinan Berusaha Terintegrasi Secara Elektronik/Online Single Submission (OSS). Pelaku Usaha Mikro, Kecil, dan Menengah sebagai salah satu pelaku pembangunan ekonomi di daerah perlu diberdayakan melalui pengembangan sumber daya manusia, dukungan permodalan, produksi dan produktifitas, perlindungan usaha, pengembangan kemitraan, jaringan usaha dan pemasaran serta legalitas usahanya melalui Online Single Submission (OSS). Hasil penyuluhan dan pendampingan menunjukkan peningkatan pemahaman dan kesadaran hukum UMKM untuk mengurus legalitas usahanya. Kata Kunci: Izin Usaha; Pendaftaran; Penyuluhan Hukum; Sistem OSSAbstractLegal Counseling and Assistance on the Registration of UMKM Business Legality in Semarang through the Online Single Submission System (OSS) based on PP Number 24 of 2018 departs from the results of research showing that the problematic implementation of the registration of the legality of MSME businesses through the OSS System in Semarang City, mainly due to lack dissemination and education to SMEs. Implementation of community service in the form of legal counseling and assistance to a number of 35 SMEs in the South Semarang District. The level of enthusiasm of the participants was quite high where participants asked many questions about the legality of the business and were interested in taking care of the legality of the business. There was one participant who shared his experience taking care of the legality of his business and the benefits that have been felt in promoting business growth. This community service aims to increase the legal awareness of SMEs to take care of the legality of their business. Methods of increasing legal awareness by providing counseling and assistance. The socialization material includes Law No. 20 of 2008 concerning UMKM and Perda No. 13 of 2013 concerning Empowerment of MSMEs; Government Regulation Number 24 of 2018 concerning Online Single Submission (OSS) Licensing Services. Micro, Small and Medium Enterprises as one of the economic development actors in the regions needs to be empowered through human resource development, capital support, production and productivity, business protection, partnership development, business and marketing networks and business legality through Online Single Submission (OSS). The results of counseling and mentoring showed an increase in understanding and legal awareness of MSMEs to take care of the legality of their business.Keywords: Business Legality; Legal Education; OSS System; Registration

Abstract

The problem in this research are: enforcement of the circulation of the liquor and the constraints of the enforcement of the circulation of liquor. Based on the results of the study concluded that: The police in law enforcement there are two (2) actions that persuasive action and repression which has its own purpose. In a persuasive action the police take preventive where often do counseling, provide guidance to the public about the dangers of alcohol. And invite various parties such as RT, RW, community leaders participated sertaandil in helping oversee the circulation of alcohol in their area. Constraints experienced as an investigator in conducting criminal investigations liquor circulation happens, is as follows: 1) Internal factors. In carrying out the investigation on the crime of liquor one such constraints is the current infrastructure of the police in tackling the crime of trafficking of liquor due to the lack of laboratory criminals who facilitate the investigation, because this place is useful as a means to prove with the naked eye between liquor original or fake. Lack of socialization conducted by the police. 2) external factors. This factor is of a society, of public awareness is relatively low which affects the smoothness in investigating criminal offenses circulation of alcohol, lack of awareness of the consequences of alcohol. Keywords: Law Enforcement; Circulation; Liquor.

Abstract

ABSTRACT  This research is entitled The Authority of Police in Handling Mining Criminal Act According to Law Number 4 Year 2009 (Study in Indonesian National Police). The purpose of this research: 1) To know and analyze the authority of Police in handling illegal mining according to Law Number 4 Year 2009 regarding Mineral and Coal Mining. 2) To evaluate preventive and repressive efforts by the Police in illegal mining in Indonesia.Research Result: 1) The authority of the Police is the authority as stipulated in Law Number 2 Year 2002 regarding the Police of the Republic of Indonesia. The duties and powers of the Police are regulated in detail in Chapter III. In the execution of duties (Articles 13 and 14), the Police are granted the authority described in Article 15 and Article 16 with further provisions in Article 17, Article 18, and Article 19. 2) a. Preventive efforts in conducting patrols, raids, security operations conducted routinely and provide socialization to the public about the importance of creating security and how to overcome illegal stone mining and approaching with local residents to do pekon not to do illegal mining activities. While repressive efforts are done by optimizing the efforts of prosecution and collect evidence to act legally illegal mining actors with the provision of sanctions firm and deterrent effect and through mediation of the parties litigation so that the perpetrators do not need to be processed through criminal sanctions.Key Words: Police Authority, Crime, Mining ABSTRAKPenelitian ini berjudul Kewenangan Kepolisian Dalam Menangani Tindak Pidana Pertambangan (Ilegal Mining) Menurut Undang-Undang Nomor 4 Tahun 2009 (Studi di Kepolisian Negara Indonesia). Tujuan Penelitian ini : 1) Untuk mengetahui dan menganalisis kewenangan Polri dalam menangani ilegal miningmenurut Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batu Bara. 2) Untuk mengevaluasi upaya preventifdan upaya represif yang dilakukan oleh Polri dalam Tindak Pidana Pertambangan (ilegal mining) di Indonesia.Hasil Penelitian : 1)Kewenangan Polri adalah wewenang yang tertuang dalam Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia. Tugas dan wewenang Polri diatur secara terperinci di dalam Bab III. Dalam pelaksanaan tugas (Pasal 13 dan Pasal 14), Polri diberikan wewenang yang dijabarkan dalam Pasal 15 dan Pasal 16 dengan ketentuan lebih lanjut pada Pasal 17, Pasal 18, dan Pasal 19.2) a. Upaya secara preventif yaitu melaksanakan patroli, razia, operasi keamanan yang dilakukan secara rutin dan memberikan sosialisasi kepada masyarakat tentang pentingnya menciptakan keamanan serta cara mengatasi penambangan batu ilegal serta melakukan pendekatan dengan warga sekitar melakukan rembuk pekon untuk tidak melakukan kegiatan penambangan batu secara liar. Sedangkan upaya represif yang dilakukan adalah dengan mengoptimalkan upaya penindakan serta menghimpun bukti-bukti guna menindak secara hukum pelaku penambangan batu secara liar dengan pemberian sanksi tegas dan berefek jera serta melalui mediasi terhadap para pihak yang berperkara sehingga pelaku tidak perlu di proses melalui sanksi pidana.Kata Kunci : Kewenangan Kepolisian, Tindak Pidana,Pertambangan

Abstract

To be implemented lending by banks, there must be an agreement between the banks as creditors and customers as debtors called credit agreement. In providing credit to the public, the Bank must be sure that the funds lent to the community it will be returned on time, with interest and with the terms that have been agreed between the bank and the customer that have been set forth in the credit agreement. In completing this study, the authors use a step to find data and collect data either through the study of literature and other data sources and to analyze the subject and object data obtained through sosiogis juridical approach, while sampling was conducted through interviews with directional type. This study focused on the integration or coherence in the manufacture / preparation of bank loan agreement and accommodate interests of the parties in a balanced manner in the bank credit agreement. The credit agreement that accommodates the interests of the parties in a balanced manner is expected to provide benefits and fairness to the parties that lead to the achievement of the objectives of law, the object of study in this research is related to the case of default on the decision number 336 / Pdt / G / 2016 / PN.SMGthat involving PT. Abstract

The purpose of this study was to determine the legality of the deed of AD / ART PT Perkebunan Nusantara IX after the consolidation of PTP XV-XVI (Persero) with PTP XVIII (Persero). This research method using normative legal research. The data used is secondary data that is material that provides an explanation of primary legal materials; in the form of deed of AD / ART PT Perkebunan Nusantara IX. Data were analyzed by descriptive qualitative method. The results showed Deeds AD / ART PT Perkebunan Nusantara IX Post-Consolidation PTP XV-XVI (Persero) With PTP XVIII (Persero), in accordance with the process and the provisions of the legislation in force. Abstract

The problem in this research are: 1) The factors that affect juvenile delinquency caused by consuming alcohol 2) The handling of juvenile delinquency caused by consuming alcohol. The purpose of this study were 1) To identify and explainfactors that affect juvenile delinquency caused by consuming alcohol. 2) To identify and explain the handling of juvenile delinquency caused by consuming alcohol.Based on the results of the study concluded that: 1) The factors that influence the habit of drinking in teenagers is a curiosity, social environment, family environment, the influence of alcohol sales freely, and as a result of the rule of law (sanctions and fines lightweight). 2) Disaster of drinking habits in teenagers by the police is divided into two stages: a preventive and repressive. Namely preventive measures, early efforts made by the police to prevent all crimes include socialization, raid the alcohol, and Binamitra (one of strategy in police), while the repressive efforts, action to suppress and restrain delinquency or impede the onset of delinquency greater events include foreclosure, arrest, legal action.Keywords : Handling; Delinquency; Alcohol.

Abstract

Local taxes can be used as one means to support regional development. However, until now there has been realized harmonization between budgetary functions and regulerend functions in the area of tax collection, especially for SMEs. Taxation for SMEs can be a burden that affects its survival. Noteworthy aspects of justice fore tax burden for SMEs, even tax revenues should be used to encourage the growth of SMEs through training, capital, business facilities and so forth. Development of the area in the future design of tax policy needs to consider the ability to pay and the principle of benefit to raise taxes on SMEs.
